RIGHTS OF THE DISTRICT. Except as limited specifically by the express terms of this Agreement, the District retains all of the rights and authority conferred upon it by the laws of the State of California to direct, manage, and control the affairs of the District. Such rights of the District include, but are not limited to: (a) The right to determine its organizational structure and to delegate its rights and responsibilities to the Superintendent-President and to such other officials, persons, divisions, departments, and committees as it shall determine from time to time; (b) The right to determine its financial structure including (i) all decisions and conditions relating to all sources of District income, (ii) all investment policies and practices, and

RIGHTS OF THE DISTRICT. Section 1. Subject to the specific terms and conditions of this Agreement, the District retains and reserves unto itself, without limitation, all of the rights, authority, duties, and responsibilities conferred upon it and vested in it by the laws and Constitution of the State of California to direct, manage and control the affairs of the District. Such rights of the District include, but are not limited to: (a) The right to determine its organizational structure and to delegate its rights and responsibilities to the President, and to such other officials, persons, institutes, divisions and committees it shall from time to time determine; (b) The right to determine its financial structure including (i) all decisions and conditions relating to all sources of District income; (ii) all investment policies and practices; and, (iii) all budgetary matters and procedures, to wit, the budget calendar, the budget formation process, accounting methods, payroll practices, fiscal and budget control policies and procedures, and all budgetary allocations, reserves and expenditures; (c) The right to acquire, administer, and dispose of all District property whether real or personal and whether owned, leased or otherwise controlled, including all land, buildings, facilities, grounds, fixtures, machinery and other improvements; (d) The right to determine all services to be rendered to the students and to the public, including the nature, methods, quantity, quality, frequency and standards of service and the personnel, facilities, vendors, suppliers, materials, vehicles, equipment, and tools to be used in connection with such services, the contracting of services to be rendered and functions to be performed, including educational support, educational aids and devices, structural maintenance and repair services; (e) The right to determine the utilization of personnel, including the determination of the number of Adjunct Faculty Member positions, the addition or elimination of personnel, the determination of the use of certificated management and supervisory personnel, the selection of Adjunct Faculty Members, the determination of the assignment and reassignment of all Adjunct Faculty, and management and supervisory employees of the District; (f) The right to establish educational policies, goals and objectives based on the District’s mission and the right to determine all matters related to student personnel services; (g) The right to determine the assignment of Adjunct Facul...
RIGHTS OF THE DISTRICT. ‌ Except as limited specifically by the express terms of this Agreement, the District retains all of the rights and authority conferred upon it by the laws of the State of California to direct, manage and control the affairs of the District. The District shall provide adequate notice and consult with ECCE before implementation of policies and/or practices which have an impact on the terms and/or conditions of employment for classified employees in the bargaining unit. Such rights of the District include, but are not limited to: (a) The right to determine its organizational structure and to delegate its rights and responsibilities to the Superintendent - President and to such other officials, persons, departments, divisions and committees as it shall from time to time determine; (b) The right to determine its financial structure including (1) all decisions and conditions relating to all sources of District income, (2) all investment policies and practices, and
RIGHTS OF THE DISTRICT. Section 5.1. It is understood and agreed that the District retains all of its powers and authority to direct, manage and control the operations of the District to the full extent of the law. Included in but not limited to those duties and powers are the exclusive rights to: determine its organization; direct the work of its employees; determine the time and hours of operation; determine the kinds and levels of services to be provided, and the methods and means of providing them; establish its educational policies, goals and objectives; ensure the rights and educational opportunities of students; determine staffing patterns; determine the number and kinds of personnel required; maintain the efficiency of District operations; determine the curriculum; build, move or modify facilities; establish budget procedures and determine budgetary allocation; determine the methods of raising revenue; contract out work; and take Section 5.2. The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the District, the adoption of policies, rules and regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and expressed terms of this Agreement, and then only to the extent such specific and express terms are in conformance with the law. Section 5.3. The District retains its right to take whatever actions may be necessary to carry out its mission in emergency situations. The determination of whether or not an emergency exists is solely within the discretion of the District. Section 5.4. The exercise of the rights under this Article are not subject to the grievance procedures of this Agreement.
