Leave for Union Service. Teachers not in excess of four (4) who are officers of the Union or who are appointed to its staff may seek and shall be granted leaves of absence up to one (1) year, respectively, without pay for the purpose of performing legitimate duties for the Union. The President of the Union shall have a morning teaching program equivalent to three-fifths (3/5) of a regular teacher’s program and shall be relieved of all non-teaching duties without loss of pay and with full service credit as outlined in Section 5-5 for the purpose of conducting labor-management activities. A substitute teacher will be provided whenever the Union President is not present during the school day.

Leave for Union Service. Where a question of seniority is a factor in a dispute, the seniority of the teachers involved shall be made available to them and to the Union.

No more than eighteen (18) workdays per school year shall be used for such purpose under the following conditions: 1. No less than one (1) workday may be taken at any one time. 2. No more than two (2) employees shall be absent from any single worksite at the same time, provided the employees are not in the same job classification. 3. The cost of substitute(s) incurred as a result of such leave shall be at the expense of the Union. 4. No more than four (4) days’ notice shall be required for such leave application. 5. No more than eight (8) days of such leave shall be taken by any one employee during any given school year.

Upon returning to work from leave without pay, upon request, the teacher shall be placed in the same assignment the teacher held prior to taking leave of absence if the appropriate vacancy exists or if a similar vacancy in the same building or another building exists. E. The teacher taking leave of absence for Union service shall not lose professional nor financial status, including salary schedule advancement and seniority for a period not to exceed three (3) years while the teacher is working on behalf of the bargaining unit. 1. Nothing in this paragraph shall be construed to grant tenure to a teacher otherwise ineligible to attain tenure under Section 115 of the School Laws of Oklahoma, 2002. F. Cumulative leave time will not accrue nor will accumulated leave time be lost.
Leave for Union Service a) Upon written notice from the Union, the University grants leave without pay, to not more than one (1) permanent full-time employee for union service either as an employee or in an elected position within the Confederation des Syndicats Nationaux (CSN) or one of its affiliated bodies. b) The notice carries the name of the employee, the nature and length of the absence and must be forwarded to Employee Relations, as a rule, thirty (30) days prior to the absence. c) The University agrees to grant the leave without pay unless, due to exceptional circumstances, it would be impossible to do so without seriously affecting the normal operations of the sector where the employee concerned works. d) If the employee who is granted leave holds a non-elective position, he/she must return to work within the twenty-four (24) months following the beginning of his/her leave. e) If the employee on such leave holds an elective position, he/she receives a leave without pay equal in length to his/her term of office; this leave without pay may be renewed once, for a total of two (2) terms in the event of a re-election. f) An employee on such leave does not have a right to the benefits of this agreement except the pension plan and the group insurance plan to the extent such plans allow. In such an event, the cost of the premiums will be paid entirely by the employee. g) The employee granted such leave must give the University a written notice of his/her intent either to return to work or to stand for re-election at least thirty (30) days before the end of his/her employment or first term of office. Upon his/her failure to return to work at the end of the employment or the term of office provided for in subsections 11.11 (d) and (e), he/she is deemed to have resigned at the beginning of his/her leave, except for the insurance and pension plans. h) Upon his/her return to work, the University reinstates the employee into the position he/she occupied at the moment of his/her departure. If his/her position has been abolished, the procedures outlined in Articles 14 and 15 apply. The employee will receive the salary progression that she or he would have been entitled to during the leave. i) The employee granted leave by virtue of the present clause will continue to accumulate seniority for the maximum period of time provided for in subsections d) and e). Thereafter, seniority does not accumulate but is maintained.

Leave of absence without pay shall be granted by the Newark Public Schools to members of the bargaining unit upon their personal request and that of CASA in order to work for CASA or for one of its parent organizations. No more than two (2) such leaves of absence shall be granted at any one time. Such leaves shall be granted for a period of not more than one academic year and shall be renewed upon request of the employee and by certification of CASA. 2. When an individual granted such leave of absence returns to regular employment with the District, he/she shall be placed at the step of the salary schedule that he/she would have attained had he/she been continually employed during such absence. There shall be no loss of seniority earned as of the date of the commencement of the leave or any other right avail- able to him/her under the law or the terms of this agreement because of such leave of absence. The period of leave shall not be included in computing length of service for the time required to attain tenure. 3. Any employee granted such leave of absence shall have the right to have maintained on the same basis as all employees his participation in any employee welfare plans available to District employees for hospital costs, medical-surgical benefits, major medical insurance, or any other such benefits upon regular payment on his behalf to the office of the Executive Controller of amounts sufficient to cover the cost to the Newark Public Schools for continued participation in such employee welfare plans, provided the District insurers will permit it.

Leave for Union Service. Upon request of the Union, and consistent with operational needs, the Employer will grant leaves of absence without pay to bargaining unit employees for up to thirty (30) days. Consecutive thirty day leaves of absence may be requested by the Union and granted by the Employer, not to exceed 120 days total for any one employee per calendar year. The employee shall be returned to his/her previous position, facility, and shift subject to post rotation provisions. In order to not disrupt KPERs contributions and requirements, an employee on consecutive leaves of absence for Union Service shall return to work at least one (1) day per each thirty day interval, on a date or dates agreed to prior to beginning Leave for Union Service. The employee’s benefits (workers compensation, medical/dental insurance, if participating, etc.) shall continue to be paid by the Employer and the Union shall reimburse the Employer for all costs of benefits except that the employee or the Union shall continue to be responsible for paying the employee’s share of the health insurance premium. For the purposes of this Section benefits do not include optional payroll deductions. Leave without pay for Union Service in accordance with this section shall not be considered an interruption in Length of Service.
