LABOR MANAGEMENT AND SAFETY COMMITTEE. Section 4.1 - COMPENSATION. MEETINGS AND AGENDAS The Board, and its designated representatives, and the Union, and one (1) representative from each department recognized in this Agreement, bus drivers, cooks, cafeteria aides, custodians, licensed engineers, and secretaries, (chosen by the union) shall meet to discuss matters of mutual interest other than those included in this Agreement as follows; A. A meeting shall be held upon written request of either party within fifteen (15) working days of receipt of the request. B. Along with the request for the meeting, there must be an agenda of the items to be discussed at the meeting. No items will be on the agenda for discussion unless they have been previously discussed with the supervisor or department head involved. Minutes of the meeting will be kept on a monthly basis with the Union keeping the minutes for one meeting and the Board keeping them for the next meeting. Minutes will be provided to both parties. C. All meetings shall be held in a school district building and shall be held at a mutually agreeable time. The meetings shall not exceed two (2) hours unless the parties mutually agree to extend the meeting time beyond two (2) hours. D. The Board will give a timely response if appropriate with respect to items on the agenda.

LABOR MANAGEMENT AND SAFETY COMMITTEE. Section 11.1. The Labor Management and Safety Committee shall consist of the Mayor, Safety Director or his designee, the Chief of Police or his designee, and two (2) members of the bargaining unit. It is mutually agreed that this committee may meet on a quarterly basis or as mutually agreed, or after a written request from either party for the following purposes: 1. To disseminate general information of interest to the parties. 2. To give the FOP Representatives the opportunity to share the views of their members and/or suggestions on the subjects of interest to their members. 3. To discuss ways to improve efficiency within the Department. 4. To promote harmonious relations between the City and the FOP in the best interest of the community. 5. To discuss safety and health issues of the Department. Section 11.2. Occupational safety and health is a mutual concern of the FOP and the Employer. The FOP will cooperate with the Employer in encouraging employees to comply with applicable safety rules, regulations, and common knowledge safety standards of the law enforcement industry. The Employer agrees to operate and maintain a safe working environment for all bargaining unit members. Section 11.3. The Employer and the FOP shall comply with all applicable federal and state laws, rules, and regulations with regard to safety. Section 11.4. All bargaining unit members are responsible to report, in writing, all unsafe conditions relating to police operations to the Chief of Police. No bargaining unit member shall be subject to any disciplinary action for such reporting. Section 11.5. If the unsafe condition remains uncorrected after five (5) calendar days, it may be subject to the Grievance and Arbitration Procedure of this Agreement. Section 11.6. The Employer shall not instruct any bargaining unit member to operate any equipment, which anyone in the exercise of ordinary care would reasonably know might cause injury. However, if the officer in charge at the time concludes that the equipment is not unsafe, the employee shall operate the equipment. Said officer’s decision is subject to the Grievance and Arbitration Procedure. Section 11.7. The FOP recognizes the right of the Employer to establish and change safety rules. Any new or changed rule(s) will be communicated to the Labor Management and Safety Committee for discussion. Section 11.8. LABOR MANAGEMENT AND SAFETY COMMITTEE. The parties agree to establish a joint Labor-Management Committee which shall consist of an equal number of Management and Union members. This Committee shall meet on a quarterly basis or as mutually agreed. The purpose of this Committee is to discuss the following: (A) Matters of general information which may include safety and health concerns; (B) This Committee shall not discuss grievances. However, unresolved matters, including safety and health concerns, may be subject to the grievance procedure; (C) This Committee shall meet during regular duty time where possible, and, consequently, employees on that shift shall not suffer any loss of compensation for attending such meetings. Nevertheless, the City will not compensate employees who come in off duty for these meetings; and (D) Failure of either party to implement an item agreed upon in the Labor- Management or Safety Committee may be a valid subject of the grievance/arbitration procedure or discipline.
LABOR MANAGEMENT AND SAFETY COMMITTEE. The University will provide the proper training, safety equipment and protective clothing to those employees who are required to use equipment to perform their job assignments and will continue to promote safe work- ing conditions for all members of the University community. The Union will encourage safety in all matters with its members and will promote the safety rules and regulations established by the University safety program. The University and the Union shall form a Labor-Management and Safety Committee which will be respon- sible for developing partnering strategies and establishing programs that will lead to cooperative and col- laborative labor-management relations. The Labor-Management and Safety Committee shall meet no to discuss issues and concerns important to the employees and the University on the last Wednesday of every calendar month unless mutually agreed upon. A standing agenda item for each meeting shall be the safety concerns of the Union and/or University. Meetings may be scheduled on a different frequency by mutual consent, but no fewer than two (2) times during each contract year. The Union will have no more than eleven
LABOR MANAGEMENT AND SAFETY COMMITTEE. Section 9.1. In the interest of sound labor/management relations, unless mutually agreed otherwise, twice each year on a mutually agreeable day and time, the Employer and/or designee(s) shall meet with not more than three (3) representatives of AFSCME to discuss pending problems and to promote a more harmonious labor/management relationship. Such meeting shall be scheduled for no more than three (3) hours, unless mutually agreed otherwise. Section 9.2. The party requesting the meeting shall propose an agenda at least five (5) working days in advance of the scheduled meeting with a list of matters to be taken up in the meeting and the names of those AFSCME representatives who will be attending. The purpose of such meeting shall be to: A. Discuss the administration of this Agreement. B. Notify AFSCME of changes made by the Employer which affect bargaining unit employees. C. Discuss grievances which have not been processed beyond the final step of the grievance procedure when such discussions are mutually agreed to by the parties. D. Disseminate general information of interest to the parties. E. Discuss ways to increase productivity and improve effectiveness. F. To consider and discuss health and safety matters relating to employees. Section 9.3. It is further agreed that if special labor/management meetings have been requested, and mutually agreed upon, they shall be convened as soon as possible. If a special labor/management meeting is requested by either party to discuss an emergency health and safety matter, it shall be convened within ten (10) business days of the request. Any decision by the Employer regarding the issue raised at the meeting shall be issued to the Union within fifteen (15) business days of the close of the meeting. Section 9.4. The Employer shall provide the information listed in Section 12.3 of this Agreement to the Union prior to each of the bi-annual meetings listed in Section 9.1, above, if requested, along with any assigned work phone number and work e-mail address on file. Such information will be sent to the Staff Representative electronically.

