SENIORITY AND JOB POSTING. 18.01 An employee shall not accrue or acquire seniority until he has successfully completed his probationary period. Upon successfully completing his probation period, his seniority shall date back to his date of hire. 18.02 The Employer shall recognize the principle of seniority, and qualifications for the purpose of daily call- in a) Every six (6) months, the Employer shall send a current seniority list to the Union. Seniority shall be defined as: - full-time seniority is by the date the employee became full-time - part-time seniority is by the date the employee was hired - full-time employees shall have seniority over part-time employees b) Promotions to higher classifications within the bargaining unit shall be made in accordance with seniority and qualifications. Employees considered for promotion must possess the ability necessary for the higher classification. The Employer shall determine the ability. Such determination shall not be unreasonable, and shall be subject to the Grievance Procedure. Any employee who has been promoted to a higher classification within the bargaining unit, and after a reasonable trial period (not to exceed three months) does not meet the Employer’s requirements for the higher position, shall be restored to his former position. c) The Employer will institute a training period of up to three (3) months for all employees moved up to operator, shipper, utility, mechanic’s helper, or mechanic. During this period, the employee will receive their original classification wage through the training period. When the employee successfully completes the training and period and is awarded the position they shall receive the new classification wage paid retroactively to the beginning of the training period. Employee’s that are required to train co-workers, as per c) above, for their new positions shall receive a training allowance of one dollar ($1.00) per hour of training. d) Demotions to lower classifications within the bargaining unit, due to reduced work requirements of the Employer, shall be made in reverse order of seniority. Employees who wish to exercise their seniority, must have performed that work prior to displacing a junior employee 18.03 In laying off and in recalling employees from layoff, the Employer will consider the skill, ability and seniority of the employees to perform the available work. 18.04 All permanent and/or temporary full-time vacancies shall be posted for a period of five (5) days to allow interested employ...

Continuous employment means the performance of all scheduled hours of 15 work, including time off because of paid-leave hours, legacy extended- 16 illness hours, and low-census hours, reduced by the periods of any 17 authorized unpaid leaves of absence of 14 or more days that has not been 18 interrupted by the occurrence of the following: 19 a. Termination, unless rehired within 30 days. 20 b. Layoff for lack of work that has continued for six consecutive 21 months. 22 c. Continued absence following the expiration of a written leave of 23 absence or emergency extension thereof granted by Hospital. 24 d. Absence from work for three consecutive working days without 25 notice to Hospital. 26 e. A staff 5 nurse covered by this Agreement who, without a break in employment by 6 Hospital, enters non-bargaining-unit employment by Hospital that is not 7 covered by this Agreement retains all previously earned seniority under 8 this Agreement, which will be the individual’s seniority if the individual is 9 subsequently employed as a staff nurse under this Agreement without a 10 break in Hospital employment. 12 B. Job Posting and Filling of Vacancies: 13 1. Qualified internal nurse applicants who apply using the Hospital’s current 14 application system to change units, shifts, or hours will be hired in order of 15 seniority when vacancies occur, first among all full- and part-time nurses 16 within the unit, then among staff nurses in the Specialty Nurse Residency 17 program (unless Specialty Nurse Resident was an ONA represented 18 employee before residency, in which case seniority applies), then among 19 Per Diem applicants within the unit, then among all full- and part-time 20 nurses house-wide; and next among Per Diem applicants house-wide. 22 A nurse applicant who is awarded a new position will be moved to 23 the position within six (6) weeks after the...
