TEACHER AUTHORITY AND PROTECTION. 10.1 The teacher shall observe all rules to maintain student discipline and shall have the right to take whatever action he/she feels necessary to maintain student discipline within the bounds of the Board policies, state statutes, and local school policies. The Board shall give support and/or assistance to any teacher acting in line of duty with respect to maintenance of control of discipline in the classroom or any other school activity.

TEACHER AUTHORITY AND PROTECTION. 7.1 A copy of the Board's Student Code of Conduct will be given electronically to all teachers with an explanation of the changes. 7.2 A teacher may impose classroom discipline as stated in School Board Policies where necessary in cases of infractions and may use reasonable force to protect himself/herself from attack or to prevent injury to himself/herself, another student, or any other school employee or volunteer, or school property. 7.3 Teachers may send disruptive students to the office to maintain effective discipline in the classroom. Prior to sending disruptive students to the office, the teacher will endeavor to achieve correction of student misbehavior. Teachers sending students to the office will either notify office staff by phone or ensure the student is supervised on his/her way to the office. The teacher shall not be responsible for maintaining records of student discipline referrals. 7.4 Any case of assault and/or battery upon a teacher shall be promptly reported, in writing, to the Facility Manager or his/her designated representative. Appropriate action by the Facility Manager shall include recording the incident, reporting to parents and the appropriate law enforcement agency office. At the conclusion of each semester, ABCE shall be entitled to a summary report listing the number of incidents and summarizing the outcomes. 7.5 Time lost by a teacher in connection with any incident in this article shall be handled as follows: A. Time for appearances before a School Board, judicial body, or legal authority shall result in no loss of wages or reductions in accumulated leave. B. In case of job connected disability which materially affects a teacher's ability to perform his/her duties, the teacher's wages shall continue in full without reduction in accumulated leave until Worker's Compensation payments begin. 7.6 No formal action (anything affecting future employment status) against a teacher shall be taken solely on a basis of a complaint by a parent or student or other individual, nor any notice thereof, shall be included in the teacher's personnel file. The personnel file shall be defined as a composite of the school file and the District office file. There shall be no other personnel files. 7.7 If a teacher is complained against or sued as a result of any action consistent with School Board Policies taken by the teacher while performing normally assigned duties, the Board will provide legal counsel to be selected from a list of five (5) at...
TEACHER AUTHORITY AND PROTECTION. A bargaining unit member may impose such discipline as is reasonable under the circumstances and is not in violation of all applicable laws, administrative guidelines, Board policies, and adopted discipline codes, and may use reasonable force to protect himself/herself from attack, or to protect a student where intervention is a prudent course of action.
TEACHER AUTHORITY AND PROTECTION. A. For the purpose of this Article, teachers are considered to be on duty, with respect to the control of students at all times during the regular school day and at any school sponsored event at which teachers may be in attendance. The BOARD agrees to give all reasonable support and assistance to teachers with respect to the control and discipline of students while such students are under the control of the school. B. If it becomes necessary to refer a student to the Principal, a disciplinary referral form shall be filled out at the time of the referral. The BOARD agrees to provide for reimbursement of judgments which may be entered against a teacher in a civil actions arising out of and in the course of the performance of his assigned duties and responsibilities. However, teachers who receive benefits of the Board’s liability insurance coverage under this Article shall be fully subject to the carrier’s requirements with respect to the amount of coverage and qualifications for coverage. In no event shall the BOARD be held liable for additional expenses and sums arising under this Article that are not included and wholly covered by the Board’s insurance policy or policies provided for such cases. E. Subject to law and to the rules of the Board, each employee shall have such authority for the control and discipline of students as may be assigned to him/her by the principal or his/her designated representative and shall keep good order in the classroom and in other places in which the employee is assigned to be in charge of students. Employee actions under this Article shall be in conformance with the duly adopted Code of Student Conduct, which shall be distributed to employees at the beginning of each school year. The Board recognizes the necessity for provision of measures to ensure both the authority and the personal protection of each member of the instructional and administrative staff. It is therefore agreed that, whenever and wherever possible, issues of this nature will be characterized by cooperative efforts and mutual support between and among the various levels of district educational personnel. B. Any case of assault upon a teacher while on duty shall be reported promptly to the site based administration or its designee by that teacher or any other teacher observing or having knowledge of the assault. In cases involving assault by a student upon a teacher, where said teacher is determined by the administration to be free from fault, and where said teacher has filed civil charges, the Board will advise the teacher of his/her rights and obligations with respect to such assault and shall render all reasonable assistance to the teacher in connection with handling of the incident by Law Enforcement and Judicial authorities. C. Any parent or other person not subject to the discipline of the school who assaults any person employed in an instructional capacity on school property shall be guilty of a felony of the third degree, punishable as provided by law. Students will be disciplined in accordance with the Franklin County School Board Code of Conduct. D. Any teacher may use such force as is deemed reasonable in protection from personal attack or to prevent injury to another student or fellow employee. E. In the event that any employee of Franklin County must be searched, probable cause based on reasonable suspicion must be established. Reasonable suspicion must be based on specific, objective facts derived from surrounding circumstances from which it is reasonable to infer that further investigation is warranted. F. Where a teacher is adjudged guilty of a criminal charge or has judgment entered against him/her, the Board has no further responsibility for pay or for loss of accumulated leave. G. Any employee required to appear before a judicial body or legal authority as a result of conditions described in sections B, C, D, E of this Article shall be entitled to leave of absence and as outlined under provision for jury leave provided under this agreement. H. No complaint by a parent or a student directed toward a teacher shall result in formal disciplinary action without the teacher first being given an opportunity to respond at an informal level.   • Safety and Protection Where applicable, the PERFORMING PARTY shall be responsible for requiring employees, contractors, and subcontractors to maintain and supervise all necessary safety precautions and programs in connection with the Grant Activities.   • Authority and Compliance Borrower has full power and authority to execute and deliver the Loan Documents and to incur and perform the obligations provided for therein, all of which have been duly authorized by all proper and necessary action of the appropriate governing body of Borrower. No consent or approval of any public authority or other third party is required as a condition to the validity of any Loan Document, and Borrower is in compliance with all laws and regulatory requirements to which it is subject.

