Section Note. The Company will post a notice in the plant when a permanent vacancy in the Operator, Milling Department is to be filled. An employee may indicate his interest by signing the notice. The signing of this interest notice does not restrict the Company from filling this vacancy by hiring from the outside. The Company will post a notice indicating who was awarded the position.
Section Note. Shift differentials are not added to an employee's base rate for purposes of computing overtime, or for any unworked hours for which the employee is paid such as holidays, jury duty, and funeral leave.

Section Rates Of Transfers If an employee is temporarily transferred by the Company to a higher-ratedjob classification, he will receive the higher rate of pay for all hours worked in the higher-ratedjob classification. However, it does not apply to employees who may relieve for breaks or who may be supplementing the workforce performing various tasks or jobs performed by employees in other job classifications. Section Rates Of Permanent Transfers An employee who is permanently transferred to a lower-rated job classification will receive the lower rate at the time he begins work in the lower-ratedjob. If he is permanently transferred to a higher-rated job classification, he will receive the rate of the higher-rated job after he has completed his training and trial period and can satisfactorily perform the duties of the job with no more supervision than is required by other employees on the same job. Temporary employees may be hired as determined by the Company to supplement the workforce. Such employees will not be entitled to benefits under this Agreement nor will the provisions of this collective Agreement apply to them. Such temporary employees will not accrue seniority as a result of such temporary employment. Temporary employees are not considered probationary employees even if the temporary assignment exceeds the probationary period. Individual temporary assignments will not exceed workdays per calendar year. Temporary employees will be paid for all hours worked regardless of the job they are performing. Temporary employees will not be employed until regular employees who are on layoff have had an opportunityto work the temporary assignment. Section Creation Of New Job Classifications If a new job classification is created, the Company will establish a rate for such classification and, if requested by the Union, shall after no more than working days of job experience, negotiate with the Union for a permanent rate for such classification. Such negotiated rate will be retroactive to the date that the job was established. If the negotiation of such rate reaches an impasse, there shall be no arbitration of such wage rate and the parties shall continue to honor the provisions of Article No Strikes Or Lockouts. Section Note. The provisions of this Section will not be used for the sole purpose of scheduling an employee(s) off during the period Monday through Friday in order to work the employee(s) at straight time on Saturday or Sunday (the 6th and 7th days of the workweek). Should a continuous 4-shift operation be scheduled, the premium double-time day in place of Sunday will be the employee(s) 2nd scheduled day off during the workweek.

Section Daily And Overtime Pay All hours worked in excess of straight time hours in any one workweek or straight time hours in any one workday shall be compensated for at the rate of times the employee's straight time hourly rate. An employee who works continuously beyond his regularly scheduled shift and continues working into the next day, or his scheduled day off, or into a new workweek shall receive times his straight hourly rate (or double time if applicable) for such hours he works beyond the start of a new day. Such hours shall not be used to create overtime or premium payments during the employee's regular scheduled shift. For purposes of satisfying the straight time hour requirement, the following hours shall as straight time hours of work up to hours per day or hours per week for days the employee was either scheduledto work or was laid off: (1) a worked or holiday for which the employee is paid, provided it falls on an employee's scheduled straight time day of work, or (2) a paid absence resulting from either bereavement leave, jury duty or vacation time off, or (3) hours per day for Union members miss work as a result of attending contract negotiating meetings with the Company, or (4) days during which the employee was laid off, or (5) absences because of illness or injury provided such an absence is approved subject to the sole discretion of management, without precedent, and on an incident by incident basis.
Section Note. The Company will post a notice when a maintenance vacancy is to be filled through the testing program. An employee interested in entering the Maintenance job classifications may indicate so by signing the notice. The Company may test all or any portion of those desiring to be tested. If all requesting employees are not tested, then those who are tested will be done on the basis of seniority.
