INDIVIDUAL TEACHER'S CONTRACT. (a) Each permanent teacher or clinician employed by the Division shall be required to execute a Teacher’s Contract in the form attached hereto as Schedule "C". (b) Each teacher or clinician employed for a specific period of time exceeding twenty (20) days in a position or on an assignment shall be required to execute a teacher's contract in the form attached hereto as Schedule "D". 5.02 Teachers employed by the Division under individual teacher contracts prior to December 18, 2004, shall be deemed to have signed the appropriate form of individual teacher contract under Article 5.01.

INDIVIDUAL TEACHER'S CONTRACT. A. All individual contracts with instructional personnel employed by the Board and covered by this agreement, shall be in writing and signed by the Business Manager and the President of the Board of Education before presentation to the teacher for signing. First year teacher contracts are subject to Board approval, but must be signed by both parties before the first day of service. If the individual contract is not returned to the Business Manager by the deadline stated in the form as provided in Appendix A, the failure to return the contract shall be deemed as the teacher’s resignation and no further letter of resignation will be required. This language will be reflected in Appendix A. B. Individual teacher's contracts shall be in the form as provided in Appendix A and will reflect the terms and conditions of this agreement. Salary and benefit amounts listed on the individual contract may change due to ongoing negotiations for the coming school year. When negotiations are concluded and a new Negotiated Agreement is in place, any changes from the individual contract will be noticed to the teacher in the form of a contract addendum. This language will be reflected in Appendix A. This assignment may be altered in cases of emergency only. Examples of "emergency" include unexpected shifts in enrollment or teacher resignation. Any alteration of the assignment after July 15, will allow the teacher to resign without penalty. If a teacher is reassigned under this clause, the teacher will be awarded a one-time salary bonus of $500.00 (gross before required payroll deductions) if reassignment occurs after July 1. The one-time bonus will be paid in the teacher’s first check for the new school year, and will not be included in that teacher’s salary for any other purpose under this Agreement or any renewal of this Agreement. 1. The transfer cannot require the person to earn additional hours for certification. 2. The Person transferred will have first priority on vacancies for which he/she is certified. The term “first priority” means the Person will be given prior consideration for the vacant position but does not mean placement will be “automatic.” C. Salary will be paid on the basis of contracted days. “Salary” includes all elements of salary stated on Appendix B excluding extra duty or other assignments. INDIVIDUAL TEACHER'S CONTRACT. This Agreement made and entered into this day of., by and between party of the first part (hereinafter referred to as the teacher) and the Board of Trustees, School District 52 of Madison County, Xxxxx, Montana, parties of the second part(hereinafter referred to as the Board).
INDIVIDUAL TEACHER'S CONTRACT. A. The Board of Directors shall make a written contract with each teacher employed by the Board. Such contract shall include the following provisions: 1. The position that the contract is intended to cover. 2. The number of days of service the teacher is to perform for the term of the contract and the effective date of the contract. 3. The salary to be paid for the contract calculated from the salary schedule and an indication of the experience and educational step placement from such salary schedule. 4. A statement as provided for by law that incorporates the policies of the District which have been adopted by the Board of Directors and which are binding on both parties. 5. The Board retains the power to deny any employment recommendation made by the superintendent, but it will only employ personnel upon the recommendation of the superintendent. B. No contract is effective until approval by a majority of the Board of Directors. C. All other applicable statutory provisions and State Board of Education regulations and directives from the Superintendent of Public Instruction shall be adhered to in contract procedure. D. A contract between the school District and a teacher shall be regarded as equally binding on both parties. E. A contract returned unsigned or not returned within ten (10) working days of receipt by the teacher shall be regarded as a resignation and as breaking the continuing contract relationship between the District and the teacher, provided that the principal has followed-up by directly speaking to the teacher within the ten day period. F. When it is clearly shown that a teacher is unable to perform his or her duties because of illness or other cause not within his or her control, resignation may be accepted at any time. G. Two (2) copies of a contract shall be given to the teacher each year. The teacher will sign both copies of the contract and return them to the District office within ten (10) working days of receipt of the contracts. The two (2) copies will be signed by the Superintendent One (1) of these copies is then placed on file at the District office. The other copy is returned to the teacher. H. Individual teacher contracts shall have typed on them the following statement: "Provided, however, that the terms of this contract shall be consistent with and subject to the terms and the execution of the Professional Agreement between the Naselle-Grays River Valley Board of Education and the Naselle-Grays River Education Association." (d) Each clinician, except a clinician employed for a limited term, is required to execute a clinician's contract in the form attached hereto as Schedule "E" or "F" whichever is applicable. (e) Each clinician employed for a specific period of time exceeding twenty (20) days in a position or on an assignment shall be required to execute a clinician's contract in the form attached hereto as Schedule "G" or "H", whichever is applicable. (f) Notwithstanding any other form of agreement or contract all clinicians engaged shall be deemed to be a party to a clinician's contract per said Schedule "E", "F", "G" or "H" as applicable. 5.02 Teachers employed by the Division under individual teacher contracts prior to January 1, 1997 shall be deemed to have signed the appropriate form of individual teacher contract under Article 5.01.

INDIVIDUAL TEACHER'S CONTRACT. Individual contracts, Attachment “C”, shall be consistent with the applicable statutes, rules and regulations and the terms of this Agreement and shall be signed in duplicate by the teacher and Board Secretary with one copy retained by the teacher and the other kept on file in the superintendent’s office. The salaries shall be paid in twelve (12) equal installments with the pay date to fall on the 8th day of each month. Should the 8th fall on a weekend, holiday, or non-work day for teachers, the pay date shall be the last teacher’s work day prior to the weekend, holiday, or non-work day for teachers. The pay date will be no earlier than the 5th day of the month. Computation of the teacher’s daily wage shall be determined by dividing the teacher’s scheduled salary by 186. The daily rate of teachers who are on extended contracts will be determined by the daily rate of 1/186th of the scheduled salary, it being understood that that portion of such teacher’s contract which constitutes an “extended contract” will not be included in determining the daily rate. In case of an extended absence or absences, the district shall continue to pay the individual monthly teacher daily pay rate for thirty (30) contract days after the teacher has exhausted his/her sick leave days, or fewer if the teacher is approved for long-term disability. Salary adjustments will be made accordingly after thirty days and communicated to the employee. Additional adjustments may be necessary after the Executive Council of the Waverly Education Association presents the Superintendent’s Office a list of teachers who will receive days from the Sick Leave Bank. The individual teacher retains the responsibility to reimburse the District for any compensation received in excess of the appropriate amount.

Failure to do so will be considered a material breach of this Contract and grounds for immediate Contract termination. The cooperative entities are responsible for obtaining all certificates of insurance and bonds required. The Contractor is responsible for providing each cooperative entity a copy of the Contract upon request by the cooperative entity. The County of Orange makes no guarantee of usage by other users of this Contract. The Contractor shall be required to maintain a list of the cooperative entities using this Contract.
