Seniority Computation. Computation of seniority for regular status employees shall be made as follows:
a. One (1) point per month for each month of continuous service with the Agency. A break in service is a separation from the service without pay for more than two (2) years. All part-time service shall be credited on a prorated basis. Periods of authorized leave without pay of fifteen (15) calendar days or more, other than for Union Activity that are for more than ninety (90) calendar days will be deducted from service credits calculations. When a layoff is announced, seniority scores shall be frozen on that date until the layoff and any subsequent bumping activity is completed. Service credit lists for permanent employees shall be updated and posted annually beginning October 1, 2011.
b. If two (2) or more employees have equal seniority, the tie shall be broken as follows, with most credit given in priority order:
1. Length of continuous service in the job classification in the Agency;
2. Length of continuous service with the Agency; and
3. Length of continuous service with the State.
Seniority Computation. Where two or more sergeants have the same time in classification, seniority shall be determined by time in rank. Where two or more sergeants have the same time in rank, seniority shall be determined by time in service. Where two or more troopers have the same time in classification, seniority shall be determined by time in service. Where two or more employees have the same time in service, seniority shall be determined by final recruit school class standing. Where two or more employees have the same final recruit school standing, seniority shall be determined by final composite entry level Civil Service Score. Where two or more employees have the same final composite entry level Civil Service Score, seniority shall then be determined by adding the last four digits of an employee's Social Security number, with the greatest number equating to the greatest seniority.
Seniority Computation. A. For purposes of this Article, seniority will be computed from a unit member’s first day of actual service in a licensed position in the district.
B. Seniority shall continue to accumulate when unit members are on approved Board paid or unpaid leaves.
C. Seniority will not be broken by employment by the district in a position outside the bargaining unit. However, such time will not be counted in computing seniority except for time spent in other licensed positions.
D. The following procedure shall be used to break ties, in the order indicated, when the years of service in the district as a licensed employee are equal:
1. The unit member possessing the most experience as a licensed employee shall retain the position.
2. The unit member possessing a master’s degree or equivalent placement on the salary schedule shall be retained over a unit member who is placed on a lesser column on the salary schedule.
3. The unit member possessing the greatest number of hours beyond the degree shall retain the position.
4. In the event a tie remains, the order of seniority will be determined by the drawing of lots by representatives from the Human Resources Department and observed and recorded by the NCEA. The employees shall be informed of the results of the tie breaker.
E. All seniority is lost when a unit member resigns, retires, is dismissed or nonrenewed. Unit members who are laid off shall retain all seniority held as of the effective date of layoff for a period of 36 months, but shall not accrue seniority during the period of layoff.
F. For purposes of this Article, the Association president(s) and the president-elect/first vice president and the second vice president shall not be laid off during their term(s) of office. Upon completion of their term(s) of office, the elected officer(s) will return to the formerly held position(s). In the event the formerly held position has been eliminated as a result of the layoff reasons listed in Section 9.1, the elected officer(s) will return to a similar position based upon certification, qualifications, and seniority.
G. The Human Resources administrator will provide the Association with a list showing the seniority, based on licensure, of district unit members by November 1 of each year and will provide the list again by February 1 and April 1. Seniority Computation. City seniority shall be computed as follows:
A. City seniority is continuous service, not broken by dismissal or resignation, commencing from the date of hire as a regular full-time employee. City seniority shall apply in all cases of choice, such as, but not limited to: shift bids and vacation. For the Police Department only, shift bids shall be done by classification seniority which shall commence with the first day of work within the classification.
B. If two (2) or more persons are hired into full-time status by the City on the same date, an alphabetical ranking of the employee’s last name will be the tie breaker from A through Z.
C. Upon satisfactory completion of the probationary period, the employee shall be placed on the seniority list retroactive to the date of hire.
D. A break in continuous service due to any layoff, period of unpaid leave, not protected by law or any other provision of the Agreement, or suspension without pay in excess of forty-five (45) consecutive calendar days shall not be counted in seniority calculations and the employee’s service dates shall be adjusted accordingly.
Seniority Computation. A. A full-time teacher shall acquire one (1) year of seniority for each complete year of full-time, continuous employment in the District from the teacher’s earliest hiring date. A full-time teacher working less than a complete school year shall acquire fractional seniority calculated by dividing the number of days worked by the number of workdays in the school calendar. For purposes of this section “days worked” shall be defined as days for which the teacher receives regular salary from the District. Days for which the teacher does not receive regular salary shall not result in seniority credit. No teacher shall receive credit for more than a full year of seniority in any given school year.
Seniority Computation. Whenever a permanent employee is laid off, the order of layoff within a classification shall be determined by length of service within the classification. The employee who has been employed the shortest time in the class, plus higher classes, shall be laid off first.
17.3.1 Length of service (seniority) will be computed on the basis of hours in paid status, whether during the school year, a holiday, recess, or during any period that school is in session or closed, but does not include hours compensated on overtime basis.
17.3.2 “Hours in paid status" shall not be interpreted to mean any service performed prior to entering into a probationary or permanent status in the classified service.
17.3.3 Any hours worked in an out-of-class assignment shall be computed as hours in paid status in the employee’s permanent position.
17.3.4 Less than twelve (12) month employees:
17.3.4.1 Any hours taken as vacation time by less than twelve (12) month employees, including periods of time outside their regular work schedule (i.e., summer) shall be computed as hours in paid status.
17.3.4.2 Hours worked in other than the employee’s permanent classification during any off-contract period (i.e., summer) shall not be considered a part of the employee’s seniority or benefits for that time period. Hours worked in the employee’s permanent classification during any off-contract period (i.e., summer) shall be considered a part of the employee’s seniority and benefits on a pro rata basis.

A break in service is a separation or interruption of employment without pay of more than two (2) years. All part-time service shall be credited on a prorated basis. Periods of authorized leave without pay will be deducted from seniority calculations pursuant to the definition of seniority in Article 7 –
Seniority Computation. Within the bargaining unit, employees shall be laid off and service credits calculated within the following separate categories: Permanent full-time positions; and Permanent part- time positions. Computation of Service Credits for regular status employees shall be made as follows:
A. One (1) credit for each full month of unbroken, regular status and trial service employment with the State of Oregon. A break in service is defined as a separation or interruption of paid employment that lasts more than two (2) years. Part-time employees earn service credits on a prorated basis. Leave without pay over ninety (90) days will be deducted from service credits. When the Agency announces a layoff, service credit totals will be frozen through the conclusion of the layoff process.
B. In the event of a tie in total layoff credits, the Agency shall determine the employee(s) to be laid off, considering requirements of the available position(s), value of the employee(s) to the mission of the Agency, demonstrated performance, work in progress, and other relevant factors.
C. The Agency may protect up to two (2) employees from layoff for up to ninety (90) days if losing such individuals would demonstrably work a hardship on the operation of the Agency.
Seniority Computation. Approved extended leaves of absence or times when a Professional Employee is on a Professional Employee reduction shall not be considered as a break in seniority; however, the individual Professional Employee’s seniority shall be frozen at the level earned at the time the leave or reduction occurred.
