TRADE OR WORK JURISDICTION. This Agreement covers the rate of pay, rules and working conditions on all construction work covered by Registration Certificate #28 in the refrigeration and air conditioning industry for all refrigeration mechanic foremen, refrigeration mechanic journeymen, refrigeration mechanic apprentices, welder foremen, welders, and welder apprentices for all work coming within the trade jurisdiction of Local 488 respecting refrigeration and air conditioning and any other work awarded to the United Association through jurisdictional ruling(s) as laid down by the Building Trades Department of the A.F.L./C.I.O.
TRADE OR WORK JURISDICTION. 9.1 The parties to this Agreement recognize that it is the employer's sole responsibility to assign work. The contractor shall not assign work contrary to existing area practices predicated on jurisdictional wording outlined in other trade Collective Agreements. The reference herein, to area practices and/or jurisdictional awards must be area practices and/or awards that have been accepted and practiced on projects between Unions. Though not mandatory, the Contractor will cooperate in defining trade jurisdiction assignments by means of a letter as requested by the Business Manager on projects upon request; in accordance with a standard form to be provided by the Business Manager. The Employer shall not unduly refuse to cooperate with such request. The noted standard form is to be provided to the Business Manager by the OPTC.
9.2 Jurisdictional disputes that may arise after the enforcement of this agreement shall be referred to either the Impartial Jurisdictional Dispute Board (I.J.D.B.) or a Successor Group, or the Ontario Labour Relations Board (O.L.R.B.) for a final binding decision.
9.3 Subject to the conditions in Clause 9.1 and 9.2 above, and subject to jurisdictional Agreements between the trades, decisions of record, and local area practice, this Agreement covers the unloading, distribution and hoisting of all equipment and piping for plumbing and/or process piping systems that may contain or convey a product under a positive or negative pressure. It further covers the fabrication, installation and handling of all plumbing pipe fitting and industrial process control systems including all hangers and supports. Without limiting the generality of the foregoing, this agreement covers the installation of new piping systems, tanks and related equipment, the maintenance and repair of all piping systems and related equipment, and the removal and/or relocation of all piping systems and related equipment for the purpose of renovation, retrofit, reconstruction, replacement or relocation. Piping systems and related equipment includes, but is not limited to that contained in the following types of work: Water Treatment Plants, Water Pumping Stations, Waste Disposal Plants, Sewage Treatment Plants, Energy from Waste Projects, Solar Heating Systems, Co-Generation Plants and Non-Utility Generating Stations. TRADE OR WORK JURISDICTION. A. This Agreement covers the rates of pay, rules and working conditions of all journeymen and apprentices engaged in the installation of all plumbing and/or pipefitting systems and component parts thereof. Members of Local 11 will operate all equipment related to the Plumbing and Pipefitting Industry, which they are qualified and assigned by their Employer.
B. All jurisdictional disputes between or among any building and construction trades units affiliated with a National or International Union that is a member of the Building and Construction Trades Department (AFL-CIO), and any Employers that are parties to or have adopted or have worked under this Agreement – shall be settled or adjusted according to the present plan established by the Building and Construction Trades Department (Plan for National Joint Board for Settlement of Jurisdictional Disputes in the Building and Construction Industry) or any other plan or method of procedure that may be adopted in the future by the Building and Construction Trades Department.
C. Decisions rendered shall be final, binding and conclusive on Employers that are parties to or have adopted this Agreement and on all unions affiliated with a National or International Union that is a member of the Building Construction Trades Department, whether or not parties to this Agreement.
D. This article shall apply to any and all jurisdictional disputes, between or among Unions affiliated with the Building and Construction Trades Department, on all work covered by this Agreement and related work performed by the Employer, whether or not the Unions involved in the jurisdictional dispute have any members employed by the Employer and whether or not the Unions involved are in agreement with the Employer.
E. To avoid costly jurisdictional disputes a pre-job conference shall be arranged when requested by this local Union or by the Employer at a time and place convenient for both parties, it shall be the responsibility of the Business Manager of this local to assure responsible Union representatives from all potentially interested Unions to be in attendance and it shall be the Employers responsibility to assure attendance of all its potentially involved subcontractors.
