General Provisions for Unpaid Leaves. A. Requests for unpaid leaves under this Article shall be submitted to the supervisor by the deadline specified for each leave, except in emergency circumstances. B. Requests for unpaid leaves under this Article shall not be unreasonably denied. C. Leaves of absence under this Article, except for those under Section 19.1, shall be available to a bargaining unit member after he or she completes three (3) months of employment as a bargaining unit member. This provision does not apply to military leave. D. Extensions may be granted upon request, provided that the request is made in accordance with the same deadline specified in the appropriate leave section of this Article. E. A bargaining unit member who is granted a leave of absence shall return to his/her former position if available or to his/her former status, with the same salary and benefits, and with length of service credit. If, during the period of leave, a layoff occurs, the bargaining unit member on leave shall receive the same rights as other bargaining unit members under this Agreement.

Denials of requests for extensions shall be grievable through Level Two of the Grievance Procedure (Article 31) and shall not be subject to arbitration. D. A graduate student employee who is granted a leave shall return, through the expiration date of their appointment in effect at the commencement of the leave, to their former position or an equivalent position with the same stipend and benefits. If, during the period of leave, a layoff occurs, the graduate student employee on leave shall receive the same rights as other graduate student employees under this Agreement. E. This Article shall apply only in situations where a graduate student employee granted a leave remains an enrolled graduate student at the University of Massachusetts Amherst during the entire period of the leave.
General Provisions for Unpaid Leaves. A. All leaves without pay are granted at the discretion of the Vice President for Business Affairs and Finance or designee. Applications for such leaves must be submitted to and approved by the employee's supervisor, unit head, and Vice President or Xxxxxxx prior to being submitted to the Department of Human Resources. Except as otherwise specified in this Article, requests for non-emergency leave should be submitted at least one (1) month prior to the beginning of the leave date. B. An unpaid leave of absence is not considered a break in seniority, and additional seniority shall continue to accrue. During an approved unpaid leave of absence, the employee will not accumulate vacation leave, sick leave, or holiday time. An employee may request an extension of any unpaid leave of absence in writing to the Department of Human Resources. C. The employee shall notify the University of her/his expected date of return from an unpaid leave of absence without pay. Upon completion of such leave, the employee is to be returned to the position formerly occupied, or to an equivalent position if the employee's former position no longer exists, at the same rate of pay including any increases that would have accrued if the employee had been on the job. If a layoff occurs during the period of leave, the employee on leave shall receive the same rights upon return to work as other employees under this Agreement. D. The University will continue to pay its share of all group insurance benefits consistent with the procedure set forth in this Agreement during an unpaid leave of absence such that said group coverages are continued through the end of the calendar month in which the employee last actually worked or was on paid leave status, whichever is later. Beginning with the first day of the calendar month immediately following the month in which the employee last actually worked or was on paid leave status, whichever is later, the employee shall be responsible for paying for insurance benefits consistent with the provisions of COBRA for such period of time as the employee is eligible for COBRA coverage. The University shall continue Basic Life Insurance coverage for an employee who becomes disabled and granted disability benefits according to the provisions of the state retirement system or the Long Term Disability program for a period not to exceed three (3) years.
General Provisions for Unpaid Leaves. 1. Unpaid leaves of absence, if approved, shall be granted for the remainder of a semester, the remainder of a school year, or for an entire school year. Such leave may terminate at the end of any vacation or grading period. Earlier termination of leaves shall be at the discretion of the Superintendent/Designee. 2. Upon a bargaining unit member's return from an unpaid leave of absence, the Board will make every reasonable effort to return the member to a position comparable to that held prior to the member's leave of absence. 3. Upon a bargaining unit member's return from an unpaid leave of absence for maternity, paternity, or adoption purposes, the Board will place the member in the position held prior to leave if the member returns to service by not later than the beginning of the school year immediately following the school year in which such leave began. 4. Any bargaining unit member who, while on an unpaid leave of absence, accepts a full-time teaching contract with another district or engages in other similar full-time employment may be considered to have resigned his/her employment with the Board. 5. If the insurance carrier permits, a bargaining unit member on an unpaid leave (other than leave under the Family and Medical Leave Act of 1993) may continue group insurance coverage at the member's expense.
