Student Attendance, Conduct and Discipline. The School agrees that it shall comply with all State and Federal law concerning student attendance, standards of conduct and discipline. The School’s procedures shall provide that appeal in student discipline cases shall be to the Governing Board of the School, rather than to the Institute Board. i. Attendance of students at the School shall be in compliance with Colorado’s compulsory attendance laws, including, without limitation, hour requirements and the distinction made between excused and unexcused absences. ii. The School shall adopt a code of conduct for students. The school will develop codes, policies, and procedures regarding student conduct and student discipline that are in compliance with applicable federal and state laws, including, without limitation, the grounds and procedures established by statute for suspending, expelling or denying admission to a student.

Student Attendance, Conduct and Discipline. The School agrees that it shall establish its own school year calendar and develop its own discipline and dress code policies. The School’s procedures shall provide that appeal in student discipline cases shall be to the Board of Directors of the School (“the Charter Board”) or its designee rather than to the District Board; provided, however, that the School may forward a recommendation to the District for expulsion of a student from all District schools when the School expels a student from its School. 2.1.1. Attendance of students at the School shall be in compliance with Colorado’s compulsory attendance laws, including, without limitation, hour requirements and the distinction made between excused and non-excused absences. 2.1.2. The School may adopt its own code of conduct for students and shall be granted a waiver from corresponding District policies as long as the developed codes, policies and procedures regarding student conduct and student discipline are in compliance with applicable federal and state laws, including, without limitation, the grounds and procedures established by Colorado laws for suspending, expelling or denying admission to a student.
Student Attendance, Conduct and Discipline. A. Except to the extent expressly waived, the Charter School shall comply with all applicable laws, rules and regulations concerning student attendance and standards of conduct and discipline. The Charter School also shall comply with all District approved policies and regulations concerning student attendance and standards of conduct and discipline. The Charter School shall promptly develop specific rules of conduct similar to the building level conduct rules developed by individual schools in the District which shall be applied in the Charter School. The Charter School may request additional waivers from specific Board policies and regulations regarding conduct, and discipline in accordance with Article 5 below, provided that the Charter School shall agree to implement specific replacement policies and regulations or otherwise provide evidence satisfactory to the District that reasonably acceptable policies and procedures for the conduct and discipline of the Charter School Students will be maintained. The Charter School shall ensure that its students comply with Colorado’s compulsory attendance laws, including, without limitation, hour requirements and the distinction made between excused and unexcused absences. B. Subject to applicable law and waiver of any inconsistent state laws, regulations or rules, the Charter School’s administrator shall have the authority to suspend Charter School Students for not more than ten (10) school days to the same extent as the Board has delegated such authority to building principals in Board Policy JKD/JKE. Upon the written recommendation of the administrator of the Charter School, the District may expel or suspend a Charter School Student for more than ten (10) days in accordance with District policy and applicable state and federal law. Such recommendation by the Charter School administrator shall include the proposed grounds for expulsion or suspension more than ten (10) days, a recitation of the facts upon which the proposed disciplinary action is based, and all pertinent educational and disciplinary documentation and records. Students expelled from the Charter School shall be excluded from District property and activities to the same extent as students expelled from other schools of the District. Student Attendance, Conduct and Discipline. (i) The Forest Grove Community School shall implement a system of uniform student conduct. The Forest Grove Community School shall notify its students of the students’ rights and responsibilities at the beginning of each school year, or as a student meets the admission requirements as stated in this Contract. The Forest Grove Community School shall maintain accurate enrollment data and daily records of student attendance and shall provide this data to the District on a monthly basis by no later than the 5th of each month. (iii) The Forest Grove Community School shall notify the District immediately upon a student being expelled from the Forest Grove Community School.

PBCCS shall notify its students of the student’s rights and responsibilities at the beginning of each school year, or as a student meets the admission requirements as stated in this Contract. PBCCS shall maintain accurate enrollment data and records of average daily membership and shall provide this data to the District on a monthly basis by no later than the 5th day of the month for the preceding month. (ii) PBCCS shall notify the District immediately upon a student being expelled from PBCCS. The continued education of non-resident student(s) expelled from PBCCS shall be PBCCS’ responsibility. (iii) PBCCS student conduct and discipline will comply with ORS 339.240-339.280, and will comply with the District’s Code of Conduct.

Community Roots shall comply with all State laws and District policies and rules concerning student attendance, standards of conduct and discipline. Community Roots shall notify its students of the student rights and responsibilities in the same manner that the District notifies its students. Community Roots shall maintain accurate enrollment data and daily records of student attendance and shall provide this data to the District as requested. Community Roots shall maintain enrollment and attendance data on the District's student information system. The District shall provide Community Roots with required software and training to allow Community Roots personnel to input such enrollment data, or will make other arrangements that are mutually agreeable. (i) Student attendance at Community Roots shall be in compliance with Oregon's compulsory attendance laws. (ii) Discipline involving suspension and expulsion shall be achieved according to Oregon law. (iii) The Community Roots teachers may recommend to the Community Roots School Board that a student be expelled. Expulsion of a student shall not extend beyond one calendar year. No student may be expelled without a hearing unless the student's parents, or the student if 18 years of age, waive the right to a hearing, either in writing or by failure to appear at a scheduled hearing. By waiving the right to a hearing, the student and parent agree to abide by the findings of a hearings officer. Upon determining that initiation of expulsion proceedings is warranted, the Community Roots board chair or designee shall serve as the hearings officer. The hearings officer's decision is final. However, this decision may be appealed to the Community Roots School Board. At its next regular or special meeting the Community Roots School Board will review the hearings officer's decision and will affirm, modify or reverse the decision. Parents of students who wish to appeal the hearings officer's decision will have the opportunity to be heard at the time the Community Roots School Board reviews the decision. Prior to expulsion, Community Roots will work with the Silver Falls School District to propose alternative programs of instruction or instruction combined with counseling to a student expelled for reasons other than a weapons policy violation. Student Attendance, Conduct and Discipline. The Charter School shall maintain accurate enrollment data and daily records of student attendance and shall provide these data to the District on a monthly basis by no later than the 10th of each month, for the preceding month. The Charter School shall implement a system of uniform student discipline consistent with the application, specifically Section 14 and Exhibit C, and shall notify its students of the students’ rights and responsibilities as provided in the application. The Charter School board may amend its policies from time to time as provided in Section 11.4. The Charter School shall notify the District immediately upon a student being expelled from the Charter School. The Charter School and the District shall extend full faith and credit to the suspension and expulsion of a student of the other, unless both parties agree in writing to a variance from this requirement.
Student Attendance, Conduct and Discipline. Unless Horizons adopts its own set of written policies that are approved by the School District, Horizons shall comply with and enforce all Board-approved policies and regulations concerning student attendance, standards of conduct, and discipline. 2.1.1 Horizons may adopt its own written attendance policy and shall be granted a waiver from the School District’s policy, so long as the policy is in compliance with Colorado’s compulsory attendance laws, including, without limitation, hour requirements and the distinction made between excused and unexcused absences. 2.1.2 Horizons may adopt its own set of written policies concerning student conduct and student discipline and shall be granted a waiver from corresponding School District policies as long as the developed policies are in compliance with applicable federal and state laws, including, without limitation, the grounds and procedures established by state statute for suspending, expelling, or denying admission to a student. Unless services are purchased from the School District, any general education services required by law to be provided to suspended or expelled students shall be the sole responsibility of Horizons. Any special education and related services required by law to be provided to suspended or expelled students shall be the responsibility of the School District as Horizons will purchase such services from the School District as set forth in this Contract.