TRADE OR WORK JURISDICTION. This Agreement covers the rate of pay, rules and working conditions on all work EXCLUDING CONSTRUCTION and all maintenance work performed under the GPMA or NMA Agreements in the refrigeration, air-conditioning and building maintenance industry for all refrigeration mechanic foremen, refrigeration mechanic journeymen, refrigeration mechanic apprentices and building maintenance mechanics on a regular and/or on an emergency call basis as required and any other work awarded to the United Association through jurisdictional ruling(s) as laid down by the Building Trades Department of the A.F.L./C.I.O, C.L.C.
TRADE OR WORK JURISDICTION. The Parties recognize the following as the:
1. All piping for plumbing, water, waste, floor drains, drain grates, supply leader, soil pipe, grease traps, sewage, and vent lines.
2. All piping for water filters, water softeners, water meters and the setting of same.
3. All cold, hot, and circulating water lines, piping for house pumps, cellar drainers, ejectors, house tanks, pressure tanks, swimming pools, ornamental pools, display fountains, drinking fountains, aquariums, plumbing fixtures and appliances, and the handling and setting of the above mentioned equipment.
4. All water services from mains to buildings, including water meters and water meter foundations.
5. All water mains from whatever source, including branches and fire hydrants, etc.
6. All down spouts and drainage areas, soil pipe, catch basins, manholes, drains, gravel basins, storm water sewers, septic tanks, cesspools, water storage tanks, etc.
7. All liquid soap piping, liquid soap tanks, soap valves, and equipment in bath and washrooms, shower stalls, etc.
8. All bathroom, toilet room and shower room accessories, i.e., as towel racks, paper holders, glass shelves, hooks, mirrors, cabinets, etc.
9. All lawn sprinkler work, including piping, fittings, and lawn sprinkler heads.
10. All sheet lead lining for X-ray rooms, fountains, swimming pools or shower stalls, tanks, or vats for all purposes and for roof flashings in connection with the pipefitting industry.
11. All fire standpipes, fire pumps, pressure and storage tanks, valves, hose racks, fire hose, cabinets and accessories, and all piping for sprinkler work of every description.
12. All block tin coils, carbonic gas piping, for soda fountains and bars, etc.
13. All piping for railing work, and racks of every description, whether screwed or welded.
14. All piping for pneumatic vacuum cleaning systems of every description.
15. All piping for hydraulic, vacuum, pneumatic, air, water, steam, oil, or gas, used in connection with railway cars, railway motorcars, and railway locomotives.
16. All marine piping, and all piping used in connection with ship building and shipyards.
17. All power plant piping of every description.
18. The handling, assembling, and erecting of all economizers, super- heaters, regardless of the mode or method of making joints, hangers, and erection of same.
19. All internal and external piping on boilers, heaters, tanks, and evaporators, water legs, water backs and water grates, boiler compound equipment, etc.

TRADE OR WORK JURISDICTION. Section 3.1 The hours of labor and working conditions set forth hereunder will apply on all work contracted for by the Contractors signatory to this Agreement coming within the recognized jurisdiction of the Union.
Section 3.2 In recognition of the above work jurisdictional claims, it is understood that the assignment of work and the settlement of jurisdictional disputes with other Build- ing Trades organizations shall be adjusted in accordance with the procedure estab- lished by the Impartial Jurisdictional Disputes Board or any successor agency of the Building Trades Department. In order to avoid jurisdictional controversies with other crafts, the Contractors will endeavor wherever practical to procure and em- brace in his contracts all phases of the piping industry as set forth in the statement of jurisdiction in the International Constitution of the United Association of Jour- neymen and Apprentices of the Plumbing and Pipe Fitting Industry of the United States and Canada.
Section 3.3 There shall be no work stoppage because of jurisdictional disputes.
Section 3.4 The Contractor agrees to have a pre-job conference with the Union in advance of the start of any job, in order to minimize any jurisdictional dispute before the job starts, if requested by either party.
Section 3.5 When any temporary heat is provided by means of any gas appliance over which the Plumber has jurisdiction, it shall be assigned to the Plumber.
(a) All temporary heating and cooling, including gas and oil fired unit heaters, refriger- ation, and air conditioning, is recognized as the work of the plumbing, heating, and air conditioning contractor, with maintenance by United Association member rather than some other craft.
(b) It is optional with the owner or Contractor to provide temporary heat, and to decide the number of hours it shall be in operation, so long as all phases of maintenance are recognized as work of the United Association, a member of which shall be in attendance during optional periods until the general tests are completed and the mechanical installation is accepted by the owner. The classification of buildings that require temporary heat shall be left to the adjudication of the Joint Conference Board.
