As a duly elected body exercising governmental power under color of law of the State of Michigan, the Board agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by the Act or other laws of Michigan or the Constitution of Michigan and the United States: that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association, his/her participation in any lawful activities of the Association or collective bargaining with the Board or his/her institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any term or conditions of employment.
B. Nothing contained herein shall be construed to deny or restrict to any teacher rights he/she may have under the Michigan General School Laws or other applicable laws and regulations. The rights granted to teachers hereunder shall be deemed to be in addition to those provided elsewhere.
C. The Association and its representatives shall have the right to use school building facilities at reasonable hours. The Association shall pay for the reasonable cost of all materials and supplies incident to such use. Such use shall not interfere with or interrupt normal school operations. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off school premises.
D. The duly authorized representatives of the Association shall have the right to transact official Association business on school property at reasonable times provided it does not interfere with normal school operations. The initial contact in a building by any Association representative shall be with the school office to announce his/her presence.
E. The Association shall have the right to post notices of activities and matters of Association concern on teacher bulletin boards, at least one of which shall be provided in each school building. ASSOCIATION AND TEACHERS’ RIGHTS. A. The teachers shall have the right to use school building facilities for school purposes at all reasonable hours for meeting provided the administration is notified of the building's proposed use. Availability of the school building facilities to the teachers is subject to prior commitments.
B. The Board agrees to furnish to the teachers or respond to reasonable requests from time to time, all available information concerning the financial resources of the District, tentative budgetary requirements and allocation, and such other information as will assist the teachers in developing intelligent, accurate, informed, and constructive programs with information, except privileged communications, which may be necessary for the teachers to process any grievance or complaint.
C. The Board agrees to make available in school adequate typing, duplicating facilities, and a copying machine for transparencies to aid teachers in the production of instructional material.
D. The provisions of this Agreement shall be applied without regard to race, creed, religion, color, national origin, sex, or marital status.
E. Privileged information such as confidential credentials and related personal references normally sought at the time of employment are specifically exempted from review. The administrator shall in the presence of the teacher's authorized representative remove these credentials and confidential reports from the file prior to a review of the file by the teacher.
F. All communications including but not limited to evaluation, commendation, and complaints directed toward the teacher which are included in the personnel file shall be called to the teacher's attention at the time of inclusion. The teacher may make addendums to any items prior to their inclusion up to three (3) 8 1/2-by-11 pages.
G. A teacher shall be entitled to have present a representative of the local Association when he/she is being formally reprimanded, warned, or disciplined for any infraction of discipline or delinquency in professional performance. The teacher shall be informed of the meeting and its purpose prior to its scheduling. When a request for such representation is made, no action shall be taken with respect to the teacher until such representative of the Association is present. If the severity of the offense warrants, any MEA state representative may be in attendance upon the request of the member.

SECTION 2.1 - GENERAL RIGHTS: Nothing contained herein shall be construed to deny or restrict to any teacher such rights as he/she may have under Montana School Laws or other applicable laws and regulations. The rights granted to teachers hereunder shall be deemed to be in addition to those provided elsewhere. Any violation of state law is a violation of this Agreement.
ASSOCIATION AND TEACHERS’ RIGHTS. 8.1 The Board shall place on the agenda of each regular board meeting under "new business" any matters brought to its attention for its consideration by the Association as long as these matters are made known in writing to the Superintendent at least one (1) week prior to the regular meeting.
8.2 The president of the Association or his designee shall be given written notice of any special meeting of the Board together with a copy of the agenda or statement of purpose of such meeting at least forty-eight (48) hours prior to the scheduled time of such meeting.
8.3 One (1) complete copy of all public Board minutes shall be mailed or placed in the mail box of the president of the Association forty-eight (48) hours after the meeting. One (1) copy of all Association minutes will be mailed or presented to the Superintendent of District 103 forty-eight
ASSOCIATION AND TEACHERS’ RIGHTS. A. Payroll Deductions: The following payroll deductions are available to teachers:
1. Association Dues
a) Anytime after the beginning of the school year, the association shall deliver to the Board names of teachers who authorized payroll deductions, the amounts of membership dues, other assessments the Association, including the National Education Association, and the Indiana State Teachers Association. The Board shall deduct such sum in either 4, 6, or 10 equal payments, beginning with the next pay period after receipt of the names from the Association. Additional names may be added anytime until the end of the school year. In cases where there are fewer than fifteen (15) pay periods left, the amount shall be deducted equally from the remaining pay periods.
b) The deductions shall be remitted not less frequently than monthly to the Association. The authorization for payroll deduction of Association membership dues shall be on a continuing basis unless revoked, in writing, by the teacher through the Association between the dates of August 24 and September 4.

Teachers shall have the right to organize, join and assist the Association to participate in professional negotiations with the Board through representatives of their own choosing, and to engage in other legal activities individually or in concert for the purpose of establishing, maintaining, protecting or improving conditions of professional service in the educational program. The teacher has the right not to be represented by any organization.
B. Nothing contained herein shall be construed to deny any teacher rights he/she may have under the School Code of the State of Illinois or under other applicable laws and regulations.
C. As a duly elected body exercising governmental power under the laws of the State of Illinois, the Board shall not discourage directly or indirectly or deprive any teacher his/her rights in the enjoyment of any rights conferred by the laws of Illinois or the Constitution of the State of Illinois or the Constitution of the United States, and that it will continue not to discriminate against any teacher with respect to hours, wages, terms or conditions of employment by reason of his/her membership in the Association or in negotiations with the Board, or to discriminate against any teacher in his/her institution of any grievance complaint or procedure under this agreement.
D. Rules and regulations governing teacher conduct shall be reasonable, and the enforcement of teacher discipline (which includes suspension) shall be impartial, factual and for reasons which are just. If a teacher is released from an extracurricular position other than that of department head, the release can be contested and processed only through Step 4 of the Professional Grievance Procedure (Article XVI

The Board and the Association agree that they shall not discriminate against any teacher on the basis of the teacher's membership in, or lack of membership or participation in the activities of the Association or any other teacher association, nor to discriminate against a teacher because of the exercise of their rights under the terms of this Agreement. Further the parties hereto agree that they shall not discriminate against any teacher on the basis of race, color, creed, national origin, sex, age or marital status as required by law.
