Out of Class. (A) An employee temporarily transferred from a job at a lower rate of pay to a job classification at a higher rate of pay for a period in excess of one (1) hour shall be paid at the higher rate in accordance with normal promotional policy for all work performed in the higher classification, provided that the employee is qualified to perform the higher classified work and that such assignment is not for training purposes. It is agreed that employees shall not be assigned in a trainee status solely for the purpose of avoiding the provisions of this Section.
(B) All assignments in training shall be authorized in writing upon the employee's request.
Out of Class. UPGRADE APPEAL
1. If an employee feels that he or she is improperly classified he or she should obtain a Position Information Questionnaire from his or her immediate supervisor or the Management Services Department, fill it out, and present it to the supervisor with a brief memo requesting a position audit. The supervisor will review the request.
2. The supervisor will discuss the request with the department manager within ten (10) working days.
3. If the department manager determines that the employee is working within the proper classification he or she will notify the employee within ten (10) working days.
4. If the department manager feels that a classification change is necessary for a more efficient operation, he or she will prepare a Position Audit Request form and submit this form with the employees’ memo and Position Information Questionnaire to the Management Services Department. The Management Services Department shall notify the BCEA upon initial receipt and subsequent findings of all audit request originally initiated by the employee.
5. The Management Services Department will audit the position and make a recommendation to the City Manager within thirty (30) working days of receipt of a completed Position Information Questionnaire.
6. If the City Manager determines that an employee has been working out-of- classification, the employee will be compensated at the higher rate from the period of time the Position Information Questionnaire and the brief memo requesting a position audit was submitted to the immediate supervisor (with a copy to the department manager) to the time when the employee is either returned to duties that no longer constitute WOC or is promoted.
7. An employee may appeal the decision of his or her department manager or the Management Services Department by filing a written grievance with his or her department manager within fifteen (15) working days of the decision.
Out of Class. WORK Out of class work is work having substantially similar duties and responsibilities as those of another permanent position (classification) with a higher maximum salary (the out of class work). While assigned, the employee shall receive at least a step increase or if the employee is at the maximum of the pay range shall receive a 3.5% increase in pay during the period so authorized, provided the following occurs:
A. All out of class work shall be assigned in writing, either prior to the initiation of the work, or the Department shall provide the employee a written record of the assignment within seventy-two (72) hours of the initiation of the work on a form prescribed by the City; and The authorization must empower the employee to perform the full range of duties of the out of class work, even though the employee may not perform the full range of duties; out of class work shall also include when an employee is assigned to operate specific equipment outlined in the higher classification; and
B. The employee performs the out of class work for a minimum of six (6) consecutive hours or more to be eligible. The employee shall then receive compensation for all hours worked in the higher class.
C. Notwithstanding the above, an employee shall not receive out of class pay for out of class work performed, in the following circumstances.
1. The Employee is participating in out of class work, because the Department is engaging the employee in bona fide training to learn how to complete the out of class tasks. For the purposes of this subparagraph, Abona fide training@ shall not include the assignment of out of class work to an employee that has previously performed the out of class work for a cumulative eighty (80) hours during their employment with the City; or
2. The employee is in a class that has a progression from a lower classification to a higher classification that automatically occurs on a predetermined time schedule, and the out of class work assigned is work that is within the classification that is the higher classification within the automatic progression. The Human Resources Director may approve out-of-class work, in the event no vacancy exists in a higher classification, when it is determined through supportive documentation that an employee is performing the work of the higher classification. Out of Class. In the event that management requires an employee (including a Battalion Chief) to assume a supervisory position of higher responsibility than the employee’s normal assignment (which is also not covered by the step-up provisions of this Article), that employee shall be entitled to five (5%) percent step-up pay for all hours worked in that capacity. In the event that management requires an employee (including a Battalion Chief) to assume a role in a position of lower responsibility than the employee’s normal assignment, that employee shall not suffer a loss in pay.
Out of Class. A. Notwithstanding Government Code Sections 905.2, 19818.8, 19818.6, and 19823, an employee may be required to perform work other than that described in the specification for his/her classification for up to 120 consecutive calendar days during any 12 month period. An employee may be assigned to work out of class for more than 120 consecutive days only with the approval of the Department of Personnel Administration (DPA). Out-of-class work is defined as, more than 50 percent of the time, performing the full range of duties and responsibilities allocated to an existing class and not allocated to the class in which the person has a current, legal appointment. Out of Class. An employee assigned to the duties of a higher classification shall receive the pay of the higher classification (same step) for the full period of time worked in the higher classification. If employees are to be assigned to a higher classification among clerical or custodial personnel at the site-level, employees will be offered the assignment in order of District wide class seniority, provided that their regular assignment is at the location where the out of class duties are to be performed. Offers of out of class clerical assignments will be limited to bargaining unit employees serving within each department or office. For the purpose of out of class pay, maintenance work shall be assumed to be performed at the maintenance yard regardless of actual work.
Out of Class. In the absence of the regularly promoted officer, a member (as designated by the Fire Chief in accordance with Section 22.2 of this article) will be offered the opportunity to assume the duties of the vacant position. Any employee who accepts the responsibilities of a position above the rank which they normally hold is assigned as “Out of Class” and shall be paid hour-for-hour at the rate for the higher position. If a firefighter or lieutenant works out of class on his/her assigned shift, he/she will be paid the straight time rate for the position for which he/she is filling. If a firefighter or lieutenant works out of class on a shift other than his/her assigned shift, he/she will be paid one and one-half (1 1/2) times the straight time rate for the position for which he/she is filling. A bargaining unit member shall not be eligible for out of class pay set forth in this Section that is more than one step above his/her current rank (in other words, a firefighter is only eligible for lieutenant pay and is not eligible for captain pay.
Out of Class. 20 Employees assigned by their Department Head or his/her designee to work out- 21 of-class as a Lieutenant for a full shift shall be paid ten percent (10%) above 22 their base rate of pay, but not to exceed the maximum rate of pay assigned to 23 the higher classification. Employees assigned by their Department Head or 24 his/her designee to work out-of-class as a Sergeant for at least forty (40) 25 consecutive hours, and for any consecutive hours in excess of forty (40), 26 including holidays, shall be paid five percent (5%) above their base rate of pay 27 for each full shift of such assignment.
Out of Class. 27 Employees assigned by their Department Head or his/her designee to work 28 out-of-class in a higher paid bargaining unit classification for at least forty 1 (40) consecutive hours within a pay period, and for any consecutive hours 2 in excess of forty (40), including holidays, shall be paid for such time at five 3 percent (5%) above their straight time rate of pay or base of the higher 4 classification whichever is higher, but not to exceed the maximum rate of 5 pay assigned to the higher classification. In the event the qualifying Out of 6 Class assignment continues into the next pay period, all consecutive hours 7 worked on the Out of Class assignment shall be paid in accordance with this 8 provision. Once a break occurs, the forty (40) hour requirement must again 9 be met. 12 * Working Out-Of-Class – Performing all the functions of a higher 13 classification.
Out of Class. Pay Any Firefighter riding as a Lieutenant shall be compensated at the rate of the Step 1 Lieutenant for all hours worked out of class.
