If an employee is requested to serve as a juror in any court of law or is required by subpoena to attend as a witness in a court proceeding in which the Crown is a party, or is required to attend a coroner’s inquest in connection with a case concerning the Hospital, the employee shall not lose regular pay because of necessary absence from work due to such attendance, and shall not be required to work on the day of such duty, provided that the employee: informs the Employer immediately upon being notified that the employee will be required to attend court or the coroner’s inquest; presents proof of service requiring the employee’s attendance; and promptly repays the Employer the amount (other than expenses) paid to the employee for such service as a juror or for attendance as such witness. In addition to the foregoing, where an employee is required by subpoena to attend a Court of Law or Coroner's Inquest, in connection with a case arising from the employee's duties at the Hospital, on his regularly scheduled day off or during his regularly scheduled vacation, the Hospital will attempt to reschedule the employee's regular day off or vacation period, it being understood that any rescheduling shall not result in the payment of any premium pay. If the Hospital fails to reschedule such employees, the Hospital shall arrange lieu time off work for all days the employees would otherwise be off work had it not been for the attendance at Court or the Coroner's Inquest.

The work week within each department shall be arranged as far as possible so as to ail department employees to have an equal amount of weekends off and the days off each week shall be as consecutive as possible, governed by the efficient operation of the Employer. Employees who work overtime will not be required to take time off in regular hours to make up for overtime worked but may take time off equivalent to overtime by mutual arrangements. An employee who is absent on paid time during his scheduled work week because of sickness, Workers' Compensation, bereavement, holidays, vacation or Union leave on scheduled days of work, shall be considered as if he had worked during his regular scheduled hours during such absence for the calculation of eligibility for overtime rates. may exchange shifts with another employee provided that no extra cost to the Employer results; and the employee signs a form agreeing to the change of shift and waives overtime payment, any, for that shift.

and Witness Duty. Regular Full-Time Employees or Temporary Full-Time Employees who are called for Jury Duty or subpoenaed as a Crown witness shall be given time off work during the period of such duty. The employee shall suffer no loss of regular pay for the time so spent and any remuneration received by the employee for such duty shall be remitted to the City. Any costs related to the Court (such as transportation, parking and meals) shall remain the responsibility of the employee. Employees are not required to remit to the City, allowances they receive from the Court for travelling, meals or related expenses. In cases where an employee's private affairs have occasioned a court appearance, such leave to attend at court shall be without pay. Employees granted leave of absence under this Clause shall not lose any seniority or benefits as provided under the Collective Agreement.
