NON-OCCUPATIONAL SICK LEAVE. Non-occupational sick leave shall be granted in accordance with the provision hereof, without loss of pay, benefits or seniority, to each member for sickness or injury sustained by a member otherwise than in the performance of duty. An employee absent for four (4) consecutive days or more may be required to submit a doctor’s certificate to the Chief attesting to the reasons for the absence. Abuse of sick leave benefits may be grounds for discipline. Sick leave may be used only for bona fide illness or injury, with the exception that up to ten (10) sick days may be used per calendar year for the illness or injury of the employee’s immediate family member (family sick days). Family sick days shall not limit or negatively impact the employee’s opportunity to work details and overtime. On January 1st of each year, the Town will grant three (3) personal days to each unit member. New employees hired after January 1st of any year shall receive prorated personal days with the employee receiving three (3) days if hired between January and April, two (2) days if hired between May and August, and one (1) day if hired between September and December. Personal days are non-cumulative and must be used by December 31st. The Town will not buy back personal days upon termination of employment or retirement.
19:01 Each employee shall be granted one and one-quarter (1 ¼) days of sick leave for each month of continuous service.
19:02 All unused non-occupational sick leave in each year shall be allowed to accumulate without limit.
19:03 Upon the death, retirement, or resignation after fifteen (15) years of service of an employee, the employee, or in the event of death, his/her estate, shall receive within thirty (30) days thereof a lump sum for payment of forty (40%) percent of all unused, accumulated non-occupational sick leave up to 100 days and sixty (60%) for all accumulated days over 100 days. Such payment shall be computed by multiplying the proper percentage by the number of accumulated days as aforesaid by a per diem rate, which per diem rate shall for purposes of this article only be deemed to be one-fifth of the employee’s average weekly compensation at the time of his death, retirement or resignation, as the case may be. For all employees hired after July 1, 2004, the Town will buy back a maximum of 75 days sick leave at 100%. All current employees grandfathered in current buyback limits. Current employees may participate in this incentive as well.

NON-OCCUPATIONAL SICK LEAVE. All employees permanently employed, shall be entitled to fifteen (15) days of sick leave at full pay during each calendar year. Unused sick leave may be accumulated without limit. The Newark Public Schools may require proof of such illness by way of medical certificate or any other means the Newark Public Schools wishes to use. The rules and regulations of the New Jersey Department of Personnel shall also apply to such leaves, where such rules and regulations are applicable.
NON-OCCUPATIONAL SICK LEAVE. Section 1. The granting of non-occupational sick leave to those Supervisors covered by the terms of this agreement shall be subject to the following provisions:
a. The Chief of Police or the Chief’s designee must investigate and approve a request for non-occupational sick leave by a Supervisor. A periodic physician’s certificate or detailed report may be required if such sick leave exceeds three (3) consecutive shifts; failure to comply will result in immediate loss of benefits.
b. Supervisors covered under this agreement may be granted sick leave with pay according to the following schedule:
1. Supervisors covered by the terms of this contract may be granted one and one quarter (1 1/4) work day of non-occupational sick leave for each successive full calendar month of continuous employment up to a maximum accumulation of sixteen hundred (1,600) work hours.
c. A sick day with pay shall consist of the number of hours of a regularly scheduled work day paid at the Supervisors’ regular hourly rate of pay, as defined in Section 4 of Article 16 of this Agreement.
d. Periods of disability with sick leave pay shall be deducted from Supervisors’ accumulated sick leave.
e. A Supervisor may file with the Chief for the use of sick leave to personally attend to an immediate family member of the Supervisor’s family who is seriously sick/ill; immediate family member means spouse, child, legal xxxx, parent, sibling, grandparent, grandchild, life partner or spousal parents. The Chief’s decision on such application shall he final and shall not be subject to the grievance and arbitration procedure of Article XI, except if the Chief’s decision is arbitrary, capricious or discriminatory.
f. Sick leave will be administered on an hourly basis.
Section 2. Where there has been a pattern of absence, the Town may require a medical certificate from a Supervisor for all sicknesses. This provision shall apply only when the Supervisor has been previously warned in writing that there is a pattern of absence. If there is no further pattern of absence for a period of twelve (12) months from the date of the issuance of the warning notice, the provisions of paragraph one of this Section shall again apply.
Section 3. A person on sick leave shall not engage in any other work for pay during such leave.
NON-OCCUPATIONAL SICK LEAVE. A. The payment of compensation to employees who are absent from work because of non-occupational illness or injury or exposure to contagious disease or severe emotional shock shall be subject to the following provisions:
1. A permanent full-time Employee shall accrue paid sick leave entitlement at the rate of 1 1/4 days per month, accumulating without limit, less paid sick leave taken.