RIGHTS OF THE DISTRICT. Except as expressly provided otherwise by the terms of this Agreement, the determination and administration of educational policy, the operation of the schools, and the direction of the professional staff are vested exclusively in the District or in the superintendent when so delegated by the District.
RIGHTS OF THE DISTRICT. It is expressly agreed that the District reserves all responsibilities, powers, rights, and authority vested in it by the Laws and Constitution of Michigan and the United States except those which are expressly relinquished herein by the District. Such rights reserved to the District shall include by way of partial illustration the right to: 1. Manage and control its business, its equipment, and its operation. 2. Continue its rights, policies, and practices of assignment and direction of its personnel and scheduling. 3. Direct the work force, including the right to hire, promote, discipline, transfer, and determine the size of the work force. 4. Determine the services, supplies, and equipment necessary to continue its operation. 5. Adopt reasonable rules and regulations. 6. Determine the qualifications of employees, including health conditions. 7. Determine overall goals and objectives as well as the policies affecting the educational program. 8. Determine the administrative organization, its function and authority. 9. Determine the location or relocation of its facilities, including the establishment of relocations of new schools, buildings, departments, divisions or subdivisions thereof, and the relocation or closing of offices, departments, divisions or subdivisions, buildings or other facilities. The exercise of the foregoing powers, rights, duties and responsibilities by the District and the adoption of policies, rules, regulations, and practices in the furtherance thereof, shall be the exclusive prerogative of the District except as limited by the specific terms of this Agreement.
RIGHTS OF THE DISTRICT. The Charter School shall not do or permit anything to be done in or about the Facilities that will in any way obstruct or interfere with the rights of the District or injure the District or use or allow the Facilities to be used for any unlawful purpose, nor shall the Charter School cause, maintain or permit any nuisance in or about the Facilities. The Charter School shall not commit or suffer to be committed any waste in or upon the Facilities.

The right to determine its financial structure including all decisions and conditions relating to all sources of District income; all investment policies and practices; and all budgetary matters and procedures, to wit, the budget calendar, the budget formation process, accounting methods, payroll practices, fiscal and budget control policies and procedures, and all budgetary allocations, reserves and expenditures;
RIGHTS OF THE DISTRICT. 4.2.1 The Association understands and agrees that the District retains the right to temporarily modify or rescind provisions of this agreement in the following emergency situations: 4.2.1.1 When faced with local natural disasters. 4.2.1.2 When faced with the loss of reasonable use of a school facility. 4.2.1.3 When faced with severe financial emergency beyond the control of the District wherein the obligations of the District could not be met except through deficit spending. 4.2.1.4 When faced with a condition where personnel must be hired to protect the health, safety, and the rights of students. 4.2.1.5 When faced with state or national emergencies proclaimed by competent government officials. Before implementing an emergency action described above, the District shall consult with the Association.
RIGHTS OF THE DISTRICT. 2.1 Except as abridged by specific provisions of this Agreement, the Union recognizes the employer's inherent and traditional right to manage the District's business as has been its practice in the past. This recognition includes the right of the District to hire, suspend, transfer, promote, demote, or discipline employees and to maintain the discipline and efficiency of its employees, the right to lay off, terminate or otherwise relieve employees from duty because of lack of work for them to do, or for other reasons set forth in this contract, the right to establish and change work schedules and assignments and to eliminate, change or consolidate jobs; the right to direct the methods and processes of doing work, to introduce new and improved work methods or equipment, and to assign work to outside contractors; the right to determine the starting and quitting time and the number of hours to be worked; and the right to make and amend such reasonable rules and regulations as it may deem necessary for the conduct of its business; and to require their observance. 2.2 The exercise of the District's rights stated herein is an exclusive function of management. The exercise of the Management’s rights herein does not modify the employee's right to appeal through the grievance procedure as set forth in this Agreement when such exercise violates the letter and intent of the Agreement. 2.3 The District shall provide to the Union upon request data produced in the regular course of business concerning monthly lunch sales performance.
