Leave of Absence - Personal. Subject to staffing requirements and following six (6) months of employment, the employer may grant an employee a leave of absence without pay, not to exceed three (3) calendar months duration. Employees will be automatically terminated if they accept other employment during this leave. Employees will maintain and accumulate seniority during leave.

If an employee does engage in gainful employment which has not been mutually agreed to while on such leave of absence, the employee will forfeit all seniority rights and privileges contained in this Agreement.

Leave of Absence - Personal. Employees, other than short term or temporary employees, who have been employed by the District for two or more consecutive fiscal years may be granted unpaid leave of up to twenty-six (26) weeks for documented medical or other disability reasons involving the employee or immediate family members of the employee. Requests for leave shall be submitted to the Superintendent, or designee, at least 30 calendar days before the leave is to commence and must be approved by the Board of Education in advance. Requests for leave under this provision shall be submitted with a physician’s written statement setting forth the basis for the requested leave. During the unpaid leave, the employee may continue existing District group health insurance coverage at the District’s expense as provided in Paragraph 12.1 of this Agreement. Upon return from leave the employee shall be placed in a position comparable to the position the employee had when leave commenced provided the employee can perform the essential job duties of the position offered. This leave is in addition to Family Medical Leave (FMLA).

Written requests for such unpaid leave, up to a maximum of ten (10) working days, will be considered and persons who are absent with written permission for such leave shall not be considered to be laid off, and their seniority shall continue to accumulate during their absence. A copy of the Leave of Absence shall be given to the Union Plant Committee. Employees shall be permitted to accumulate, in full shift increments, up to 5 days leave of absence during the calendar year and then, once the 5 days of leave of absence have been utilized, apply to cash out a maximum of one weeks’ vacation to offset the wage loss incurred.
