HOURS OF WORK AND PREMIUM RATES. 11:1 The employer shall establish hours of work based upon the need for employees. The normal work week for full-time employees will be forty (40) hours, except as overtime is required to carry out the mission of the employer. All hours worked in excess of forty (40) hours per week or eight (8) hours per day shall be at one and one-half (1 1/2) times the employee’s hourly rate. Time worked on Saturday morning or on a holiday to complete a scheduled third shift shall be paid at the employee’s straight time rate of pay including shift differential. 11:2 Work Week: The normal work week shall be Monday through Friday; however, the parties recognize that on occasion other schedules may be necessary and may be implemented provided: (a) Any alternative to the Monday through Friday schedule shall be timely discussed with the Union before it is implemented. (b) All time worked on any Saturday shall be paid at the rate of time and one-half and any work on Sunday shall be paid at the rate of double time. (c) The premium pay will be considered the same as overtime and equitably distributed in accordance with the overtime distribution pro- vision of this Agreement. (d) The alternate work schedules shall not be utilized to diminish Saturday and Sunday overtime for employees assigned to the Monday through Friday schedule who normally service community groups on such Saturday’s and Sunday=s. (e) The development of a variable schedule shall not increase the workload of employees on the regular Monday through Friday schedule. 11:3 Work Day: Eight (8) continuous hours of work, including a one-half (D hour paid duty free lunch, within a twenty-four (24) hour period shall constitute a normal work day. 11:4 Any employee called back by the employer to work outside of his/her regularly scheduled shift shall be paid a minimum of two (2) hours at one and one-half (1½) times the employee’s regular hourly rate for all hours worked except on Sunday or holidays, when such call back time shall be paid at double time, in addition to holiday pay. Call back time shall not be paid for work contiguous to the regularly scheduled shift. HOURS OF WORK AND PREMIUM RATES. 10:1 It is understood the employer will establish hours of work for employees based upon the need for the services of the employees. With that understanding, the Board agrees not to reduce the hours of those regular full-time employees currently employed as of the first of the month following the ratification of this Agreement by both parties; this does not preclude the Board from reducing the number of paraprofessionals as long as the sole purpose is not to reduce hours of employment by offering re-employment on a reduced basis. It is also agreed that any employee who is laid off and recalled or any employee hired after the first of the month following ratification of this Agreement by both parties will not be subject to this article. 10:2 The employer reserves the right to reasonably modify starting and quitting times of employees. The employer will normally notify the employee(s) involved at least seventy-two hours in advance of such change; however, in the event of an emergency the employee(s) will report as requested without regard to the aforementioned seventy-two hours notice.

Substitute coverage will begin on the second (2nd) day of absence provided timely notice is given by the absent employee. When Maintenance Mechanics are needed to assist Custodians in a Building due to extended Custodial absences and/or in emergency situations for duties not usually performed by Maintenance Mechanics, the Maintenance Mechanics shall be called in to assist on a rotating basis with least senior workers called first. The Employer will notify the employee(s) involved at least ten (10) days in advance of such change; however, in the event of an emergency the Employee(s) will report as requested without regard to the aforementioned notice. 16.1.1 The District shall make a good faith effort to provide coverage for Custodians who use more than two (2) consecutive days of sick 16.1.2 Staffing of night shift will be comprised of no less than two (2) Custodians. 16.1.3 When an Employee’s duties require him/her to be in an unoccupied building, the Supervisor of Building and Grounds or Designee, will be notified. Annually, a check in procedure will be established and/or reviewed, by an Association representative, an Elementary Custodial representative, an Elementary Building Chief, and the Supervisor of Buildings and Grounds in order to ensure the safety of all employees. 16.1.4 During planned school year days in which students are not present, a work schedule rotation shall be created among all afternoon/evening shift Custodians in each building that would allow for one Custodian’s shift to end at five (5) pm and all other custodians to work an earlier shift. This rotation shall be established first through volunteers. If no such volunteer exists, the last shift shall be assigned by reverse seniority order for each qualifying day. For example, the first day the least senior must take the last shift, the next day the second to least senior must take the shift. In the case that all other employees leave the building prior to five (5) pm. 16.1.4 shall apply.
HOURS OF WORK AND PREMIUM RATES. 16.1.1 Employees shall be entitled to a duty-free work break with pay of fifteen (15) minutes duration during each half of the work day or in lieu of the fifteen (15) 16.1.2 Normal working hours for the upcoming school year will be established by August 1 and will fall within the range of seven (7) am to five (5) pm. 16.1.3 During non-Teacher work weeks, Employees may, with the approval of their appropriate Supervisor, work flexible hours to meet their individual needs within the thirty-seven and one-half (37.5) hour work week. Compensatory time, in accordance with Article XVI, shall also be available for use during this time. Beginning and ending dates for flexible work schedules during the summer months shall be tentatively scheduled by February 15 annually between MEA representatives and the Superintendent or designee. Beginning and ending dates for flexible work schedules during the summer months will be set by May 1 annually between MEA representatives and the Superintendent or designee. 16.1.4 The District shall make a good faith effort to provide coverage for two classifications (Secretaries and Clerks) who use more than five (5) consecutive days of sick leave. Substitute coverage will begin on the sixth (6th) day of absence.

All hours worked in excess of forty hours per week or eight hours in any calendar day, with the exception of a modification of the summer work schedule determined by the Superintendent or designee, shall be at one and one-half times the employee's hourly rate. If a modification of the work schedule occurs during the summer months, employees will be paid one and one-half times their normal rate for time worked over forty hours in a work week or 10 hours in any calendar day. Time worked on Saturday morning or on a holiday to complete a scheduled third shift shall be paid at the employee's straight time rate of pay including shift differential.
