TRANSFERS, VACANCIES AND PROMOTIONS. A. Any request by an employee covered hereunder for a transfer to a different class, building or position shall be made in writing through the Principal to the Superintendent on or before April 1st of each calendar year. Transfer requests shall set forth the reasons for requesting such a transfer.
B. Any vacancy shall be posted on an appropriate bulletin board in each school, and shall be sent to the President of the Association. Teachers who are interested in being notified of postings over the summer shall make a written request to the Central Office by the last teacher day of the school year. Staff that have signed up for notification of postings and are qualified for the position, shall be notified by phone by the Superintendent or his/her designee. Vacancies shall not be filled, except on a temporary basis, until the vacancy has been posted. Posting shall include:
1. Position(s) available
2. Requirements for job
3. Deadline for application
4. Effective starting date
5. Any additional pertinent information
6. Date of posting
C. Employees requesting transfers and promotions as provided for in this Article, shall be interviewed by the Superintendent or designee. If the transfer or promotion is not approved, the Superintendent will hold a conference with the teacher to notify him/her of the reasons why the transfer was not approved.
D. Transfers may also be made upon the initiation of the Administration. When such a transfer is initiated by the Administration, the Superintendent and receiving building principal will hold a conference with the teacher to notify him/her of the reason(s) for the transfer and to develop a plan of action for the new assignment. Insofar as possible, assignments will correlate with the individual's total qualifications.
E. Promotional positions are defined as follows: positions paying more and/or positions on the supervisor-administrative level. The Administration shall give consideration to qualified candidates from within its own staff or employees in addition to other qualified candidates when filling these vacancies.
F. Tentative building, grade and/or subject matter assignments for the succeeding year shall be given to the professional staff members no later than the professional work day at the end of the school year. TRANSFERS, VACANCIES AND PROMOTIONS. Although the Committee and the Association recognize that some transfer of teachers from one school to another is unavoidable, they also recognize that frequent transfer of teachers is disruptive of the educational process and interferes with optimum teacher performance. Changes in grade assignment in the elementary schools and in the secondary schools will be voluntary. Exceptions to the provisions in this Article may be made only if the Superintendent (or his/her designee) determines that it is necessary to do so in the best interest of the educational process but in no instance shall this provision be applied to circumvent the rights and obligations contained in Article XI, Reduction in Force.

TRANSFERS, VACANCIES AND PROMOTIONS. 16.01 Where possible and practical teachers’ requests for transfer shall be accommodated provided that such requests, in order to be considered for the following school year, must be made to the Board by a date to be determined each school year by the Superintendent of Human Resources, in consultation with the Unit.
16.01 (a) Teachers who have applied for a transfer for five or more consecutive school years without success may apply in writing to the Superintendent of Human Resources, prior to the transfer request form deadline, for assistance from the Board and the OECTA York Unit in obtaining a transfer.
16.01 (b) The list of teachers requesting transfer shall be provided to OECTA York Unit.
TRANSFERS, VACANCIES AND PROMOTIONS. 17.01 Where possible and practical teachers’ requests for transfer shall be accommodated provided that such requests, in order to be considered for the following school year, must be made to the Board by a date to be determined each school year by the Superintendent of Human Resources, in consultation with the Unit. A teacher after obtaining a transfer is not eligible to apply under this section unless the effective date of the transfer requested is two years after the date of the most recent transfer granted. This restriction shall not apply to teachers transferring from a centrally allocated program.
(a) The list of teachers requesting transfer shall be provided to the principal for posting in each school.
17.01 (b) Teachers requesting transfer to a particular school shall be granted an interview by the Principal of that school, if a position for which they are qualified is available.
17.02 Where the Board requires that a teacher be transferred, whether for reasons of surplus or otherwise, the teacher shall be informed in writing of the Board’s intention to transfer the teacher.
(a) The transfer shall be discussed with the teacher by a representative of the Board prior to the transfer. A representative of the Unit may attend at the teacher's request.
(b) Any teacher who has applied for transfer shall be able to arrange an exchange between schools subject to the exchange being agreeable to the teachers and principals involved. Teachers who arrange an exchange are not prevented from applying for a transfer in the subsequent year.
(c) Transfers shall occur in a number of phases. Vacancies shall be posted and updated at each round or phase. The last day for transfers shall be determined by the Board in consultation with the Unit.
(d) Where the transfer of a teacher is not necessitated by the need to fill another position within the Board, the Board shall endeavour, where conditions permit, to arrange a transfer that is mutually acceptable. VACANCIES AND PROMOTIONS:
17.03 Where possible and practical teachers employed by the Board shall be given priority in the filling of new or vacant positions.
17.03 a) Teachers shall be advised of vacant positions of responsibility prior to public advertisement by a posting in each school.
17.03 b) Before extending an offer of employment to an external candidate, any teacher employed by the Board who fulfills the criteria for the promotion to a bargaining unit position of responsibility shall be interviewed.

