Jury Duty/Court Leave. 1. All absences for jury duty/court leave must be requested in writing through the District’s electronic system. 2. The employee must endorse his or her check for jury duty service over to the Treasurer of the Board and simply receive the normal salary amount to which the employee otherwise would be entitled under his or her contract(s). 3. Employees shall be released from duty, without loss of pay or benefits, for absence due to the employee’s compliance with a subpoena to appear in a court of law, provided that the subpoena is work related and neither the employee nor the Union is a party in the litigation adverse to the Board of Education or adverse to any individual Board member or administrator.

Jury Duty/Court Leave. 1. Any teacher who is required to be absent from duty to perform jury service during his/her scheduled work period will suffer no loss of pay for such duty, contingent upon appropriate verification to the Treasurer that such service was rendered by the teacher. A teacher receiving notice to appear for jury duty shall notify the Superintendent as far in advance of the absence as possible, utilizing the personal leave form. 2. If a teacher is subpoenaed by the Board to serve as a witness in a court action, or if a teacher is subpoenaed as a witness in an action arising from his/her employment, he/she shall be given a leave of absence with pay for the time required for such appearance(s). This leave will not be granted to a teacher filing suit against the Board, or against one or more of its employees. A member of the bargaining unit receiving a subpoena shall notify the Superintendent as far in advance as possible utilizing the personal leave form.
Jury Duty/Court Leave. 14.8.1 Leave of absence without loss of pay shall be granted, other than an employee already on leave without pay, on sabbatical leave, or under suspension: 14.8.1.1 for jury duty or any summons related thereto; 14.8.1.2 to answer a subpoena or summons to attend as a witness in any proceeding authorized by law to compel the attendance of witnesses. 14.8.1.3 Any compensation received from Jury / Court Leave will be reimbursed to the School Division.
Jury Duty/Court Leave. Employees shall be allowed time off from scheduled work without loss of pay as is required in connection with jury duty or under subpoena in a proceeding to which the employee is not a party and in which the employee was a witness while on or off of official Agency business. The Employer shall pay such employee the difference between his/her normal earnings and the payment he/she receives for jury service or court witness excluding payment for travelling, meals or other expenses. The payment of such pay differential by the Employer shall be contingent upon the employee providing the Employer with proof satisfactory to the Employer that the employee has attended the specified legal proceeding and having presented a Court receipt of payment to the Employer.

A teacher required to appear as a witness at a trial or hearing before a court of competent jurisdiction shall be granted leave with pay if called as a witness to testify to facts arising out of such teacher’s scope of employment. A teacher required to appear as a defendant or appearing as a witness at the request of the Board at a trial or hearing before a court of competent jurisdiction shall be granted leave with pay if named as a defendant by reason of acts or omissions arising from such teacher’s scope of employment. Additional days as needed may be granted for consultation with legal counsel. Scope of employment is defined as those acts that arise during the performance of teaching duties. Scope of employment is not to be construed to include cases arising out of contract disputes between a teacher and the Board or the Association and the Board. The leave granted under this provision shall not be deducted from such teacher’s sick leave or personal leave. Leave with pay under this article will not be granted if a teacher is to appear in court in a personal legal matter. B. When it becomes necessary for a teacher to accept jury duty, the teacher shall be paid his jury pay and his regular salary for the number of days involved. Said employee will submit to the Treasurer any monies paid for jury duty service. Such leave shall not be deducted from any other type of leave. When granted such leave, the teacher shall be replaced by a qualified substitute according to Board adopted policy.

Jury Duty/Court Leave. 1. Any employee who is absent due to a court appearance to testify on behalf of the school or who is subpoenaed to testify because of an incident which arose out of the employee’s being a witness to events at school, shall be granted paid professional leave upon the employee submitting to the Administration a copy of the subpoena as verification for the leave. 2. On those working days that an employee is required to serve as a juror, such employee will be excused from his/her regular work shift which commences on that date. When so required to serve as a juror, such employee will receive his normal rate of pay. In the event an employee who is scheduled to work the 2nd or 3rd shift is excused from jury duty and wishes to work his/her shift on that day, he/she must call the Board office prior to 1:00 and advise the Board that he/she will be reporting for work at the start of his/her shift. In the event such employee works his/her second or third shift, the employee may retain any compensation paid to the employee by the court for that day.
Jury Duty/Court Leave. 9.9.1 Members called to jury duty shall be paid her/his regular per diem and shall retain any compensation paid by the court for jury service. 9.9.2 Days missed by members subpoenaed to court to testify in a proceeding where the member is not a party to the action shall be treated in the same manner as jury duty. As an example, divorce or domestic disputes where the member is a party are not included.

Permanent and probationary employees who are called to serve on jury duty for any county, state or federal court shall be entitled to paid leave under the following circumstances: A. The employee must present to his or her supervisor the court order to appear for jury duty at least three weeks prior to the date to report. B. The employee must submit a daily court authorized stamped time card accounting for all hours of required service ordered by the court. C. If jury service and travel time from court to work is less than five hours (7 hours for person on a 4/10 plan) in a work day, the employee is expected to return to work unless a justification for not returning to work is provided and approved, or pre-authorized leave is approved.\ D. Employees who are required to serve on jury duty on their scheduled days off will not be compensated for this time and may keep any fees paid by the court. E. If the employee is not required to report for jury duty on any particular day(s) he or she is then expected to be at work as per the normal schedule. F. It is the employee’ s responsibility to inform his or her supervisor on a daily basis if he or she is required to report for jury duty the following day. This may include calling the supervisor after or before normal working hours. X. Xxxxxxx due to jury duty will be submitted on the City leave form. X. Xx employee whose work week is other than Monday through Friday (8:00 a.m. to 5:00 p.m.) may have jury duty work day adjustments made by his or her supervisor. II. Court leave is paid leave granted by the City to enable an employee to fulfill his or her duty as a citizen to serve as a witness in a court action to which the employee is not a party, before a federal, superior, or municipal court located within San Diego County. Court leave shall be limited to: A. Required attendance before federal, superior, municipal, and justice courts located within San Diego County. B. Time in attendance at court together with reasonable travel time between court and work if attendance is for less than a full day and the employee can reasonably be expected to return to work. C. Court leave shall not be granted when the employee is paid an expert witness fee. D. The employee must submit to the City any payment received except travel and subsistence pay for such duty. E. Court leave will only be granted to employees who are not litigants in a civil case nor related to litigants in a civil case or defendants in a criminal case. F....
