Meal Breaks and Rest Breaks. Employees are entitled to a paid 20 minute morning rest break. An unpaid 30 minute meal break may be taken usually after the completion of between six and seven hours work. The taking of the rest breaks must be in accordance with the Company’s operational requirements.

Meal Breaks and Rest Breaks. (a) An employee, other than a continuous shiftworker, is entitled to an unpaid meal break of not less than 30 minutes. (b) A continuous shiftworker will be entitled to a paid meal break of 20 minutes per shift. (c) All employees will be allowed a rest break of 10 minutes, between the time of commencing work and the usual meal break. This rest break will be counted as part of time worked. (d) The timing of meal breaks and rest breaks on any particular job may be discussed between the Employer and the majority of employees at a particular site and varied by agreement. Occupational health and safety considerations will always prevail. (e) An employee shall not be compelled to work for more than six hours without a break for a meal. Where possible the normal meal break should be as near as practicable to the middle of the period of duty or shift in lieu thereof.

Where the working situation permits, the Municipality shall schedule a break of at least fifteen (15) minutes duration during the first and second halves of each shift. B. All employees, unless specified elsewhere in this Agreement, will be permitted to have a scheduled unpaid meal period of at least thirty (30) minutes in duration. The Municipality will attempt to schedule the meal period at approximately the middle of each shift. C. Where, because of the nature of the work, employees must remain in duty status and eat while working, the time shall be considered as time worked, and the Municipality may implement a schedule which contains no provisions for an unpaid meal period. D. Where employees work two (2) or more hours outside of and contiguous with the regularly scheduled shift, the employees will be afforded a reasonable period of time to eat a meal on paid time at the factored overtime rate of pay and every four (4) hours thereafter. E. Where employees are required to return to work outside their regularly scheduled shift, they will be afforded a reasonable period of time to eat a meal on paid time at the factored overtime rate of pay every four (4) hours worked.
Meal Breaks and Rest Breaks. Employees shall be allowed an unpaid break of thirty (30) minutes for a meal during their ordinary working hours. A rest break of ten minutes each morning and afternoon plus walk time shall be granted to all employees. Such a rest break is to be counted as time worked and taken at a time fixed by the employer, provided that the rest break will not be granted within one hour of normal commencement or cessation of work or within one hour either side of a meal break. The same amount of meal and rest breaks will also apply to shift work. No employee shall be required to work longer than five hours without a meal break.

(3) From Monday to Saturday inclusive the lunch period may be taken between the hours of 11a.m. and 3p.m. (4) A trainee who is required to attend for ordinary hours during late night trading shall be entitled to an evening meal break of between forty five minutes and one hour between 4.30p.m. and 7.00p.m. Provided that the employer and any trainee may agree that the meal break shall not be less than a half hour. (5) A trainee attending on-the-job for more than eight hours in ordinary time shall be allowed two paid tea breaks of ten minutes to be taken in the morning and afternoon. Otherwise a trainee shall be allowed a ten minute break each day either in the first or second half of the period of attendance Monday to Saturday inclusive. Such break shall be taken to suit the employer's business provided that no trainee shall be required to attend for more than four and one half hours without having had such break. Provided further that such break shall not take place within a period of one hour after the trainee commencing in the morning or within a period of one hour after the completion of the trainee's lunch period or during the time of late night trading. (a) Where a trainee is required to continue into overtime beyond his/her normal finishing time for more than two hours he/she shall be allowed a break for a meal of not less that thirty minutes. Such break shall be allowed to the trainee before the expiration of the period of work beyond his/her normal finishing time referred to herein and not earlier than 5.00pm. Meal Breaks and Rest Breaks. A. Telecommunicators are encouraged to take their paid rest breaks and paid meal breaks when staffing and workload permits. The figure below outlines the authorized number of paid rest breaks and paid meal breaks corresponding to scheduled hours worked. Taking a rest break or meal break during the first or last 60 minutes of the workday. C. It is understood that telecommunicators may leave their workstation during their meal break or rest break but will remain on the premises and available for recall. Telecommunicators may leave the premises only with authorization and are subject to submission of a leave request if employee is absent longer than the allotted time, at the discretion of the dispatch supervisor except where it is noted in this article. D. Telecommunicators forced to work back to back shifts, without advanced knowledge, due to a last-minute vacancy, increased call volume or an emergent incident can be granted permission to leave the premises. Departure from the premises can be for a period not to exceed 30 minutes with authorization. Employees remain subject to recall and are not required to submit a leave request under these unique conditions.

By agreement, an employee may extend this period to six (6) hours. b) Meal breaks shall be unpaid and for thirty (30) minutes duration. c) Employees shall be entitled to a paid rest pause of ten (10) minutes duration if rostered to work more than four (4) hours and it is taken within the first four (4) hours at a time assigned by the Company. d) A further ten (10) minute paid rest pause shall be provided if an employee is rostered to work seven and a half (7.5) hours or more, provided that this second paid rest pause is taken after the first four (4) hours of work are completed and at a time assigned by the Company.
Meal Breaks and Rest Breaks. 4.4.1. An Employee will be entitled to an unpaid 30-minute meal break in duration taken no longer than six hours after the commencement of work on that day. The Company may stagger the time of a meal break to meet operational requirements. 4.4.2. Where an Employee is required to work during the Employee’s usual meal break and such meal break is postponed for more than half of one hour, the Employee will be paid at overtime rates until such time as the meal break is taken. (a) Despite 4.4.2 above, overtime rates will not be paid where an Employee is instructed to do so for the purpose of making good any breakdown of plant, routine maintenance of plant which can only be done while the plant is in idle or where work is being performed and it would be unsafe or impracticable for a break to be taken at the time of the designated break. (b) The time of taking a scheduled meal break or rest break by one or more Employees may be altered by an employer if it is necessary to do so in order to meet a requirement for continuity of operations. 4.4.3. A rest period of 15 minutes will be allowed each shift. This rest period will be counted as time worked and will be arranged at a time and a manner to suit the convenience and operational requirements of the Company. 4.4.4. Employees working on an afternoon or night shift will be entitled to a paid meal break of 20minutes instead of an unpaid meal break of up to 30 minutes. 4.4.5. Notwithstanding any other provision of this Agreement relating to meal breaks, rest periods and payments, the following arrangements will apply where Employees are rostered to work on a shutdown or project involving a planned work pattern of 12 hours of day work continuous with 12 hours of night shift work. (a) The working day or shift will include a 25-minute paid meal break which will be taken as near as practicable to the middle of the working day or shift. Two rest paid periods of 15 minutes will also be taken which will be scheduled during the day or shift to suit the requirements of the work. (b) Where this work pattern is applied, the 12 hours will be treated as paid hours, comprising of ordinary time and overtime for day work and ordinary time with shift loading and overtime for the night shift. (c) The provisions of clause 4.4.5.2 will not be used as a precedent for or support for a claim in relation to any other work or work pattern that may be worked under this Agreement.