  • Security and Safety A. The Contractor warrants it is and shall remain in compliance with all applicable local, state and federal laws, regulations, codes and ordinances relating to fire, construction, building, health, food service and safety, including but not limited to the Hotel and Motel Fire Safety Act of 1990, Public Law 101-391. The Judicial Council may terminate this Agreement, pursuant to the termination for cause provision set forth herein, without penalty or prejudice if the Contractor fails to comply with the foregoing requirements.   • Governing Law, Regulatory Authority, and Rules The validity, interpretation and enforcement of this Agreement and each of its provisions shall be governed by the laws of the state of New York, without regard to its conflicts of law principles. This Agreement is subject to all Applicable Laws and Regulations. Each Party expressly reserves the right to seek changes in, appeal, or otherwise contest any laws, orders, or regulations of a Governmental Authority.

  • COMPLIANCE WITH HEALTH, SAFETY, AND ENVIRONMENTAL REGULATIONS The Contractor, it’s Subcontractors, and their respective employees, shall comply fully with all applicable federal, state, and local health, safety, and environmental laws, ordinances, rules and regulations in the performance of the services, including but not limited to those promulgated by the City and by the Occupational Safety and Health Administration (OSHA). In case of conflict, the most stringent safety requirement shall govern. The Contractor shall indemnify and hold the City harmless from and against all claims, demands, suits, actions, judgments, fines, penalties and liability of every kind arising from the breach of the Contractor’s obligations under this paragraph.

Parts 1500-1508) for Implementing the Procedural Provisions of NEPA, which requires Subrecipients to use all practicable means within their authority, and consistent with other essential considerations of national policy, to create and maintain conditions under which people and nature can exist in productive harmony and fulfill the social, economic, and other needs of present and future generations of Americans.

  • WORKPLACE SAFETY AND INSURANCE 41.1 Where an employee is absent by reason of an injury or an occupational disease for which a claim is made under the Workplace Safety and Insurance Act, his or her salary shall continue to be paid for a period not exceeding thirty (30) days. If an award is not made, any payments made under the foregoing provisions in excess of that to which he or she is entitled under Articles 44.1 and 44.6 (Short Term Sickness Plan) shall be an amount owing by the employee to the Employer. 41.2 Where an employee is absent by reason of an injury or an occupational disease for which an award is made under the Workplace Safety and Insurance Act, his or her salary shall continue to be paid for a period not exceeding three (3) consecutive months or a total of sixty-five (65) working days where such absences are intermittent, following the date of the first absence because of the injury or occupational disease, and any absence in respect of the injury or occupational disease shall not be charged against his or her credits. 41.3 Where an award is made under the Workplace Safety and Insurance Act to an employee that is less than the regular salary of the employee and the award applies for longer than the period set out in Article 41.2 and the employee has accumulated credits, his or her regular salary may be paid and the difference between the regular salary paid after the period set out in Article 41.2 and the compensation awarded shall be converted to its equivalent time and deducted from his or her accumulated credits. 41.4 Where an employee receives an award under the Workplace Safety and Insurance Act, and the award applies for longer than the period set out in Article 41.2 (i.e. three (3) months), the Employer will continue subsidies for Basic Life, Long Term Income Protection, Supplementary Health and Hospital and the Dental Plans for the period during which the employee is receiving the award. The Employer shall continue to make the Employer’s pension contributions unless the employee gives the Employer a written notice that the employee does not intend to pay the employee’s pension contributions. 41.5 Where an employee is absent by reason of an injury or an occupational disease for which an award is made under the Workplace Safety and Insurance Act, the employee shall not be entitled to a leave of absence with pay under Article 44 (Short Term Sickness Plan) as an option following the expiry of the application of Article 41.2.