2. Notification of absences shall be given as early as possible on the first day of absence. If such notification is not made, such absence may, at the discretion of the Chief or appointing authority, be applied to absence without pay. The Chief shall investigate and ascertain the validity of any request for non-occupational sick leave made by an employee and shall approve the same if he is satisfied as to the validity of such request. He may also approve a request for sick leave due to family illness in the immediate household up to a maximum of seven (7) shifts per year, if satisfied as to the validity of such request. Up to three (3) shifts per year of family sick leave may be taken as single shifts, day or night, while working the 24-hour shifts. A physician's certificate may be required by the Chief for absences of four
NON-OCCUPATIONAL SICK LEAVE. All employees shall be entitled to fifteen (15) days of sick time at full pay during each calendar year. Unused sick time may be accumulated without limit. The Newark Board of Education requires proof of such illness by way of medical certification or any other reasonable means The Newark Board of Education wishes to use after five (5) consecutive days of absence. The rules and regulations of the Civil Service Commission shall also apply to such absences, where such rules and regulations are applicable, including management’s right to request documentation for any absences when a pattern of excessive or repetitive absences develops. In the event all sick time is exhausted, vacation time may be substituted, upon the employee’s request and subject to the approval of his/her immediate supervisor.
NON-OCCUPATIONAL SICK LEAVE. All employees who work twenty (20) or more hours per week shall be credited with one and one quarter (1 1/4) days of sick leave upon the completion of each month of service (or the major fraction of a month) until the July 1 following the date of employment. The number of days credited as of July 1 of each year shall be available for future use. No maximum is applicable to this sick leave accumulation. For each day of sick leave accumulated at the start of a single continuous, prolonged illness an employee who has exhausted his sick leave credit may receive two (2) additional days of sick leave, if necessary, up to a maximum of sixty-six (66) days on the recommendation of the Director of Facilities and Transportation, with a written statement from the employee’s doctor of the nature of the illness and the probable duration thereof, with the approval of the Superintendent. Extended leave may be used only for the illness or injury to the employee himself (herself) and only while in the employ of the District. In order to be eligible to be granted sick leave, the employee must notify the Director of Facilities and Transportation of his/her incapacity on the first day of absence, stating the nature of the sickness or injury, time expected to be incapacitated and when he/she expects to return to work. The Director of Facilities and Transportation may request from the employee his or her doctor’s statement concerning the incapacitation, after three (3) consecutive days, or if a pattern of absence emerges, if in the Director’s judgment the situation demands such certification. This discretion shall not be unreasonably exercised. Earned sick leave days shall be earned and paid at the rate of hours worked per day.
NON-OCCUPATIONAL SICK LEAVE. Section 1. Eligibility Members of the bargaining unit shall be eligible for non-occupational sick leave as provided hereunder.
Section 2. Accrual Members of the bargaining unit shall accrue one and one-quarter (1 1/4) days non-occupational sick leave for each full calendar month of continuous employment per fiscal year. The aforementioned accruals shall be added to the employee's permanent record of available non-occupational sick leave and shall be referred to as the "non-occupational sick leave credit" or the "non-occupational sick leave bank."
NON-OCCUPATIONAL SICK LEAVE. Section 1. The granting of non-occupational sick leave to those employees covered by the terms of this agreement shall be subject to the following provisions:

NON-OCCUPATIONAL SICK LEAVE. The payment of compensation to employees who are absent from work because of non-occupational illness or injury or exposure to contagious disease or severe emotional shock shall be subject to the following provisions:
A. Employees, who have been in the employ of the Employer for more than ninety (90) days, shall accrue sick leave at the rate of twenty-five percent (25%) of the weekly authorized hours for each month of service to a maximum of 1480 hours.
B. A new employee shall not be entitled to paid non-occupational sick leave until the employee has been employed for ninety (90) calendar days. At that time, the employee will be credited with sick leave retroactive to the first day of employment and shall become entitled to receive paid non-occupational sick leave.
C. The employee shall give to the Department Head notification of absence prior to the start of the workday. If such notification is not made, the Department Head shall credit the absence as unauthorized and without pay. Further, failure to notify a department head or superintendent of an unscheduled absence may be subject to disciplinary action. Department Heads shall investigate and ascertain the validity of any request for sick leave. If it is determined that the request is valid, the Department Head shall approve the sick leave request. A physician’s certificate shall be required by the Department Head for absences for five (5) consecutive working days or after any sick leave use if the supervisor has reason to suspect abuse of sick leave and a meeting has been held with the Department Head and the employee to discuss the reasons of excess absenteeism.
D. If an employee is injured while working for another employer, he/she shall not be entitled to use of sick leave.
