SAFETY, SANITATION AND SHELTER. 9.01 Every Employer shall provide a proper and adequate place of shelter sufficiently heated and securely locked in which the employees may eat their lunch and store their clothing. It is further agreed that the lunch room facilities shall be separated by a partition from the area in which the clothing is stored. Water, towels and soap shall be available at all times. It is clearly understood that the place of shelter shall not be used for any other purpose, such as storage of tools, etc. Sanitary toilets shall be provided in accordance with the regulations of the Occupational Health and Safety Act, as amended, and if located near the lunch room shall be separated by a partition. The Employers agree to provide the above facilities before production work commences on the project. It is agreed that these facilities shall be on or in the vicinity of the working area. Without in any way limiting the generality of the above, in the case of welders, employed by the Employer, the special clothing and protective equipment which the Employer is required to supply shall include the following: Suitable gloves for welding, leather sleeved or welding jackets, safety helmets and welding masks, cutting goggles and all equipment required for normal welding duties. 9.02 In cooperation with the Employer’s overall program of Accident Control and Prevention, the Job Xxxxxxx and Health & Safety Representative may report to the Xxxxxxx for immediate corrective action of any unsafe conditions, unsafe acts or violation of safety regulations. Safe working conditions are primarily the responsibility of Management; therefore, all supervisory personnel shall be made aware of all safety regulations and see that they are carried out. 9.03 Every employee shall, as a condition of employment, be required to wear a Safety Helmet of an approved type. The Employers agree said helmets will be supplied by them at no cost to the 68 Provincial Civil Agreement employee. If an employee at termination of employment does not return said helmet, he/she shall be charged at cost. 9.04 Every employee shall, as a condition of employment, own and wear suitable protective footwear. The Employer shall supply protective equipment required in the normal course of the employee’s duties including special clothing such as suitable gloves, at no cost to the employee. SAFETY, SANITATION AND SHELTER. 7.01 Adequately heated enclosures or cabs for employees for protection from severe weather elements shall be provided by the Employer where reasonably required. 7.02 The Employer shall provide Employees with all Personal Protective Equipment (PPE) excluding safety boots, which is required for the job, such as sandblasting, coating, etc. or during inclement weather. The Employer shall ensure that all PPE is correctly sized for each employee. The Employer shall undertake the maintenance of all PPE which include the Employer’s obligation to launder, at the Employer’s expense, all Employer provided flame resistance/fire retardant coveralls. 7.03 The Employer, the employees, the Local Unions and the Union agree to abide by all of the applicable codes of the Canadian Standards Association relating to workplace safety. 7.04 The Employer agrees to abide by the applicable Occupational Health and Safety Act of the Province in which the work is being performed and any regulations applicable thereto as amended from time to time. Employees shall be allowed one coffee break in each half of the working shift. 7.05 The Employer shall provide iced drinking water in approved sanitary containers and paper cups where no running tap water is available. 7.06 When an employee is injured at work in the course of performing his/her duties and the injury requires medical attention beyond first aid, the Employer will arrange for such treatment and provide transportation to that treatment. If the worker is deemed to be unable to return to work that day by the medical professional, the Employer will provide transportation for that worker to a safe location where he/she can spend the remainder of the day recovering. The worker will be paid for the entire day for the hours normally worked. In addition, when a worker is injured on the job and he/she requires attention beyond first aid, the Employer will inform the union of the injury as soon as they are aware of the requirement for additional medical attention beyond first aid.

The Employer shall arrange such facilities with the General Contractor prior to the commencement of work. 16.02 Sanitary toilets shall be provided in accordance with the Occupational Health and Safety Act. 16.03 The Employer shall make safety hats available to employees. Employees must wear these at all times while on the job site working. 16.04 The Employer shall provide employees with such protective and wet weather clothing as may be reasonably required. The Union recognizes the right of the Employer to economically supervise the distribution of the clothing provided, and will co-operate with the Employer to prevent wasteful practices. 16.05 In co-operation with the Employer’s overall program of Accident Control and Prevention, the Job Xxxxxxx may report to the Xxxxxxx for corrective action of any unsafe acts or violations of safety regulations. In the event the Xxxxxxx is not available to rectify any violations, the Xxxxxxx will prevent any employee from working in any unsafe areas.

