Seniority Status and Lists. 2.1 The right of promotion of employees in the various groups specified in the schedule of wages appended hereto and forming part of this Agreement shall extend over the entire Telecommunications system and shall be governed by merit, fitness, and ability. Where these are sufficient, the senior employee shall be given the preference.
Seniority Status and Lists. 11.1 Employees shall accumulate seniority from the date of last entry into the service on a position covered by this Agreement. Employees will remain on the seniority list providing they have performed some actual work for the Corporation within twenty-four (24) months from the first day of compensated service and any period of twenty-four (24) consecutive months thereafter or are on authorized leave of absence (i.e. illness, injury, Union leave, WCB and others); otherwise, the employee will forfeit his seniority, his name will be removed from the seniority list and his employment with the Corporation will be terminated. The period of twenty-four (24) months will commence after the weekly layoff benefits terminate. If the affected employee wishes to maintain his seniority they must so notify the Department Director, or his designate, in writing prior to the completion of the 24 month period. This period will be extended for a further 12 months. If no actual work is performed by the employee for the Corporation within the further 12 month period, the employee then will forfeit their seniority, their name will be removed from the seniority list and their employment with the Corporation will be terminated.

Seniority Status and Lists. 1.1 A complete list of all employees covered by this Agreement, showing name, seniority date, and ranking in each group in which an employee holds seniority shall be compiled at the beginning of each year. Such lists will be posted at the headquarters of employees concerned, and copies will be furnished the Local Chairman and General Chairman or designate. This list shall be open for correction for a period of 90 days and a seniority date not protested within 90 days from its first posting on the seniority list will be considered permanently established.

When proof of error is presented by an employee or his/her repre- sentative, such error will be corrected and when so corrected the agreed upon seniority date shall be final. No change shall be made in the existing status of an employee unless concurred in by the National Representative. No change shall be made in the seniority date accredited an employee which has appeared on two consecutive annual seniority lists, unless the senior- ity date appearing on such lists was protested in writing within the sixty day period allowed for correctional purposes. An employee who, while filling a position under this Schedule, is promoted to a position covered by another wage agreement, may continue to fill such position for a continuous period up to six months without loss of seniority, but must return to his/her former position at, or prior to, the expiration of such six months’ period, or forfeit his/her seniority rights under this Agreement, provided he/she can hold work in his/her own seniority group. The foregoing section shall not apply to an employee who, while holding seniority rights under another wage agreement, obtains employment and establishes seniority under this Schedule. If such an employee, while filling a position under this Schedule, exercises his/her seniority under the pro- visions of another wage agreement, his/her name will be dropped from the seniority list. An employee shall not be regarded as having exercised seniority rights when used for emergency service only.
