PERSONAL LEAVE AND COMPASSIONATE LEAVE. 39.1 Personal leave and compassionate leave will be provided in accordance with Part 7 of the Workplace Relations Act 1996 (Cth) as amended from time to time (which includes the employee being required to meet the evidentiary and notice requirements) including as set out below.
PERSONAL LEAVE AND COMPASSIONATE LEAVE. An employees entitlement to paid personal/carers leave accrues progressively during a year of service and accumulates from year to year. (i) Paid sick leave and paid carers leave are cumulatively referred to as Personal Leave. In addition to Personal Leave, an employee is entitled to Compassionate Leave. (ii) Paid Personal Leave in accordance with the NES may be used for sick leave and/or, carers leave. Paid Compassionate Leave may be used for bereavement and other such purposes as prescribed by the NES. Full time and part time employees are entitled to paid Personal Leave and Paid Compassionate Leave. Casual employees are not entitled to such paid leave, however may access unpaid components as per the Act. (iii) Full Time employees shall receive an amount of no more than 75 hours in total per anniversary year (equivalent to 10 days per annum) for the purpose of paid Personal Leave, to be used for either their own personal illness (ie sick leave) or to care for a family member who is ill (ie carers leave). Part time employees shall receive a pro rata amount of entitlement based on their average hours worked. Should an employee’s paid leave accumulation becomes exhausted, that employee is entitled to request unpaid leave as per the Act. (iv) All periods of personal leave, whether paid or unpaid, are to be notified to the Executive Manager/Director of Care immediately and directly where possible, prior to the absence occurring and where possible no less than 24 hours prior to the taking of Personal Leave. Failure to correctly notify the Executive Manager/Director of Care of an absence may result in the absence being deemed leave without pay. Notification via second and third parties, or via text, email, facsimile or social media will not be accepted, unless exceptional circumstances exist (eg hospitalisation). (v) All periods of leave, including single day absences where requested by management, must be covered by a medical certificate and endorsed by a medical or healthcare practitioner. The Act also allows other acceptable equivalents such as a Statutory Declaration, to be provided by the employee to the employer to cover absences. The certificate (or other acceptable equivalent as per the Act) must contain information regarding the absence that is acceptable to a reasonable person. PERSONAL LEAVE AND COMPASSIONATE LEAVE. 40.1 Personal leave and compassionate leave will be provided in accordance with the Fair Work Act 2009 as amended from time to time (which includes the Employee being required to meet the evidentiary and notice requirements) including as set out below.
PERSONAL LEAVE AND COMPASSIONATE LEAVE. The provisions of this clause apply to permanent full time and permanent part time employees (on a pro rata basis) but do not apply to casual employees. For the purpose of this clause, immediate family means: (i) Spouse, child, parent, grandparent, grandchild or sibling of the employee (ii) Child, parent, grandparent, grandchild or sibling of a spouse of the employee. Personal leave and Compassionate Leave are available in accordance with the Australian Fair Pay and Conditions Standard. These conditions, along with the company’s notification and documentation requirements, are summarised below.

PERSONAL LEAVE AND COMPASSIONATE LEAVE. Employees accrue 10 days personal leave per year of service. Personal leave comprises 10 days sick leave per year of service. Employees are entitled to draw from their sick leave accruals up to 10 per year paid personal leave to care for a member of their immediate family. Whereas sick leave accrues annually, personally leave is capped at 10 days per annum. Where an employee has exhausted all paid personal leave, they are entitled to take up to 2 days unpaid leave on each occasion to care for an immediate family member. Employees must provide a medical certificate. Compassionate leave is available of up to 2 days per occasion where a member of their immediate family falls ill and the employee is a principal carer, or the member dies. In accessing leave, Employees are required to provide a medical certificate or other proof to the satisfaction of Sandvik.

  • Compassionate Leave (1) An employee is entitled to take up to 2 days’ paid compassionate leave on each occasion that a member of his or her immediate family or a member of his or her household: (a) contracts or develops an illness that poses a serious threat to his or her life; or (b) sustains an injury that poses a serious threat to his or her life; or

  • Personal Leave Written request for a personal leave of absence without pay will be considered on an individual basis by the Hospital. Employees needing personal leave days for appointments with medical practitioners may utilize the personal leave language. Such leave shall not be unreasonably withheld.

  • Personal Leave Days Section 1. All employees after completion of six (6) months of service shall be entitled to receive personal leave days in the following manner: (A) All full time employees shall be entitled to twenty-four (24) hours of personal leave with pay each fiscal year; (B) Part-time, seasonal, and job share employees shall be granted such leave in a prorated amount of twenty-four (24) hours based on the same percentage or fraction of month they are hired to work, or as subsequently formally modified, provided it is anticipated that they will work 1,040 hours during the fiscal year; Section 2. Should any employee fail to work 1,040 hours for the fiscal year, the value of personal leave time used may be recovered from the employee. Section 3. Personal leave shall not be cumulative from year to year nor is any unused leave compensable in any other manner. Section 4. If the permissible occasion is the contraction or development of a personal illness, or the sustaining of a personal injury, the Employee may take the compassionate leave for that occasion at any time while the illness or injury persists.

  • Personal/Xxxxx’s Leave 7.3.1 All full time employees shall be entitled to accrue paid personal / xxxxx's leave on the basis of 10 days per year (or pro-rata thereof for any period less than one year). Part-time employees are entitled to a pro-rata benefit. Paid personal / carer's leave is cumulative. 7.3.2 All accrued personal leave shall be available for use as carer's leave in accordance with the provisions outlined below. 7.3.3 As part of its commitment to provide a family-friendly workplace, the employer will allow employees to use any amount of accrued personal /xxxxx's leave to enable employees to: (a) provide primary care to partners, children and/or other household or family members. (b) attend the funerals of family or household members or close family relatives (if compassionate leave is not available in the circumstances). 7.3.4 The leave provided for in this clause will be granted subject to the following: (a) The employee must notify the employer of the reason and likely duration of the absence before 7.00 am on the first day of the absence, unless this is not possible due to an unexpected emergency in which case the employee must notify the employer as soon as practicable. (b) Where circumstances permit, an employee must endeavour to arrange leave to minimise the impact on operational needs. (c) The provision of appropriate documentary evidence. 1. For sick leave, a medical certificate or if not reasonably practicable to provide a medical certificate- a statutory declaration made by the employee. 2. For xxxxx's leave, a medical certificate in respect to the family or household member, or a statutory declaration by the employee. 3. For compassionate leave, any evidence that the employer reasonably requires. 7.3.5 The employee is not entitled to take more than 10 days of paid xxxxx’s leave (1/26th of the nominal hours worked by the employee) per year, regardless of the amount of personal leave the employee has accumulated over time. 7.3.6 An employee may request to cash out any amount of paid personal/xxxxx’s leave that they have accrued that is excess of 3/52 of the number of nominal hours worked over the past 12 months. For example, an employee working 38 hours per week over 12 months must retain 15 days of paid personal/carer’s leave and may cash out any further personal/carer’s leave that has been accumulated. 7.3.7 In addition to the above, a request to cash out personal/xxxxx’s leave will only be granted where: (a) the employee elects to cash out their leave in writing; and (b) the employer agrees. 7.3.8 Casual Employees engaged in continuous service shall be entitled to personal leave limited to the provision of sub clause 7.3.

  • Personal Leave With Pay Full-time employees who are eligible to accrue sick leave may use up to a maximum of six days personal leave with pay per year provided that such days shall be charged against the employee's currently accrued sick leave. This leave is non-cumulative.
