ANNUAL VACATION AND STATUTORY HOLIDAYS. 9.1 Each member covered by this Agreement shall be granted, during the term of this Agreement, annual vacations with pay at the current rate of pay, as follows: 9.2 All members with less than one year of service shall receive vacation on the basis of the provisions of Article 9.3 but pro-rated according to his/her actual length of service up to a maximum of eighty (80) hours. 9.3 All members having completed one or more years of service shall receive eighty (80) hours. 9.4 All members having completed three (3) years or more of service shall receive one hundred and twenty (120) hours. 9.5 All members having completed nine (9) or more years of service shall receive one hundred and sixty (160) hours. 9.6 All members having completed fifteen (15) or more years of service shall receive two hundred (200) hours. This article is effective on July 26, 2010. 9.7 All members having completed twenty-two (22) or more years of service shall receive two hundred and forty (240) hours. 9.8 All members having completed twenty-eight (28) or more years of service shall receive two hundred and eighty (280) hours.

ANNUAL VACATION AND STATUTORY HOLIDAYS. (i) Articles 19.01 (i) and 19.02 of the Agreement shall apply. (ii) Annual Vacation shall be based on one (1) week of vacation equating to thirty-five (35) hours: - Fifteen (15) days vacation shall equate to one hundred and five (105) hours. - Eighteen (18) days vacation shall equate to one hundred and twenty-six (126) hours. - Twenty-three (23) days vacation shall equate to one hundred and sixty- one (161) hours. - Twenty-eight (28) days vacation shall equate to one hundred and ninety- six (196) hours. - Thirty (30) days vacation shall equate to two hundred and ten (210) hours. - Thirty-three (33) days vacation shall equate to two hundred and thirty- one (231) hours. (iii) Article 20 shall apply only in respect to the Statutory Holidays listed in Article 20.01. (iv) (a) As remuneration in lieu of the eleven (11) Statutory Holidays listed, whether occurring on a rest day or on a regular work-day, Communication Specialists, Communication Operators, Communication Supervisors or Complaint Takers shall be granted seventy-seven (77) hours statutory leave with pay for each full calendar year (reduced pro-rata service of less than one year and for probationary employees). Such leave may be granted in one block period, subject to the efficient operation of the Department, provided that in each instance that the Communication Specialists, Communication Operators, Communication Supervisors or Complaint Takers is absent from a scheduled work shift that occurs on a Statutory Holiday by reason of illness, injury, funeral leave or any other leave with pay, there shall be a deduction of seven (7) hours from the maximum original seventy-seven (77) hour entitlement.

It is agreed that the annual vacation pay for an employee working under this Agreement shall be paid in the following manner. In addition to an employee’s total earnings, the Employer shall pay six point three six percent (6.36%) of the employee’s total earnings and pay it on each pay cheque. Total earnings are defined as wages earned. (b) It shall be a violation of this Agreement for an employee to forego his paid vacation or work for wages during his holiday period. (c) All holiday pay owing will be paid upon termination. 602 Statutory Holidays (a) Statutory Holidays shall be: New Years Day, Third Monday in February (Heritage Day), Good Friday, Easter Monday, Victoria Day, Dominion Day, Friday preceding B.C. Day, B.C. Day, Discovery Day (L.U. 993 — Yukon Only), Friday preceding Labour Day, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day, Boxing Day and any other Day declared as such by the Provincial or Federal Government. (b) It is agreed that Statutory Holiday pay for an employee working under this Agreement shall be paid in the following manner. In addition to an employee’s total earnings the Employer shall pay six percent (6%) (or when working in the Yukon Territory, six point four percent (6.4%)) of the employee’s total earnings on each pay cheque. (c) If a Statutory Holiday(s) falls on a Saturday or Sunday, the closest following work day(s) will be observed.

ANNUAL VACATION AND STATUTORY HOLIDAYS. 401 Holiday Pay shall be a total of twelve percent (12%) of the Ironworker's gross wages, consisting of six percent (6%) for annual holidays and six percent (6%) for statutory holidays to be accrued and paid to the Ironworkers on the Ironworkers on the last regular pay cheque of the month or upon termination of employment if less than one (1) month. * 402 Statutory Holidays 403 When an Employer decides to shut down all or part of out-of-town work for a Christmas Recess, not to exceed ten (10) days unless by mutual agreement, and the employees are given Christmas leave, the Employer shall pay to non-local residents accommoda- tion checkout for each weekend day or Statutory Holiday that occurs during the Christmas shut down period. To qualify the employee must work the com- plete shift on the last day before the Christmas Recess begins and report for the first scheduled shift after the Christmas Recess unless the employee has reason- able cause for not doing so. 404 An employee may take up to three (3) weeks annual vacation in any calendar year. The vacation period will be arranged by mutual agreement between the member and the Employer. CLAUSE 5 - FOREMEN 501 When two (2) or more Ironworkers are employed, one (1) or more of the said Ironworkers shall be chosen by the Employer to act as Xxxxxxx, and the Ironworker acting as Xxxxxxx shall receive Xxxxxxx'x wages. 502 When only one (1) Ironworker is employed and when the Employer places him in responsible charge of the work being done, he shall receive Xxxxxxx'x wages, provided that nothing in this Clause shall inter- fere with the usual right to employ a single man for Journeyman's work at Journeyman's wages. 503 All Foremen shall be members in good stand- ing of Local 97. In the absence of proficient Local 97 personnel being available to fill this position at time of dispatch, the Employer may appoint a person of his own choosing from the personnel dispatched.
