INCLEMENT CONDITIONS a. The Employer/Agency designated official(s) may close or curtail offices, facilities, or operations because of inclement weather or weather-related hazardous conditions. The Employer/Agency will announce such closure or curtailment to employees. The Employer/Agency will strive to make its decision to close and/or postpone day shift no later than 5 a.m.; however, the parties recognize that changing conditions may require further adjustment. The Employer/Agency may provide this information through methods such as pre-designated internet web sites, phone trees, radio stations and/or television media. The Agency shall notify employees of these designations and post the notices on Agency bulletin boards by November 1st of each year. Notifications do not apply to employees who are required to report to work. Essential employees/positions shall be designated by the Agency by November 1 of each year. Such designations may be modified with two (2) weeks advance notice to the affected employee(s).
b. Where the Employer/Agency has announced a delayed opening pursuant to Section 1a, employees are responsible for continuing to monitor the reporting sites for updated information related to the delay or potential closure. Employees may be allowed up to two (2) hours commuting time as reasonably needed to report for work after a delayed opening has been announced. Where an employee arrives late due to this extended commute, he/she may cover the time with accrued vacation, compensatory time off, personal leave or approved leave without pay.
Section 2. When the Employer/Agency notifies employees not to report to work pursuant to Section 1, prior to the beginning of the work shift the following applies:
a. FLSA Non-Exempt Employees. Non-exempt employees shall not be paid for the period of the closure. However, employees shall be allowed to use accrued vacation, compensatory time off, personal leave or approved leave without pay for the absence(s). A non-exempt employee arriving at work after the Employer/Agency has announced a closure or curtailment of operations may be directed to leave work and if so directed shall not be paid for the remainder of the shift unless utilizing accrued leave as described above. An employee who actually begins work shall be entitled to pay for all actual hours worked.
INCLEMENT CONDITIONS. Section 1. When in the judgment of the Department, weather conditions require the closure of the work location after an employee reports to work, the employee shall not be required to use accrued leave for the remainder of the workday.
Section 2. If the Department closes a work location before the normal work day starts, the Department will notify employees not to report to work because of inclement weather or hazardous conditions. In such cases the Department, either directly or through the Department of Administrative Services announcement, will use radio or television and other electronic means such as email, text messages and announcements on State websites to attempt to notify employees of the closure prior to their leaving home. The Department shall notify all employees locations where such information may be found by a posting on the Department’s intranet.
Section 3. If the Department gives notice of closure of a work location before the beginning of a workday and an employee is not otherwise approved to be on pre-scheduled leave or authorized to report to a different work location, the employee shall not be required to use accrued leave for the day of the closure.
Section 4. If local conditions in the vicinity of the employee's residence make travel to the work location hazardous, the employee shall notify the employee's supervisor that the employee is unable to report or will be late in reporting for work. The employee shall use accrued leave or leave without pay during the period that the employee's work is curtailed due to the hazardous conditions, unless the employee arranges with the Attorney In Charge to perform his or her work assignment in another way, such as working at home, working at another State office or performing work at another time.
Section 5. An employee may be required to use accrued leave when closure of a work location applies to that employee for a full workweek.
INCLEMENT CONDITIONS. When, in the judgment of the Agency Head/Functional Unit Manager or designee, weather conditions require the curtailing of institutions operations within the employees regularly scheduled work day and the employees are ordered home, the employees will be paid for the remainder of their regularly scheduled shift.
INCLEMENT CONDITIONS. Section A. When, in the judgment of the Institution, weather conditions require the closing or curtailing of operations after the teacher reports to work, the teacher shall be paid for the remainder of his/her work day.
Section B. Teachers unable to report due to verified inclement weather conditions may be authorized to use personal leave, leave without pay, or the floating day as provided in Article 23.A.5 (Paid Leaves of Absence) during the period in which the teacher's work is curtailed due to the inclement weather or hazardous conditions.
Section C. Teachers who arrive for work and are unable to leave because of verified hazardous road conditions resulting from inclement weather or road closures shall be allowed to stay inside a building.

The employee may elect to use accrued leave or leave without pay during the period that the employee’s work is curtailed due to the hazardous conditions, unless the employee arranges with the employee’s immediate supervisor to perform his or her work assignment in another way, such as working at home, working at another state office or performing work at another time.

Section 2. The Agency Head or designee may direct employees to remain at home prior to the beginning of the work shift because of inclement weather or hazardous conditions. If announcement is provided by telephone, television, or radio prior to the employee leaving home, the employee will be authorized the optional use of accrued vacation, compensatory time, or leave without pay during the period in which the employee's work is curtailed due to the inclement or hazardous condition.
Section 3. If notice is not given as herein provided, and the employee reports to their regularly scheduled shift of work, they shall be assigned work and paid for the full shift of work.
INCLEMENT CONDITIONS. 3 A. Nothing in this Agreement shall require the Board to keep the College open in the event of 4 inclement weather, or when otherwise prevented by an act of God.
5 B. If the College closes due to inclement weather, employees shall not suffer loss of time.

When, in the judgment of the Department of Administrative Services, the Agency Head or designee, weather conditions require the curtailing operations within the employees regularly scheduled work day and the employees are ordered home, the employees will be paid for the remainder of their regularly scheduled shift.
Section 2. When the Department of Administrative Services, the Agency Head, or designee chooses to close an office or facility before the start of an employee’s work day, one of the following options will be implemented:
a) The employee will work from home or an alternate work location for at least one half of their regular work day. The balance of the employee’s work day will be paid inclement weather/hazardous conditions leave for up to forty (40) hours per biennium, or
b) If the employee is unable to work remotely they will choose to use accrued vacation hours, compensatory time off, personal business leave, or leave without pay for at least one half of their regular work day. The balance of the employee’s work day will be paid inclement weather/hazardous conditions leave not to exceed forty (40) hours per biennium, or
c) The employee may, with Agency prior approval, temporarily adjust their work hours during the same workweek to make up for hours not worked. The Agency shall not suffer any overtime or penalty payments as a result of this schedule change. In the event the forty (40) hours of inclement weather/hazardous conditions leave is used, and there are more closures during the biennium, the employee will choose to use accrued vacation hours, personal business leave, compensatory time off, leave without pay, or with prior Agency approval, temporarily adjust their work hours during the same work week. In such situation when the employee has used forty (40) hours of inclement weather/hazardous conditions leave, the employee may work remotely in lieu of using accrued leave, upon supervisor approval. The Agency shall not suffer any overtime or other penalty payments as a result of the change in schedule. Employees will not be eligible for inclement weather/hazardous conditions leave when their regular days off occur on a day the Agency closes an office or when the employee is on pre- scheduled leave. Inclement weather/hazardous conditions leave shall not count as hours worked for the purpose of overtime calculation.
