Union Dues Remittance. The Employer shall deduct an amount equivalent to regular monthly union dues and initiation fees for the term of this Agreement according to the following conditions: (a) All Employees covered by this Agreement shall, as a condition of employment, have deducted from their pay each month an amount equivalent to the regular monthly union dues. (b) New Employees covered by this Agreement shall, as a condition of employment pay an initiation fee and have deducted from their pay each month an amount equivalent to the regular monthly union dues. (c) Union dues will be deducted from the employee’s pay twice a calendar month and the same shall be remitted by the employer to the Secretary-Treasurer of the Local Union not later than two weeks following the deductions. The Union agrees to keep the Employer harmless and indemnified from any claim against it by an employee which arises out of any deduction under this Article. (d) The Employer, when forwarding union dues, will submit a list, indicating the names of those Employees for whom deductions have been made as well as the names and dates of hire of those Employees hired in the preceding month. (e) Union language to be provided to account for CAW change in dues for part-time staff. (f) Any Employees working less than forty (40) hours in a month - due to injury, illness, unpaid leave of absence or layoff, shall be exempted from payment of dues. The Union takes full responsibility for any refunds within these circumstances. (g) New Employees shall pay an initiation fee of Twenty ($20.00) Dollars in addition to their first month’s regular dues. (h) Union dues deductions must be made from the Employees on vacation. (i) When submitting the dues, list beside each Employee whether they are: full-time, part-time, probationary, on sick leave, compensation, maternity leave, parental leave, leave of absence, laid off, resigned, terminated or on vacation. (j) In the case of a new Employee’s first remittance, a notation of “Initiation Included” shall be listed beside their name. (k) The dues formula is based on the CAW - Canada Constitution.

A Xxxxxx will not be scheduled independently of a Greeter/Seater or a grandfathered Host. The classification of Service Assistant will be deleted. Existing employees will be reclassified into the Greeter/Seater and Xxxxxx classifications. No employee will receive a lesser wage than he/she is currently receiving as a result of this reclassification, and all employees will receive the agreed upon increases for non gratuity employees for the duration of the collective agreement. Employees currently in the Host category will maintain their classification and rate (and will continue to progress through the wage scale in place prior to ratification) and in addition will receive all negotiated percentage increases for non gratuity employees for the duration of the collective agreement. No new employees will be hired into the category. Note: The Employer has reviewed the employee lists to determine which employees are to be classified as Bussers upon ratification of this agreement. The Company shall also provide to the new Employee for signing, a package of documents for the purpose of becoming a Union member and signing an authorization card, authorizing the Company to deduct from earnings Union initiation fees, Union dues and/or other charges as levied against by the Union. After the documents are signed, the Company shall forward those documents to the Union within working days of them being signed. The new employee shall appear on the monthly check-off list as provided by the Company to the Union. The Company will include all union dues, fees and assessments deducted in the calendar year for all employees as set out above on slips issued by the Company. The Company will distribute Union dues receipt issued from the Local Union for all Owner Operators at the end-of each year through the payroll department. Collective Agreement between and CAW a) Every employee and owner operator of the Company covered by this Agreement shall be a member of the Union in good standing as a condition of employment with the Company. When additional employees and owner operators are required, the Company shall give the Union first opportunity to refer suitable CAW members for employment. In the event that a person who is not a member of the Union is hired by the Company, that person shall join the Union within three (3) days of hiring. The Company shall provide to the Union a list of new employees and owner operators hired by the Company within one (1) day of their hire date.
