Filling Permanent Vacancies. Permanent vacancies shall be filled by the most senior qualified applicant who, in the opinion of the Director of Transportation, is qualified and capable of adequately performing the assignment. An employee shall be deemed to be “qualified and capable of adequately performing the assignment” for an assignment in the same classification as the employee’s current assignment. [Example: A bus driver will be deemed to be qualified and capable of adequately performing the assignment for all driving positions.] In addition, the provisions of Article 15.05 shall apply when filling any permanent vacancies in noon runs.

Filling Permanent Vacancies. In filling a permanent vacancy in a full-time or part-time certificated position covered by this Agreement, the Employer shall consider any respective applicant's ability, qualifications, experience, length of service with the Employer, the best interests of all students and the School District, and any other factors the Employer considers pertinent.
Filling Permanent Vacancies. Posting and Qualifications - Permanent vacancies in existing or newly created job classifications which the Company determines are necessary to fill will be filled by posting for bid for 3 working days within the department where the vacancy exists. The employees in the department where the vacancy exists shall have the right to bid on the vacancy, and such vacancy shall be filled on the basis of plant seniority provided that the employee is capable of learning and satisfactorily performing the work.
Filling Permanent Vacancies. ‌ a. Whenever a vacancy occurs in a particular job assignment, and the manager elects to permanently fill said vacancy, the vacancy shall be posted for a period of ten (10) calendar days. The posting shall include the duties of the position. Employees holding career status in the classification allocated to that position, and who are assigned to the particular operation in which the vacancy arises, may request to be reassigned to fill said vacancy. The manager shall give first consideration to those employees making such requests before considering any other persons for the vacancy. The term “first consideration” does not mean that the employees requesting transfer to the vacant position have first priority to the job, nor does it require the appointing authority to appoint an employee from such list to the vacancy, but only assures that such employees shall in fact be given consideration for the position prior to reviewing other candidates. b. In the event more than one (1) qualified employee requests to fill said vacancy, the assignment shall be based on classification seniority (or in the case of a tie, highest position on the eligible list) provided relative experience and capability in performing the required job functions and relative disruptive effect on the established work schedule are equal. c. The City shall reassign or prevent the assignment of employees where there is or would be an immediate supervisory/subordinate relationship and the employees have a potential employment conflict of interest due to a parental, spousal, or sibling relationship. d. A vacancy or vacancies resulting from an assignment made hereunder may not be subject to this procedure. e. It shall be within the discretion of the Department Heads, or their respective designee, to make departmental transfers as in their judgment will best meet the organizational, operational, and personnel needs of the departments. f. This Section does not apply to non-career employees.

When a vacancy exists, the vacancy will first be offered to Fluor-B&W Portsmouth LLC USW-represented employees laid off from the job classification in which the vacancy exists and who are on the Classification Recall List for the job classification in which the vacancy exists. The Company shall provide notice as provided in Section 7 of this Article. Recall shall be in order of classification seniority. 2. If a vacancy is not filled under subsection (1) of this Section, then FBP shall offer 3. FBP USW employees the opportunity to bid for this job opening. Classification seniority begins the date of the award of the White Bid. An employee who has been awarded a permanent vacancy shall be transferred as soon as possible, but no later than thirty (30) days after the vacancy posting period has been completed. An employee who has been awarded a permanent vacancy shall be required to accept the vacancy. 4. If a vacancy is not filled under subsections 1 or 2 of this Section, then the Company shall provide an offer to USW represented individuals, in order of bargaining unit seniority, who are laid-off from the Company from classifications other than the classification in which the vacancy exists. Such employees must be qualified for the vacancy and have proof of such qualification in their records at the time the vacancy is being filled. 5. If a vacancy is not filled under subsections 1, 2, or 3 of this Section, then the Company shall provide an offer to individuals with the most site wide seniority who is actively employed in the comparable job classification and who volunteers to transfer employment from other USW-represented employers at the PORTS Site (e.g., WEMS, UDS or their successors). This list of qualified individuals shall be solicited through posting on the Company web site, Union Hall, and posting on available bulletin boards at the PORTS Site. A list shall be developed in order of site-wide seniority, and the Company shall, in cooperation with the Union, poll qualified Union members in order of site-wide seniority. 6. Filling Permanent Vacancies. (Maintenance) A - Entry into the Maintenance job classification will be made at the Company's discretion by either hiring from outside or by the assignment of an employee of the Company's choice to be trained in the job. The following criteria, among others, may be used in the selection of an employee for these job classifications. 1. Filling Permanent Vacancies. (a) Notwithstanding Section 9.10 a permanent vacancy is a vacancy where the duration of the work is intended to exceed twenty-one (21) working days. (b) When a permanent vacancy occurs in a classification within an established line of progression that is vacancy based as set out in Appendix 1, the employee in the next lower classification who possesses the greatest Departmental Seniority will be awarded the job. (c) Department vacancies not filled in accordance with sub-section 9.03 (b) above, shall be posted on bulletin boards at each site for a period of twenty-one (21) calendar days. During this time, employees at either operating site location may apply for the position by completing the form provided by the Company.
