WORK FORCE REDUCTION. SECTION 1 – Layoffs (A) When employees are to be laid off, the state shall implement such layoff in the following manner: (1) The competitive area within which layoffs will be affected shall be defined as statewide within each agency. (2) Layoff shall be by occupational level within the Law Enforcement bargaining unit. (3) An employee who has not attained permanent status in his current position may be laid off without applying the provision for retention rights. (4) No employee with permanent status in his current position shall be laid off while an employee who does not hold permanent status in his current position is serving in that broadband level unless the permanent employee does not elect to exercise his retention rights or does not meet the selective competition criteria. (5) All employees who have permanent status in their current position shall be ranked on a layoff list based on the total retention points derived as follows: (a) Length of service retention points shall be based on one point for each month of continuous service in a Career Service position. (1) An employee who resigns from one Career Service position to accept employment in another Career Service position is not considered to have a break in service. (2) An employee who has been laid off and is reemployed within one year from the date of the layoff shall not be considered to have a break in service. (3) Moving from Career Service to Selected Exempt Service or Senior Management Service and back to Career Service does not constitute a break in service unless the employee’s break in service is more than 31 calendar days. Only time spent in the Career Service can be counted in calculating retention points. (b) Retention points deducted for performance not meeting performance standards or work expectations defined for the position shall be based on the five years immediately prior to the agency’s established cutoff date. Five points shall be deducted for each month an employee has a rating below performance expectations. (6) The layoff list shall be prepared by totaling retention points. Employees eligible for veterans’ preference pursuant to section 295.07(1)(a) or (b), F.S., shall have fifteen percent added to their total retention points, those eligible pursuant to section 295.07(1)(c), (d), or (e), F.S., shall have ten percent added to their total retention points, and those eligible pursuant to section 295.071(1)(f), or (g), F.S., shall have five percent added to their total rete...

WORK FORCE REDUCTION. The Medical Center retains the right to determine whether a permanent or prolonged reduction in personnel is necessary, the timing of such reduction in personnel, the number of FTEs to be eliminated, and in which seniority pool(s) layoffs will be effected. The parties further agree:
WORK FORCE REDUCTION. Permanent employees who are removed from their permanent positions or are laid off as a result of the elimination of permanent positions shall receive appropriate notice. When permanent full-time positions are to be reduced, the full-time employee with the least bargaining unit seniority in the job level to be affected within the unit reporting to a Director or organizational equivalent will be the first removed. When permanent part-time positions are to be reduced, the part-time employee with the least bargaining unit seniority in the job level to be affected within the unit reporting to a Director or organizational equivalent will be the first removed.
WORK FORCE REDUCTION. (A) Seniority shall be defined as the total length of continuous full-time service in classification with UPD. Seniority shall continue to accrue during all types of compensable leave approved by the University. Approved leaves of absence without pay shall not count towards the accrual of seniority. Probationary employees are excluded toward the accrual of seniority until such time as the employee satisfactorily completes probation; once completed, seniority will accrue from the date of continuous service in the classification. (B) Employees shall lose their seniority as a result of the following:
WORK FORCE REDUCTION. Whenever it becomes necessary due to lack of work or funds to reduce the size of the work force in any class of positions covered by this Agreement, the Fire Chief shall designate the number of positions from each class which shall be eliminated. The employee(s) to be laid off shall be determined by inverse classification seniority. All temporary and provisional appointees in that class shall in all cases be laid off first. For the purpose of this subsection, persons appointed to the same class on the same date shall be considered to have seniority in the order on which they appeared on the certification. When the number of employees in a class above Firefighter is to be reduced, affected employees in such higher classes who have held lower titles within this bargaining unit shall be entitled to a reduction to the highest of these titles to which classification seniority in such lower title (which includes time served in a higher title) would keep them from being laid off. 10.4 (1) In the event of a work force reduction in the department that affects members of the Fire Supervisory Association, Local 3939, and when such affected employees have held lower titles within this bargaining unit, such employees shall be offered reductions to the highest of these titles to which classification seniority would keep them from being laid off. Except as expressly provided herein, Civil Service Rule 22 (entitled “Layoff”) and Civil Service Rule 23 (entitled “Reinstatement”) shall continue to apply with regard to employees impacted by the application of this Section 10.4. Notwithstanding the foregoing, Department seniority shall continue to be used for the purposes of bidding for positions and vacations within a job classification.
WORK FORCE REDUCTION. 28.01 The Employer agrees that prior to any major reductions of hours or any reduction of the workforce, it will discuss the matter with the Union with a view to minimizing the negative impact on current employees.
WORK FORCE REDUCTION. In the event of a reduction in the department work force, such reduction shall occur in accordance with Section 22 of the Civil Service Rules as of the date of the signing of this Agreement.

WORK FORCE REDUCTION i) A permanent employee declared surplus as the result of a work force reduction may elect to claim the job held by the employee with the least seniority in the bargaining unit, provided the surplus employee has greater seniority and the qualification, ability, training, experience and physical capacity to perform the job being claimed. ii) A permanent employee who declines or is not qualified to exercise the above right or, who is being bumped, and is not qualified to exercise this right, shall be laid off to await recall as provided in this agreement.

If a former employee is notified by Certified Mail, return receipt requested at his or her last known address to return to work and fails to notify the Company within five (5) days after receipt of the letter from the Company of his or her desire to return, or fails to return for duty within twenty (20) days from the original date if such notice, he or she shall lose his or her seniority and the Company will be relieved of any obligation to again offer him or her re-employment. SECTION 3. When an employee is furloughed by the Company due to a reduction in force he or she shall be given two (2) weeks’ notice of furlough, or failing such notice or any part thereof, he or she shall be paid for the said two (2) weeks period or the part thereof for which he or she was not notified; provided that such two (2) weeks’ notice or pay shall not apply to discharges or suspensions for cause or for Leave of Absence or resignations requested by the employee, or employees retiring. When the number of employees in a higher title is to be reduced, employees who have held lower titles within this bargaining unit will be offered reductions to the highest of these titles to which department seniority would keep them from being laid off. (1) In the event of a work force reduction in the department that affects members of the Fire Supervisory Association, Local 3939, and when such affected employees have held lower titles within this bargaining unit, such employees shall be offered reductions to the highest of these titles to which department seniority would keep them from being laid off.
