Within an employee’s regular work week, work shifts will ordinarily be scheduled to start within the “windows,” as established above; provided, however, that up to two (2) work shifts per employee per month may be prescheduled to start any time between 6 am and 6 pm without giving rise to an obligation for additional pay such as delayed reporting time or call-in. This subsection (f) does not provide a right to alter days off; provided, however, that completion of a shift rescheduled under this subsection may extend into the following calendar day. (g) An employee’s scheduled day(s) off may be altered (through timely posting in accordance with this Article) to accommodate attendance at training under the following circumstances: (i) up to eight (8) regularly scheduled days off per employee per fiscal year for the purpose of special teams training; and/or (ii) for any training of more than three (3) days in duration. Except as provided in this subsection, the Department may not change an employee’s day(s) off for the purpose of avoiding overtime or to accommodate training.

(b) Uniform schedule: Effective July 1, 2001, the normal work schedule for uniformed Troopers, Corporals, and Sergeants shall be 4 on - 2off/5 on - 2 off resulting in 252 workdays per employee, per year. Therefore, employees shall normally work 180 hours during a 28 day work period, with 160 hours normally paid at straight time rates and 20 hours normally paid at applicable overtime rates. Daily work schedules may consist of 8, 9, 10, 11.25 or 15 hour work days depending on the work period. (c) Uniform Troopers, Corporals and Sergeants who are assigned to work a Monday through Friday, 5 on-2off schedule, (e.g., HQ assignments, Corridor and Commercial Vehicle Team, and Station Administrative Officers) shall have 9 hour work days with the hours worked in a 28 day work period paid in same manner as in Section 2(b) above. The overtime rate is one and one-half (1-1/2) times the regular rate of pay for all work suffered or permitted. Overtime shall be approved by the employee's immediate supervisor before the time is worked.

REGULAR HOURS AND OVERTIME. 17.01 Nine (9) hours shall constitute a day's work within an nine and one-half (9 1/2) hour period with one half (1/2) hour off for lunch, and thirty-six (36) hours shall constitute a week's work. Weekly hours shall be compiled by each employee working four (4) consecutive nine (9) hour days and receive three (3) consecutive days off. The employer may, with the Union's consent, implement a program of eight (8) hour work days over a five (5) consecutive day period from Monday to Friday or Tuesday to Saturday. The work day shall be eight and one-half (8 1/2) hours with a one-half (1/2) hour unpaid lunch period. While the employer shall determine when and where to utilize an eight (8) hour work day or a nine (9) hour work day, it shall schedule changes for the lengths of the work days with as much notice to the employee as practical.
REGULAR HOURS AND OVERTIME. (a) The maximum number of weekly straight-time hours for any employee shall be forty (40) hours per week, inclusive of paid breaks, after which the double time (2x) overtime rate shall apply. (b) The normal full-time hours of work shall be established by the Employer to best meet its operational requirements in accordance with one of the following shift patterns: (1) A shift length of seven (7), seven and one-half (7.5), eight (8), eight and one-half (8.5), nine (9), nine and one-half (9.5), ten (10) and twelve (12) hours worked inclusive of the paid meal break. (2) A shift of four (4) hours duration may be utilized for additional work that is provided pursuant to Article 7.12. (3) The Employer shall give as much notice as operationally possible to the Union, in writing, but not less than thirty (30) calendar days notice, when as a result of a new project or building, the Employer intends to implement hours of work that are different than those set out above. At the Union's request, the parties shall meet to discuss and to mutually agree upon such new work hours, provided that the implementation of such new hours shall not be delayed by so doing. The Union shall not unreasonably withhold its agreement upon the new hours when the Employer can show that its operational and/or funding requirements are best met by the hours of work the Employer has implemented. Should the Employer believe the Union is acting unreasonably, the Grievance and Arbitration Procedures under this Agreement may be applied. (c) Where an existing permanent position's days/hours are altered under subsection (3) above, the positions shall be reposted and filled pursuant to the provisions of Article 14, unless the Union agrees otherwise on a case by case basis. This requirement to re-post does not include when the days to be worked in a posted position change as result of a short-term change in funding that does not exceed three (3) months. This section (c) does not apply in cases where an employee and the Employer mutually agree that the employee will work a minor variation from the hours than set out in the employee's posting [e.g., one (1) or two (2) hours]. The Union will be immediately informed of such arrangements. (d) Employees will be paid the double-time (2x) overtime rate when they are required by the Employer to work more than their scheduled straight-time shift on any workday.
