Bargaining Unit Vacancies. It is the intent of the City to continue the practice of filling job vacancies of bargaining unit classifications by promoting or transferring qualified employees from within. Vacancies (as determined by the City to exist) which will last more than thirty (30) days shall be posted on the bulletin board at each City building for a period of five (5) workdays. The notice of vacancy shall be dated. Any regular or probationary employee who desires consideration must notify the Department Head or Human Resources in writing within fourteen (14) calendar days of the date of posting. Application/bid forms will be provided by the City to be filled out by the employee/bidder. Qualifications for promotion or transfer to a vacant position will be determined based on the classification description of the vacant position. Employees may be requested to participate in interviews and/or testing to assess whether their qualifications meet those required in the classification description. Where the above does not meet the needs of the City or Union, the City and Union shall meet and confer to attempt to resolve the issue.
Bargaining Unit Vacancies. Section 1. When a bargaining unit position becomes vacant because of retirement,
A. A notice of vacancy shall be communicated to the Chief Xxxxxxx and posted on the University’s website for campus distribution for at least eight (8) working days. The notice shall describe thejob duties and the minimum qualifications for the position.
B. Any non-probationary employee may apply for the position on an application update form to be furnished by the University. In the event the University decides to use a Position Search Waiver, it will first notify and discuss the decision with the Union. A bargaining unit member who anticipates that a posting may occur during their vacation may submit an application update which shall be effective until their return. A bargaining unit member who is absent during the period of posting due to vacation, illness, leave of absence, or layoff and has not submitted an advance application update, may make application for the posted position and will be considered if the position has not already been filled and the successful applicant notified.
C. It is understood, however, that no posting or award shall be deferred to accommodate an employee’s absence.
Section 2. Determining job content, minimum qualifications and required job skills,
Section 3. The University shall evaluate all candidates to ensure they meet the minimum criteria stated in the job classification specifications and, in selecting among such candidates, may take into account work record, demonstrated job performance, skills, attitude, knowledge and capacity. The University may utilize assembled or unassembled testing to aid in its determination and such testing, whether written or oral or a combination thereof, may include:
1. demonstration of skill, physical fitness, efficiency, and manual dexterity; or
2. evaluation of capacity, knowledge, training, experience or adaptability.
Section 4. As among those bargaining unit candidates who meet the job criteria determined and published by the University pursuant to Section 2, the University may award the job to a candidate deemed qualified by the University. When the University awards the job to a member of the bargaining unit, the employee shall be transferred to the new job within four (4) weeks following the award, unless operational requirements dictate a longer period. The new pay rate, if applicable, shall commence the day the employee actually commences the new job or four (4) weeks following the award, whichever occ...
Bargaining Unit Vacancies. A. All bargaining unit vacancies will be posted on the AADL website for a minimum of ten (10) working days, prior to the interviewing of applicants. Copies will also be sent to the Association President and the Association’s business office at the time of posting.
B. Employees shall apply within the ten (10) working day period if they wish to be considered for the posted vacancy.
C. Prior to the posting of any newly created position, the Employer shall notify the Association of its intent and the classification proposed. Should the Association disagree with the proposed classification after informal discussions to attempt to resolve the issue, the Association may, within five (5) days of the conclusion of such attempts, refer the issue to Step Two of the Grievance and Arbitration Procedure.
D. All bargaining unit members who apply for a posted position shall receive an interview provided that they meet the minimum qualifications as specified in the job posting.
E. The most qualified candidate will be awarded the position. If the most qualified candidates are internal and external, and both are equally capable and qualified, the internal candidate will be awarded the position. Similarly, if the most qualified candidates are internal, and both equally capable and qualified, the most senior internal candidate will be awarded the position.
F. If the Employer decides not to fill a vacant position it will notify the Association President as soon as the decision has been made.
G. All internal applicants who are not selected shall be so notified, prior to the general public announcement of the name of the person awarded the position.
Bargaining Unit Vacancies. Subd. 1. A vacancy shall exist when a bargaining unit position is open due to reasons such as resignation, termination, or the creation of a new position and there is no certificated or licensed teacher on unrequested leave or returning from leave and there is no staff overage in such area of certification.
Subd. 2. When vacancies occur after August 1 and other than at semester break, it may be difficult to fill them from within the District without undue disruption to the existing instructional program. Such a vacancy will be filled on a temporary basis, on a one-year only contract until the end of the school year at which time the position will be considered vacant subject to Subd. 1 above. The Association shall be so notified.
Subd. 3. Bargaining unit members shall be notified of all bargaining unit vacancies with the exception of extra-curricular positions as described in Article VI (Salary Schedules and Placement), Section 6 (Extra Curricular Assignments), Subd.
Bargaining Unit Vacancies. All vacancies within the bargaining unit will be posted within fourteen (14) calendar days of determining there is a vacancy. The vacancy will remain posted for a period of seven (7) calendar days. Postings will list the reason for filling the vacancy. Whenever possible, the Employer will fill the vacancy within five (5) calendar days of the posting deadline. If the vacancy is not filled by ten (10) work days, the successful candidate will be compensated at the vacancy rate starting the eleventh (11th) work day provided the employer is ready to present the work. If an individual is not ready and present to work because of vacation, sick day, personal day, etc. the days in the preceding paragraph will be extended by a like amount of days.

When a vacancy occurs, the personnel department shall notify all ho..: 1-.1 employees in writing, describing the position, classification, and advising that applications will be accepted. When a position is vacated due to an employee transfer, retirement, resignation or termination, Human Resources shall notify the ESPA President in writing of the status of the position within sixty (60) calendar days of the vacancy occurring.
Bargaining Unit Vacancies. In recognition of merit and career service, the parties agree that it is their mutual intent that vacant or newly established positions in the bargaining unit be filled by Bargaining Unit Members pursuant to the terms provided in this Section. The following shall supplement the University's hiring procedure for filling positions in the bargaining unit.
a. If Bargaining Unit Members meet the minimum qualifications for the position and they apply for the vacancy prior to the closing date at the MAU personnel office, they shall be given priority consideration and an opportunity to interview for the position.

Prior to filling a vacancy in a bargaining unit 20 position, employees in the same classification as the vacancy will be given an opportunity to submit 21 transfer requests for the vacant position. Selection of the successful applicant will include seniority 22 in classification as a factor in consideration. Employees who have successfully transferred shall be 23 prohibited from future transfers for a two (2) year period. 24 If no bargaining unit member submits a transfer request for a vacant position, applications 25 may be solicited from non-bargaining unit members at the discretion of management. Nothing in this 26 section shall modify management’s right to make changes in assignment to address departmental 27 operating need.