B. All vacancies in teaching, supplemental, or administrative positions shall be posted through email for not less than five (5) work days, when possible, prior to the position being filled. During summer months, a list of vacancies shall be sent through email to all certificated/licensed staff. The application deadline will be noted on the emailing. A vacancy exists when one of the following has occurred:
1. A resignation of a teacher or administrative contract has been accepted by the Board of Education.
2. A teacher’s or administrator’s employment (as per his/her teacher or administrative
3. The Board of Education has acted to create a new teaching or administrative position.
C. Employees requesting transfers as provided for in this Article shall, upon the submission of a written request to the Superintendent, be afforded the opportunity for an interview with the Superintendent or his/her designee.
D. Transfers may also be made upon the initiation of the Administration for reasons that will serve the best interests of the District. When such a transfer is initiated by the Administration, the Superintendent or his/her designee will hold a conference with the teacher to notify him/her of the reason(s) for the transfer. Such transfers or reassignments after notification of assignment will be made as infrequently as possible. Insofar as possible, assignments shall correlate with the individual’s total qualifications. Seniority may also be considered. Changes in assignments may be discussed with the Superintendent.
E. The Board shall fill vacancies in the following manner:
1. The District’s determination as to which applicant will fill a vacancy will be based on the relative qualifications and abilities of the applicants.
2. Current employees will receive a preference, but only when the qualifications and abilities of the applicants are equal.
3. Seniority shall only be a factor when judging between two employees of equal qualifications and abilities.
TRANSFERS, VACANCIES AND PROMOTIONS. A. Teacher Assignments:
1. Teachers shall be notified in writing of any changes in their programs for the ensuing school year or ensuing semester, including the schools to which they will be assigned, the grades and/or subject that they will have, as soon as practicable, and under normal circumstances not later than June 1 for changes between years and December 1 for changes between semesters. Of course, such circumstances as sickness or resignations may necessitate changes to meet the situation.
2. In order to assure that pupils are taught by teachers working within their areas of competence, teachers shall not be assigned, except in accordance with the reg- ulations of the State Board of Education and for good cause, to subject and/or grades or other classes outside the scope of their teaching certification and/or their major or minor fields of study.
3. Teachers desiring a change of assignment should make this fact known simul- taneously to the Superintendent of Schools and the Principal of the school in which the teacher is currently serving. Said request for change of assignment should be made in writing and should state reasons for wishing to make the change. Such letters may be submitted at any time; however, when change is desired for the beginning of a school year, the letter should be submitted at the beginning of January. The Superintendent of Schools should reply to this request within thirty (30) days. The term "change in assignments" shall include change from grade level to grade level as well as building-to-building.
4. Teachers being transferred by the District, and not on the basis of a request by the subject teacher, shall be given within thirty (30) days of such transfer, a notice. The teacher shall be made aware in writing of the relevant circumstances involved in the change in assignment.
TRANSFERS, VACANCIES AND PROMOTIONS. A transfer is a lateral change within each classification where there is an opening and there is no increase in wage rate. Transportation bidding is not included in the above definition of a transfer but shall be provided for in Article 29, Transportation Bid Days.
TRANSFERS, VACANCIES AND PROMOTIONS. 1. For the term of this agreement, the Employer will forego any transfers of Employees to another city or location away from the Employee’s home, except if the most urgent of needs should arise. In such a case, the Employer will provide the Employee reimbursement and assistance for moving expenses. This is not intended to preclude an Employee from being assigned to travel to a certain city or location for a special project or assignment of a determined duration that is not a permanent move to said location.
2. No Employee shall incur any penalty for refusing to accept a promotion or management position outside of the bargaining unit’s jurisdiction.
3. The Employer's promotional standards shall not exceed those required in the hiring notice. Positions shall be posted internally for five (5) business days before the position is announced externally. Present Employees shall be given first notice to apply for a vacancy in a higher classification or to make a lateral transfer; subject, however, to the prior operation of the recall list (Article VIII). Notice of each vacancy shall be posted electronically for Employees and given to the Guild. An Employee desiring to fill a vacancy shall submit written application within five (5) business days of such posting. Any Employee who applies for a vacancy shall be given consideration for the position.
4. The Employer, with the Guild’s and Employee’s prior knowledge and consent, may give an Employee a trial period of one month in a new position, unless there are internal candidates available to fill the Employee’s previous position. If the position has not been filled by an internal candidate at the end of the trial period, and the Employer or the Employee desires the Employee’s return to the Employee’s former position, such return shall take place with no penalty or prejudice, at the rate of pay at which the Employee would have received had the Employee never left the former position. This section is not to be construed as an additional probationary period.
5. The Employer shall provide upon request an explanation to an Employee and the Guild of why such Employee is denied promotion or transfer. Current Employees shall be judged by the same parameters as an outside applicant. If an Employee is deemed more valuable by the Employer in their current position rather than the promotion or transfer then the Employee will receive the same rate of pay as the promotion or transfer position.
