Retention of Management Rights. The Union recognizes the right of the University to operate and manage the University, including but not limited to the right to take actions reserved to management by RCW 41.80.040; to require standards of performance and to maintain order and efficiency; to direct employees and to determine job assignments and working schedules; to determine the materials and equipment to be used; to implement improved operational methods and procedures; to determine staffing requirements; to determine the kind and location of facilities; to determine whether the whole or any part of the operation will continue to operate; to select and hire employees; to promote and transfer employees; to discipline, demote and discharge employees for just cause; to lay off employees; to recall employees; to require reasonable overtime work of employees; and to promulgate rules, regulations and personnel policies, provided that such rights will not be exercised so as to violate any of the specific provisions of this Agreement or applicable rules or laws. The retention of these rights does not preclude any employee from filing a grievance if she/he believes the exercise of such rights constitutes a violation of this Agreement.
Retention of Management Rights. The Board, on its own behalf and on behalf of the electors of the District, hereby retains and reserves unto itself all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and Constitution of the State and of the United States, which generally includes the right:
A. To maintain executive management and administrative control of the District and its properties and facilities.
B. To hire all employees and, subject to the provisions of the law and this agreement, to determine their qualifications and their continued employment and to promote, transfer and assign such employees.
C. To direct its employees.
D. To establish educational programs, courses of instruction, extra-curricular programs and to determine the means, methods and personnel by which such programs are to be provided. All employee created resources are bound by Copyright Board Policy 5:170. The exercise of Management Rights shall be limited by the contract and the Constitutions and laws of the State of Illinois and the United States.
Retention of Management Rights. Nothing in this Article shall limit the City’s rights as set forth in Article 4. Management Rights, nor shall it prevent the City from periodically analyzing its operation for the purpose of identifying cost-saving opportunities.
Retention of Management Rights. The College retains all powers, rights, authority, duties, and prerogatives conferred upon it by the laws of the State of Florida or enjoyed prior to the execution of this Agreement, except as otherwise expressly stated in this Agreement, which shall include, but are not limited to, the following rights:
a. To establish educational policies and procedures and to ensure the rights and educational opportunities of students;
b. To manage and administratively control the College and its properties, its facilities, and the activities of its employees;
c. To hire all faculty and instructors and, subject to the provisions of law, to determine their qualifications and the conditions of their continued employment, and to promote, assign, and transfer all such faculty and instructors;
d. To determine the time and hours of operation and the assignment of all classes and approval of all schedules;
e. To determine the kinds and levels of services to be provided and the methods and means of providing those services, including entering into contract(s) with privatevendors for services;
f. To determine staffing patterns;
g. To determine the number and classification of personnel needed;
h. To control and regulate the use of machinery, facilities, equipment, intellectual property networks, and other property of the College;
i. To determine, establish, increase, reduce, or eliminate the number, location, and operation of programs, departments, divisions, and all other units of the College;
j. To build, move, modify, or close facilities, centers, or campuses;
k. To establish budget procedures and determine budgetary allocations;
l. To determine and implement the methods of raising and using revenue; including without limitation and federal appropriations, grants and donations.
m. To take action on any matter in the event of an emergency;
n. To schedule classes and to assign faculty and instructors to meet the needs of the students, the community, and the College;
o. To develop, maintain, and enforce administrative rules, procedures, policies,regulations, and practices.
Retention of Management Rights. It is understood and agreed that the Library has all the customary and usual rights, powers, functions, and authority of management. Any of the rights, powers, functions, or authority which the Library had prior to the signing of this Agreement are retained by the Library, except as those rights, powers, functions, or authority are specifically abridged or modified by this Agreement. Accordingly, the Library retains all the rights identified in the Constitution and laws of the United States of America and of the State of Ohio and in Ohio Revised Code Section 4117.08.
Retention of Management Rights. The Township retains the exclusive right to manage the operations, control the premises, direct the working force and maintain efficiency of operations. The Township specifically retains the rights and responsibilities set forth in Section 4117.08(C) of the Ohio Revised Code to:
1. Determine matters of inherent managerial policy which include, but are not limited to areas of discretion or policy such as the functions and programs of the public employer, standards of services, its overall budget, utilization of technology, and organizational structure.
2. Direct, supervise, evaluate, or hire Members.
3. Maintain and improve the efficiency and effectiveness of governmental Operations.
4. Determine the overall methods, process, means, or personnel by which Governmental operations are to be conducted.
5. Suspend, discipline, demote, or discharge for just cause, or lay off, transfer, assign, schedule, promote, or retain Members.
6. Determine the adequacy of the work force.
7. Determine the overall mission of the employer as a unit of government.
8. Effectively manage the work force.
9. Take actions to carry out the mission of the public employer as a governmental unit. The exercise of the foregoing powers, rights, authority, duties and responsibilities, the adoption of policies, rules and regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and then only to the extent so limited.