SAFETY, SANITATION AND SHELTER. 11.01 On all jobs where more than five (5) employees are continuously employed, shelter will be provided for employees to eat their lunch and store their clothing. Sanitary toilets shall be provided in accordance with the Occupational Health and Safety Act of Ontario as amended from time to time. It is understood that the provisions of this Section do not apply to jobs of short duration. 11.02 The Company shall supply safety helmets in accordance with the Occupational Health and Safety Act Regulation to employees at no cost. If an employee, at termination of employment, does not return said helmet, he/she shall be charged at cost. If the helmet is returned and has been made unwearable from willful neglect and abuse, the employee shall be charged for the full replacement value. 11.03 No employee will be discharged by his/her employer because he/she fails to work in unsafe conditions, as set out in the Occupational Health and Safety Act and Regulations. Any refusal by an employee to abide by the Act after being duly warned will be sufficient cause for dismissal. 11.04 It is further agreed that drinking water and paper cups will be provided for employees on all jobs, and that washing water will be provided where outlets are available to the Company. Further, if a trailer is used at the job site for storage of tools and equipment, in addition to the use as lunchroom facilities, the tools storage area will be partitioned off and the lunchroom facilities will be heated when necessary. 11.05 A Safety Committee is to be established, composed of two (2) members of the Union and two (2) representatives of the Company. Meetings, not to exceed one (1) per month, will be held when requested by either party, as per the Occupational Health and Safety Act and Regulations as amended from time to time. 11.06 The parties jointly acknowledge the importance of health and safety on jobsites, which include that all employees report to work fit to perform their duties and free of impairment for any reason including from drugs and alcohol for the duration of the entire shift. The Employer and Union express their joint determination to deal cooperatively and constructively with the problem of substance abuse and misuse having regard to human rights considerations and Employer safety concerns. SAFETY, SANITATION AND SHELTER. 10.1 Employees shall be provided with reasonable and adequate protection from the weather and falling material or other hazards on the job. 10.2 In co-operation with the Employer's overall program of accident prevention, the Xxxxxxx shall report to the xxxxxxx for immediate corrective action any unsafe conditions, unsafe acts, and violations of safety regulations. 10.3 Every employee shall, as a condition of employment, be required to own and wear a safety helmet of a type approved by the Construction Safety Association and the Employer agrees that such helmets may be purchased from him at cost. 10.4 Every employee shall, as a condition of employment, own and wear suitable protective footwear, safety glasses, welder's helmet, and other personal protective equipment required in the normal course of his duties. 10.5 The Employer, the employees and the Union agree to abide by the provisions of the Occupational Health and Safety Act. 10.6 It shall be the duty of every employee to practice good housekeeping. 10.7 The operator of any equipment shall be directly responsible for the safe operation of same. If in doubt as to the ability of the equipment or the load, he shall not move same until safe conditions have been assured. 10.8 The Employer agrees that when work is to be performed outside normal working hours, and Management and the Union consider it hazardous or a risk to the safety of the employee, arrangements shall be made to have other employees available in case of emergency. 10.9 No employees shall be discharged by his Employer because he fails to work in unsafe conditions, contrary to the provisions of the Occupational Health and Safety Xxx 0000. Any refusal by an employee to abide by such regulations, after being duly warned, will be sufficient cause for dismissal.

Sanitary toilets shall be provided in accordance with the Occupational Health & Safety Act. This provision will have been complied with if the Employer has made arrangements with the general contractor or other parties for the use of existing facilities. 26.02 In co-operation with each Employer's overall program of accident control and prevention, it is expected that an employee will report to the xxxxxxx or if the xxxxxxx is not available, to any person responsible for management of the site, for immediate corrective action, any unsafe conditions, unsafe acts or violation of the
