JOB POSTING, TRANSFERS, AND PROMOTIONS. Section 10.1. Management is not required to fill a vacancy, but, if such vacancy is filled, it shall be in accordance with Section 10.2. The reclassification of a current position which results from an internal job audit by the Agency or by an external job audit of a change in duties or functions of the position, which results in the position being assigned to a new classification or an increase in the number of jobs in an existing classification, creates a vacancy. Section 10.2. When a vacancy is to be filled, the Employer shall post a notice of said vacancy on bulletin boards in all facilities for a period of six (6) working days (excluding holidays), which includes the day of posting. Once the position has been posted, it shall be filled within a reasonable period of time following the end of the posting period, unless the Employer decides not to fill the position. The position announcement shall state the following: 1. classification, grade, and pay range; 2. the position description; 3. the required qualifications for the position established by the Agency for the classification; 4. person to contact if interested; and 5. deadline for submitting application. No classification change, except for temporary assignments as provided for herein, will occur for any employee unless the new classification has followed the posting procedure. Section 10.3. The Employer will not consider applications filed after the sixth (6th) full working day (excluding holidays) of the posting, including the day of the posting. The employee should consult with his/her supervisor to schedule a mutually agreeable time to make such application. No employee who is serving a probationary period may bid for a position. Section 10.4. Any vacant or newly created position, upon being filled, will be filled in the following manner. A. The position will be awarded to the laid off employee applicant or the employee applicant with the greatest Agency seniority who is qualified and capable of filling the position. The laid off employee applicant(s) and employee applicant(s) (collectively referred to as “applicant”) shall be reviewed considering the following criteria: 1. the applicant’s qualifications and experience; 2. the applicant’s job performance; 3. the applicant’s active disciplinary record as provided in Section 11.4; 4. the applicant’s attendance and tardiness record for the last twelve (12) months. JOB POSTING, TRANSFERS, AND PROMOTIONS. 37.01 When a vacancy occurs and the Employer decides to fill the new vacancy or a new position is created in any classification, the Employer shall post notice of the vacancy for at least seven (7) days before filling the position. Applicants can be from inside or outside the Bargaining Unit. Such positions shall be filled by the applicant who best meets all of the requirements of the job as described in the notice of vacancy in accordance with Article 37.02(a) 37.02(g). (a) In making selections to fill posted vacancies or a new position first consideration shall be given to Employees in the Bargaining Unit. (b) If two or more internal applicants equally meet the requirements of the job as described in Article 37.02, preference will be given to the most senior applicant from within the Bargaining Unit. (c) Outside applicants will only be hired if no internal applicant meets the necessary qualifications and no external applicant will be considered until all internal applicants are processed. (d) For the purpose of Article 37.01 the filling of vacancies must be reached in good faith and consistent with Article 7: No Discrimination. 37.02 The notice shall contain the following information: (a) the nature of the position; (b) qualifications; (c) required knowledge and education; (d) experience; (e) skills; (f) hours of work (the total hours of work for the position in a two (2) week period and the daily hours of work for the position); and, (g) Wages shall be subject to the current Collective Agreement for the position posted. 37.03 The Employer will accept applications from Employees who signify their interest in any vacancy. All applications for vacant positions shall be made in writing to the Employer. 37.04 Where an individual from within the Bargaining Unit is promoted to a position in a higher classification, the Employee shall serve a trial period of three (3) months. During this trial period, the Employee may return to their former position and rate of pay providing: (a) The Employee chooses to return. (b) The Employer is not satisfied with the work of the Employee. Should the Employer not be satisfied, they shall provide the Employee, in writing, with the reasons for their dissatisfaction. (c) The Employer will meet with the Employee and complete a written evaluation for all Employees by the midway point of their trial period. JOB POSTING, TRANSFERS, AND PROMOTIONS. Job Posting and Transfer In the event the District elects to fill a vacancy in any of the classifications represented by the Union, the District will post the job opportunity including the work location, appropriate pay band, and the number of hours for a minimum of ten (10) working days on bulletin boards in every organizational unit where bargaining unit members are employed. In addition, the District shall also send the posting to bargaining unit members through the District email system. The District will establish a pool of eligible candidates comprised of employees who file preferential forms or respond to job postings and applications from individuals who are not District employees. All individuals hired into classifications represented by the Union will be obtained through this Candidate “Pool” Process. Seniority based on length of service as a legally and permanently appointed employee and meritorious service shall be the basis for transfers, promotions, or filling of vacancies within the service. Such vacancies shall be filled as soon as practicable after such vacancies occur. In the filling of such vacancies, references will be made to the preferential lists of employees on file in the appropriate office at the date when vacancies occur.

  • Proposed Policies and Procedures Regarding New Online Content and Functionality By November 1, 2017, the College will submit to OCR for its review and approval proposed policies and procedures (“the Plan for New Content”) to ensure that all new, newly-added, or modified online content and functionality will be accessible to people with disabilities as measured by conformance to the Benchmarks for Measuring Accessibility set forth above, except where doing so would impose a fundamental alteration or undue burden. a) When fundamental alteration or undue burden defenses apply, the Plan for New Content will require the College to provide equally effective alternative access. The Plan for New Content will require the College, in providing equally effective alternate access, to take any actions that do not result in a fundamental alteration or undue financial and administrative burdens, but nevertheless ensure that, to the maximum extent possible, individuals with disabilities receive the same benefits or services as their nondisabled peers. To provide equally effective alternate access, alternates are not required to produce the identical result or level of achievement for persons with and without disabilities, but must afford persons with disabilities equal opportunity to obtain the same result, to gain the same benefit, or to reach the same level of achievement, in the most integrated setting appropriate to the person’s needs. b) The Plan for New Content must include sufficient quality assurance procedures, backed by adequate personnel and financial resources, for full implementation. This provision also applies to the College’s online content and functionality developed by, maintained by, or offered through a third-party vendor or by using open sources. c) Within thirty (30) days of receiving OCR’s approval of the Plan for New Content, the College will officially adopt, and fully implement the amended policies and procedures.
