ASSIGNMENT, TRANSFER AND VACANCIES. The employment, assignment and direction and management of all employees of the District is the exclusive right and responsibility of the Board of Directors of the District. The District will have the right to hire, assign and transfer the personnel of the District to meet the educational program and needs of the District. To assure that employees are given every consideration in filling any vacancies which may occur at any time within the District, these vacancies and new positions will be publicized to the staff and Association through an electronic notice or reference to an on-line job posting as far in advance of the date of the opening of any vacancy or new position as possible. Employees will be notified of vacancies which occur during summer break via District email. If an alternate email address is preferred, the employee will provide it to the Superintendent’s secretary by the last day of school. For this section, vacancies mean newly created or recently vacated positions, after in building transfers are completed.
A. When an involuntary transfer or reassignment is necessary due to changes in staffing, enrollment, adjustment of master schedule (secondary schools) or other changing building needs, the following provisions will apply:
1. A list of qualified candidates based on certification, major or minor field of study, length of service within the District, length of service in the building, grade or subject from which transfer or reassignment is contemplated will be provided to the Association. Other relevant factors, including legal certification requirements and/or most recent summative evaluation, will be considered in determining which employee is to be transferred or reassigned.
2. The building administrator will notify building staff that a position will need to be reduced, and ask for voluntary transfers from qualified candidates.
3. The employee will be notified as soon as possible, when feasible, no later than one week prior to the first contracted/pre-service work day of the employee’s new assignment. Such notification will be made in writing and will include the reason for the transfer, the position, building, grade level, subject, program, or course and other pertinent information including a statement of employee rights/options, concerning the assignment.
4. An employee who is involuntarily transferred will have the first right of return to his/her previous position, if it becomes available prior to the first student day.

ASSIGNMENT, TRANSFER AND VACANCIES. A. Definition of Terms
1. A vacancy is a position which has been permanently vacated or one which has been newly created.
2. An assignment shall mean the placement of an individual in a particular grade level, subject area, or District program.
3. An involuntary transfer is an administratively initiated change in assignment in the same or different building.
4. Seniority is defined in Article III, Section 1.
5. A voluntary transfer request is one initiated by the employee for a change in assignment in the same or different building. This written request can be made to the Building Principal or Superintendent.
B. To assure that pupils are taught by teachers working within their areas of competence, teachers shall not be assigned, except in accordance with the regulations of the State Board of Education, to subjects, grades and/or other classes outside their teaching certificates and/or their major or minor fields of study or qualifications in specialty areas. Teachers shall be notified in writing no later than June 30 of any tentative changes in their programs and schedules for the ensuing school year, including teaching assignments. Tentative assignment may be changed after June 30 for good cause. Employees shall be notified as far in advance as possible of the assignment change.
C. In determination of assignments and transfers, the convenience and work of the teacher shall be considered to the extent that these considerations do not conflict with the educational program. Certificated employees will be assigned on the basis of their qualifications, the needs of the District and their expressed desires. When it is not possible to meet all these conditions, personnel shall be assigned first in accordance with the needs of the District, and second, in accordance to the expressed preferences of the employee. A transferred staff member will be required to use, in combination, two (2) sub days / sixteen (16) hours of paid District work for instructional purposes.

In case of a layoff, employees laid off in one classification will be able to bump into a prior classification in which they hold seniority. The employee retains their seniority in the former classification for two (2) years.

B. To assure that employees are given every consideration in filling any vacancies or newly created positions which occur at any time within the Districts, the following procedure shall be used:
1. All vacancies and new positions shall be publicized to the staff and Association through a written notice that shall be distributed to each employee as far in advance of the date of the opening of any vacancy or new position.
2. Said notice of vacancy or new position shall clearly set forth the qualifications for the position and procedures for applying.
3. All vacancies or new positions shall be filled by the best qualified employee based upon stated objective criteria described in the posting.
4. The Districts shall make all possible effort to fill vacancies and new positions with their present employees before out-of-district hiring or contracting can occur.
ASSIGNMENT, TRANSFER AND VACANCIES. To assure that pupils are taught by employees working within their areas of competence, employees shall be assigned in accordance with state law or state administrative regulations. The District shall notify employees, in writing, NO LATER THAN June 1 of any changes in their programs and schedules for the ensuing school year, including general teaching areas and any special assignments. Where assignment or reassignment becomes necessary after June 1, the affected employee shall be notified, in writing, as soon as possible of the assignment or reassignment. Any vacated or newly created position will be posted throughout the District, except that a vacancy created as a result of a transfer, need not be announced. A new position is not created when a classroom unit is transferred from one building to another building. The District may still transfer personnel at the start of school, if needed. If an employee is involuntarily transferred or if an employee is transferred to a new building after the school year begins, s/he will be granted one (1) preparation day and up to one (1) per diem day of pay to move and prepare for the new assignment. The preparation day may be used to hire a substitute or the employee may request a day of pay at the sub rate. In the event of a classroom reassignment less than three (3) work days prior to the first student day of the year, the district will provide classified staff to assist with the physical move and the technology change orders that are necessary. Transferred employees will be provided assistance with moving instructional materials from one location to another. Materials must be boxed and secured by the employee. Delivery directions will be placed on the outside of the container. The following procedures shall be used in the assignment and transfer of certificated employees:

1. Teacher Certification/Endorsement
2. Time in District
3. Time in State
4. If all things are equal, ties will be determined by lot In order to maintain an accurate Certificated Employment List, the district will provide a form based on the above criteria. This list will be provided to the staff by November 1 of each year. Staff will verify the accuracy of the information by signing the document in the space provided and return the document within 15 days. If the accuracy is incorrect, it is the employees’ responsibility to notify the district office.
ASSIGNMENT, TRANSFER AND VACANCIES. 1. Certificated employees shall not be assigned, except in accordance with the regulations of the State Board of Education. In the event it becomes necessary to assign a certificated employee outside his or her major or minor or endorsement field, the District shall do so in consultation with the employee involved. Certificated employees shall be notified in writing of any changes in their programs and schedules for the ensuing year, including the schools to which they will be assigned, the grades and/or subjects that they will teach on or before the last week of school if possible.
2. In order to assure that certificated employees, currently employed, are given consideration in filling vacancies, the following procedures will be used:
a. Certificated employees who desire a transfer or reassignment shall complete a request form no later than April 1. Such requests will be kept on file until the first day of the ensuing school year.
b. No employment of any new certificated employee for a specific position shall be made until all pending requests for transfer of assignment have been given consideration.
c. Notice of vacancies and new positions will be posted within the district for five working days. A copy of the job posting will be sent to the Association President and placed in the faculty room and administration offices of each building.
d. In the event vacancies arise between school terms (summer), the District will send a written notification to all certificated employees who have complied with paragraph a. contained herein above. Applications will be submitted to the District within seven (7) working days.
e. The filling of such vacancies or new positions shall be determined on the basis of requirements for the position with the Board of Directors making the final determination.
f. As soon as practicable, the superintendent or principal will notify in writing each certificated employee of his transfer. In the event a certificated employee was not granted the transfer, he/she may make an appointment with the superintendent or principal if they desire. Upon request by the teacher to the superintendent, a written explanation will be granted.