General Provisions for Unpaid Leaves. (a) Except as provided in 43.1 above and 43.5 below, during unpaid leave, a member may elect to continue all group insurance benefits provided the member does not become newly employed elsewhere anytime during the leave and provided he/she pays the appropriate monthly premiums for such benefits to the Board's Treasurer. (b) The member returning from an unpaid leave of absence will resume the contract status held prior to the leave and to the extent possible, be assigned to the same or similar position held prior to such leave. The member who is certificated/licensed in more than one area will, to the extent possible, be returned to a position in the same area of certification/licensure held prior to the leave. (c) All unpaid leaves under this Article, other than disability leaves, shall expire at the end of a semester or a school year. No member may return from a leave prior to its expiration unless the early return is approved by the Superintendent/designee. (d) Members on an unpaid leave of absence must give the Superintendent written notice of resignation or intention to return to his or her position at the beginning of the next school year. Failure of a teacher to submit written notice to the Superintendent by April 1, shall be deemed to be a resignation by the teacher, which resignation may then be accepted by the Board of Education, effective at the end of the school year in which the deadline for notice occurs. The Superintendent may waive the above specified deadlines for a member if the Superintendent has received by March 15 of such year a written request stating the reasons to extend the above notification deadline.

Upon return from an unpaid leave, the employee may return to his/her original position or to a comparable position. 3. If the insurance contracts permit, an employee on unpaid leave may continue group insurance coverage at the employee's expense. The employee shall tender payment in advance to the Treasurer in such a form as the Treasurer may require. Upon return from leave, the Board shall resume paying its share of the benefits after the employee has completed thirty (30) workdays of actual service and meets the reenrollment criteria in the insurance contracts. The thirty (30) workday service requirement shall not apply to employees returning to service after an injury compensable under workers' compensation. Such employees shall resume Board-paid insurance coverage at the earliest time allowed by the insurance contracts. 4. Upon return to service, the employee will be placed on the same step on the salary schedule as he/she enjoyed prior to the leave, unless the employee actually worked at least one hundred twenty (120) days within the school year, thus entitling him/her to advancement in accordance with District policy. 5. Any employee who, while on unpaid leave, accepts or engages in full-time or part-time employment may be considered to have resigned his/her employment with the Board.
General Provisions for Unpaid Leaves of Absence a. Child Care Leave, Disability Leave, Leave for Academic Study or Work Experience, Leave to Hold Elected Office, and Long-Term Unpaid Leaves of Absence are the unpaid leaves addressed in the contract and shall be without fringe benefits, provided however that the District will maintain an employee's health insurance coverage if required to do so by the federal Family and Medical Leave Act of 1993 (FMLA). An employee on unpaid leave shall be allowed to purchase health and life insurance to the extent allowed by the district's insurance provisions. b. An employee must submit a written request to the Executive Director of Human Resources for unpaid leave at least ten (10) work days in advance of the need for the leave. Employees who are in unpaid leave status without prior written approval by the Executive Director of Human Resources may be subject to termination of employment. c. Seniority shall accrue as if the employee remained on paid status for an approved unpaid leave of absence of up to thirty (30) work days. Seniority may be adjusted for an unapproved leave of absence. d. If unpaid leave of absence is thirty (30) or fewer work days of one (1) fiscal year, then the following return provision shall apply: The employee shall return to work on the next work day following the expiration date of the leave to the position he/she held prior to the commencement of the leave. e. If the unpaid leave of absence is more than thirty (30) work days, or if the employee's absence extends into two (2) fiscal years, then the following return provisions shall apply: 1. The employee shall return on his/her first scheduled work day of the fiscal year as established by the District, except for disability leave when the employee shall return on the date established by the doctor's statement. 2. The employee shall notify the Human Resources Department of the District in writing at least thirty (30) calendar days in advance of the expiration of the leave if the leave is less than sixty (60) days, otherwise in all other cases by at least sixty (60) calendar days' advance notice. Failure to give such notice shall be treated as a voluntary resignation. 3. The employee shall be returned to his/her former position if it is vacant. If not, then the employee shall be returned to a position in the same classification held at the time of the leave request. f. Upon return from Professional Study Leave, Political Leave, Association Leave, or International and Federal Leaves, members shall be placed at the same position on the salary schedule as they would have been had they worked in the District during such period. 6. Members on leave of absence, other than FMLA/OFLA, shall not be permitted to continue group insurance coverage and would need to apply for COBRA benefits through their insurance carrier at their own expense if they would like insurance coverage during the leave. In the event that a member is injured on the job and is entitled to Workers’ Compensation, the District will continue to pay the insurance premiums for a maximum of six (6) months.