The Labor Management and Safety Committee shall consist of two representatives of the Communications Center and two members of the bargaining unit. It is mutually agreed that this committee shall at the request of either party, meet on a quarterly basis, and as mutually agreed at any other time for the purpose of: 1. Disseminating general information of interest to the parties, 2. Giving the FOP Representatives the opportunity to share the views of their members and/or suggestions on the subjects of interest to their members, 3. Discussing ways to improve efficiency within the Department, 4. Promoting harmonious relations between the Employer and the FOP in the best interest of the community, 5. Discussing safety and health issues of the Department. Section 37.2. The County will make every effort to maintain equipment in a safe and healthful condition. No employee shall be required to exercise his/her duties with unsafe equipment. Unsafe equipment is defined as that which is in a condition of damage or disrepair that it will no longer safely perform the function for which it was intended. This provision shall not apply to any equipment owned or maintained by the employee as the employee is required to maintain his/her personal equipment in an operable and safe fashion. Employees must comply with all safety rules and regulations. Failure to comply is grounds for disciplinary action. Section 37.3. All bargaining unit members are responsible to report, in writing all unsafe conditions relating to Communications Center operations to the Director. Section 37.4. The Employer shall not instruct any bargaining unit member to operate any equipment which anyone in the exercise of ordinary care would reasonably know might cause injury. However, if a supervisor in charge at the time concludes that the equipment is not unsafe, the employee shall operate the equipment. Said supervisor’s decision is subject to the Grievance and Arbitration procedure. Section 37.5. The FOP recognizes the right of the Employer to establish and change safety rules. Any new or changed rule(s) will be communicated to the Labor Management and Safety Committee for discussion. Section 37.6. All bargaining unit members of the Labor Management and Safety Committee shall be paid at their regular rate of pay while attending committee meetings on duty.

LABOR MANAGEMENT AND SAFETY COMMITTEE. The Company and Union agree that there shall be a Labor-Management Committee consisting of an equal number of Management and Union members (maximum of three [3]) to apprise each other of issues related to the operations and the work force; all with the aim of promoting a better understanding between the parties. Meetings will be held monthly, or more often as may mutually be agreed. A written agenda shall be established for each meeting. Such meetings shall not be construed as opening the Agreement for negotiations, nor shall any subject matter at the meetings constitute a step in the grievance procedure. Employees shall be paid at their regular hourly rate for time spent at Labor-Management Committee meetings. Each party will designate their representative(s) to the Labor-Management Committee. Following the discussion of matters pertaining to operations, the Committee shall address issues of health and safety, for the purpose of identifying and eliminating potential safety hazards throughout the facility and to reduce accidents.

A standing agenda item for each meeting shall be the safety concerns of the Union and/or University. Meetings may be scheduled on a different frequency by mutual consent, but no fewer than two (2) times during each contract year. The Union will have no more than eleven (11) members on the Labor Management and Safety Committee, with at least one member each from Physical Facilities and Campus Services. Members of the Labor Management and Safety Committee will serve with no loss of regular straight time pay. Where safety concerns or issues arise, employees should promptly inform the University of those concerns rather than waiting for the next Labor Management and Safety Committee meeting. Nothing in this article shall be construed to limit the University's ability to conduct safety meetings outside of the Labor Management and Safety Committee context, including at the departmental level.
LABOR MANAGEMENT AND SAFETY COMMITTEE. At the request of the Union (by its President or designee) or of the Village (by the Fire Chief or designee), the parties shall meet at least semi-annually, or more frequently if mutually agreed, to discuss matters of mutual concern including safety matters that do not involve negotiations or the grievance procedures. Each party may have up to two additional persons attend such meetings. The party requesting the meeting shall submit a written agenda of the items it wishes to discuss at least three (3) calendar days prior to the date of the meeting; the respondent may add to the agenda up to 24 hours prior to the meeting. Such meetings may be held during working hours, provided they do not interfere with the operations of the Fire Department, as determined by the Fire Chief.
