TIME OFF FOR UNION REPRESENTATIVES. UFLAC may designate up to four board members to take full time off to conduct Union business. The parties acknowledge that board members so assigned are exempt from Fair Labor Standards Act overtime provisions due to the executive and administrative nature of their assignment. Board members so designated shall not be required to perform any other duties for the Los Angeles Fire Department. UFLAC shall pay the City each month 130% of the salary of Union board members taking such time off, except such time off taken pursuant to provisions of State or City law or under other provisions of the MOU. In addition to the above, UFLAC board members shall be allowed to take time off, in hourly increments, to conduct Union business. XXXXX acknowledges that any such work is not to be considered hours of work for the City. Such time off may not exceed an aggregate total of 5,000 hours annually. UFLAC will select and provide a rank for rank replacement, to the extent possible, for all Platoon Duty board members taking such time off outside of Scheduled Overtime Duty (SOD) procedures. If no replacement is provided, no time off shall be allowed. UFLAC shall pay the City 135% of the salary rate of the replacement. Special Duty board members shall be allowed to take time off in hourly increments to conduct Union business subject to the operational needs of the Department. UFLAC shall pay the City the straight time salary rate of the Special Duty board member. The provisions of this paragraph shall not apply to such time taken off pursuant to provisions of State or City law or under other provisions of the MOU. Permission for time off must be arranged at least 72 hours in advance; however, time off may be granted without this advance notice under circumstances which could not be anticipated, subject to the approval of the Fire Chief. Payment shall be made to the City monthly. The failure of the City to receive reimbursement as stated above, within 45 days of the monthly due date, shall result in the immediate cessation of obligations under this Article and the immediate reassignment of the board members to regular duties for their class and pay level. At the time such payment is received, the obligations under this Article will become fully operative. TIME OFF FOR UNION REPRESENTATIVES. The parties recognize that it is in their interest to maintain and develop a labour-management partnership. (a) The function of bargaining agent president can require a rearrangement of one’s work schedule. To this effect, the employee occupying this function must inform his or her supervisor and obtain the permission of his or her immediate supervisor before leaving his or her work. (b) A union representative appointed in accordance with Article 10 shall obtain the permission of his or her immediate supervisor before leaving his or her work to investigate employee complaints of an urgent nature, to meet with local management for the purpose of discussing such complaints or problems directly related to employment and to attend meetings called by management. Such permission shall not be unreasonably withheld.

(3) Union Representatives in the organisation and employee members of the companies’ management bodies shall be granted time off with pay for up to 12 working days per annum to participate in courses and conferences for Union Representatives arranged by the Confederation of Vocational Unions (YS) or the Finance Sector Union of Norway with contents as mentioned in Clause 19-1 no. 2 and for meetings convened by the Boards in the regional branches. The quota of 12 working days can be taken as full- or half-days, or subject to further agreement in the company, for example, on an hourly basis. (4) Board members in the regional branches of the Union shall have the same right to time off with pay for up to 12 working days per annum. For these members, the time off may also be used for participation in Board meetings in the regional branches of the Union. (5) Union Representatives who are also Board members in the regional branches of the Union shall be entitled to the necessary time off with pay in excess of 12 working days per annum. This shall be agreed in the individual company and must not constitute more than a total of 15 working days per annum. (6) Union Representatives who are also managers of regional branches of the Union shall also be entitled to the necessary time off with pay in excess of 12 working days per annum. This shall be agreed in the individual company and must not exceed a total of 18 working days per annum. (7) Any necessary time needed for travel during working hours due to a long distance to the regional branch of the Union where the meeting of the regional board is to be held shall be added to the 12, 15 or 18 working days per annum stated in nos. 4, 5 and 6. (8) The centrally appointed course instructors on the union’s basic organisational course shall have the same right to time off with pay for up to 12 working days per annum. TIME OFF FOR UNION REPRESENTATIVES. (a) A Union representative shall obtain the permission of their immediate supervisor before leaving work to investigate a grievance, to meet with local management for the purpose of dealing with grievances and to attend meetings called by management. Such permission shall not be unreasonably denied. (b) The Union representative shall make every reasonable effort to report back to their supervisor before resuming normal duties. (c) Where an employee and the employee’s Union representative are involved in the process of a grievance, they shall be granted time off with pay.
TIME OFF FOR UNION REPRESENTATIVES. 6.01 Local Union Representatives may investigate and settle grievances, attend joint Company and Union committee meetings or attend to other business of the Union pertaining to the affairs of the Company during working hours for a reasonable length of time, provided however, that arrangements are made with the supervisor(s), subject to service requirements. All time granted accordingly, shall be reported as Union Leave (UL) and paid for by the Company. 6.02 Employees shall be allowed time off to attend to other business of the Union, including necessary travelling time. This will be subject to service requirements and management approval. The Union must notify the Employer stating purpose, name(s) of employee(s) and the time required. Where possible, notification will be given five (5) weeks prior to the days off required. All time granted for this purpose shall be billed to the Union.

TIME OFF FOR UNION REPRESENTATIVES a) The Employer will grant leave without pay to one (1) employee representing the ATU before a Conciliation Board or before an Arbitration Board. Where operational requirements permit, the Employer will grant leave without pay to any additional employee called as a witness before a Conciliation Board or an Arbitration Board. b) When an employee and his/her representative are involved in the process of his/her grievance, he/she and his/her representative shall be granted the necessary time off from work with pay to attend the hearings at the various steps of the grievance procedure. These hearings, after step one, will be held at such times as are mutually agreeable to the parties. c) The Employer will grant leave without pay to an employee who exercises the authority of a Union Executive, on behalf of the Local, to undertake training, related to the duties of his/her position. This shall not create unnecessary overtime. d) The Employer will grant leave without pay to a Union Representative to attend official meetings of the Local or its administration. e) Any employee elected to a full-time office or position in the Union or any other body with which the Union is affiliated shall, upon written application to the Manager, Human Resources, be granted leave of absence without pay and shall accrue seniority and service for the duration of the period he/she is so acting. Upon retirement from said office, the employee shall be reinstated in his or her former employment, provided the employee is qualified, after having received the normal training required to fill such a position at the time of reinstatement. All pension and benefit packages shall remain in effect with all costs paid by the employee and/or union.
