Seniority Status and Lists. 4.1 Seniority lists will be posted in the respective Seniority Groups in January of each year. Such lists will show names, positions, and dates of last entry into the service in positions covered by this Schedule (due regard being had to the provisions of Articles 7.9, 7.10 and 7.11) from which date seniority will accumulate. The name of an employee shall be placed on the seniority list immediately upon being employed on a position covered by this schedule. Copies of Seniority lists will be furnished to the Local President/Unit Chairperson.
4.2 An employee will be considered on probation until he/she has completed sixty (60) days of actual work in the service of the Railway. If found unsuitable during such period, such employee will not be retained in the service.
4.3 Protests in regard to seniority standing must be submitted in writing within sixty (60) days from the date seniority lists are posted. When proof of error is presented by an employee or his/her representative, such error will be corrected and when so corrected, the agreed upon seniority date shall be final. No change shall be made in the existing status of an employee unless concurred in writing by the Local President/Unit Chairperson.
4.4 No change shall be made in the seniority date accredited an employee which has appeared on two (2) consecutive annual seniority lists, unless the seniority date appearing on such lists was protested in writing within the sixty (60) day period allowed for correctional purposes.
4.5 An employee who, while filling a position under this Schedule, is promoted to a position covered by another wage agreement, may continue to fill such position for a continuous period of up to six (6) months without loss of seniority, but must return to his/her former position at, or prior to, the expiration of such six (6) months' period, or forfeit his/her seniority rights under this Agreement, provided he/she can hold work in his/her own seniority group.
4.6 The foregoing Section shall not apply to an employee who, while holding seniority rights under another wage agreement, obtains employment and establishes seniority under this Schedule. If such an employee, while filling a position under this Schedule, exercises his/her seniority under the provisions of another wage agreement, his/her name will be dropped from the seniority list. Seniority Status and Lists. 2.1 The right of promotion of employees in the various groups specified in the schedule of wages appended hereto and forming part of this Agreement shall extend over the entire Telecommunications system and shall be governed by merit, fitness, and ability. Where these are sufficient, the senior employee shall be given the preference.
(a) When an employee is offered an official or other position by the System not covered by this schedule, it is not obligatory upon him/her to accept. If he/she does so and an understanding is reached between him/her and the Vice-President Telecommunications Services, confirmed through the Chief Xxxxxxx, he/she may retain rights to the position previously held for a period of six months. If he/she remains in such official or other position beyond six months, his/her previous position will be bulletined at once, but he/she may retain his/her standing on the seniority list. A person released from an official or other position after the six-month period may only bid in vacancies occurring within the seniority group from which promoted or work spare.
(b) The assignment held by an employee granted leave of absence to act as full time representative of the employees will, subject to the approval of the President, be protected during period of such leave, but during this period the employee concerned will be allowed to bid on other positions.
(c) Effective July 1, 1999, when an employee is offered an official or other position by the System not covered by this schedule, it is not obligatory on him/her to accept. If he/she does so and an understanding is reached between him/her and the Vice President ONTERA, confirmed through the Chief Xxxxxxx, he/she may retain and continue to accumulate seniority for a period of one year. Seniority Status and Lists. 11.1 Employees shall accumulate seniority from the date of last entry into the service on a position covered by this Agreement.
11.2 A seniority list will be posted in each of the respective seniority regions in January of each year and copies will be furnished to the designated National or Regional Representative of the Union and Local Chairperson concerned. Such list will show names, date from which seniority will accumulate, and position symbols designating qualifications.
11.3 Employees will be considered as on probation until they have completed eighty (80) days of actual work in the service of the Corporation. The employees may be removed for cause, which in the opinion of the Corporation renders the employee unsuitable for its service during such period or extended period. Probationary employees shall have access to the grievance procedure.
11.4 Protests in regard to seniority status must be submitted in writing within 60 calendar days from the date seniority lists are posted. When proof of error is presented by employees or their representative, such error will be corrected and when so corrected, the agreed upon seniority date shall be final. No change shall be made in the existing seniority status of employees unless concurred in by the designated National or Regional Representative of the Union. 11.5 When two or more employees commence work on the same day, the procedure for establishing their relative seniority shall be as follows:
(a) When the employees commenced work at the same hour, the order in which employees were scheduled for the interview will determine the seniority order. The National or Regional representative shall, upon request, be furnished with the time and date of such interview. The information will be placed on the employee’s file.
(b) All other things being equal they shall be placed on the seniority list as mutually agreed between the proper officer of the Corporation and the designated National or Regional representative of the Union seniority list as provided for above.

1.2 Except as provided in Article 1.3, seniority of an employee promoted to a higher classification is established only at the time he/she is assigned by bulletin to a permanent position in such higher classification and shall begin on the specified closing date of the bulletin advertising the position. When two or more employees are promoted to a higher classification on the same bulletin, their relative rank in the lower classification shall govern their rank in the higher classification.

1.4(a) Not less than ten working days' advance notice will be given when regularly assigned positions are to be abolished except in the event of a strike or a work stoppage by employees in the railway industry, in which case, a shorter notice may be given.