Retention of Management Rights. 3.01 Except as expressly modified or restricted by a specific provision of the Agreement, all statutory and inherent managerial rights prerogatives and functions are retained and vested exclusively with the Employer, including, but not limited to, the rights in accordance with the Employer’s sole and exclusive judgment and discretion:
1. to reprimand, suspend, discharge, or otherwise discipline employees for just cause;
2. to determine the number of employees to be employed and the location of jobs;
3. to hire employees, determine their qualifications and assign and direct their work;
4. to promote, demote for just cause, lay off, transfer or recall to work employees;
5. to maintain the efficiency of operations;
6. to set the standards of productivity and/or services as to quality and quantity to be rendered;
7. to determine the personnel, methods, means and facilities by which operations are conducted;
8. to set the starting and quitting time and number of hours and shifts to be worked in accordance with Article XI;
9. to expand, reduce, alter, transfer, assign jobs, departments or operations in compliance with this Agreement;
10. to close down or relocate the Employer’s operations or any part thereof;
11. to control and regulate the use of machinery, facilities, equipment, supplies and other property of the Employer;
12. to introduce new equipment or improved methods, production, distribution, procedures, processes and maintenance methods, materials, machinery and equipment;
13. to determine the number, location and operation of departments, divisions and other units of the Employer;
14. to require the observance of safety rules, operating procedures and policy;
15. to determine the methods of compliance with various federal and state regulations; and to take whatever action is either necessary or advisable to determine, manage and fulfill the mission of the Employer and to direct the Employer’s employees;
16. upon notification to the Union to issue, amend, revise, abolish and enforce reasonable policies, rules, regulations and practices for the operation of the plant and conduct of the employees. Any differences of opinion over the reasonableness of such policies, rules, regulations or practices shall be subject to the grievance procedure commencing at Step 4 within seven (7) days after the Employer’s notification. In exercising these rights the Employer agrees to observe the other provisions of the Agreement.
3.02 The Employer’s or the Union’s failure ...
Retention of Management Rights. The Union recognizes the right and authority of the Township to administer the business of the Township, and in addition to other functions and responsibilities which are required by law, the Union recognizes that the Township (including, in certain instances, the Fire Chief) has and will retain the full and exclusive right and responsibility to manage the operations of the Department, to direct the work force, to promulgate rules and regulations and to otherwise exercise the prerogatives of management, which more particularly include, but are not limited to, the following:
A. To manage and direct its employees, including the right to select, hire, promote, transfer, assign, evaluate, lay off and recall or to reprimand, suspend, discharge or discipline for just cause to maintain order among employees;
B. To manage and determine the location, type and number of physical facilities, equipment, programs, and to determine the work to be performed;
C. To determine the Department's goals, objectives, programs and services, and to utilize personnel in the manner designed to effectively meet these purposes;
D. To determine the size and composition of the work force in the Township's organizational structure, including the right to relieve employees from duty due to layoff or job abolishment;
E. To determine and otherwise arrange the hours of work and work schedules required to most efficiently operate;
F. To determine when a job vacancy exists, the duties to be included in all job classifications, and the standards of quality and performance to be maintained;
G. To determine the necessity to schedule overtime and the amount required thereof;
H. To maintain the security of records and other important information;
I. To determine the overall budget;
J. To maintain and improve the efficiency and effectiveness of the Township's operations; and
K. To determine and implement necessary actions in emergency situations. The exercise of the foregoing powers, rights, authority, duties and responsibilities, the adoption of policies, rules and regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement, and, then only to the extent so limited, and actions and/or decisions by the Township relating to the foregoing shall not be grievable or otherwise subject to challenge in any court or other tribunal.

I. Take action to carry out the mission of the public employer as a governmental unit. The exercise of the foregoing powers, rights, authority, duties and responsibilities, the adoption of reasonable policies, rules and regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement, and, except where so limited and then only to the extent so limited and further subject to the conditions and qualifications contained in Article V, hereof, actions and/or decisions by the Township relating to the foregoing shall not be grievable. The Township is not required to bargain with the Union during the term of this Agreement on subjects reserved to its management and direction, except as affect wages, hours, terms and conditions of employment and the continuation, modification or deletion of a provision of this Agreement.

The Employer retains all powers, rights, authority, duties and prerogatives conferred upon it by the laws of the State of Florida or enjoyed prior to the execution of this Agreement, except as otherwise stated in this Agreement, which rights shall include but are not limited to the following rights:
A. To establish educational policies and procedures and to ensure the rights and educational opportunities of students;
B. To manage and administratively control the College and its properties, its facilities and the activities of its employees;
C. To hire all faculty and, subject to the provisions of law, to determine their qualifications and the conditions of their continued employment, discipline, dismissal or demotion; and to promote, assign and transfer all such faculty;
D. To determine the time and hours of operation;
E. To determine the kinds and levels of services to be provided and the methods and means of providing those services, including entering into contract(s) with private vendors for services;
F. To determine staffing patterns;
G. To determine the number and classification of personnel needed;
H. To control and regulate the use of machinery, facilities, equipment and other property of the College;
I. To determine, establish, increase, reduce, or eliminate the number, location and operation of programs, departments, divisions, and all other units of the College;
J. To build, move, modify, or close facilities, centers, or campuses;
