PROFESSIONAL QUALIFICATION AND ASSIGNMENTS. 11.01 Both the Board and the Association agree to the importance of having a properly certified or licensed (where applicable) teacher with a minimum of a Bachelor’s degree and educational training preferred. The Board will attempt to contract only teachers who have a degree or degrees from an accredited college or university and those individuals who also meet the minimum Michigan Certificate Code requirements, or appropriate Michigan licensing requirements where a teaching certificate is not required. Teachers in reimbursed vocationally certified programs must hold a valid vocational certificate in their specialized areas. If teachers in reimbursed vocationally certified programs do not hold vocational certification as required, said teachers will be encouraged to apply for or renew vocational certification and/or may be subject to transfer to maximize the district’s ability to obtain reimbursement. 11.02 Those teachers for whom special permits are being processed while they are waiting full certification from the State of Michigan, or teachers of vocational subjects who possess a vocational certificate or permit are excluded from the provision of Sections 11.01 and 11.02 of this Article. 11.03 The Association recognizes that each teacher must assume the responsibility of filing his/her valid Michigan teaching certificate or other documents indicating same with the Department of Human Resources by July 1. Each teacher must file with the Department of Human Resources a valid Michigan teaching certificate/license and a transcript of credits. 11.04 The responsibility for being certified to teach in the Rochester Community Schools rests solely with the individual teacher. The Board will continue its present practice of informing the teachers of this responsibility and the manner in which it may be fulfilled. Teacher proof of certification must be on file by July 1. The Department of Human Resources will work in partnership with the Association to notify any teacher who does not have proof of certification on file. PROFESSIONAL QUALIFICATION AND ASSIGNMENTS. 7.1 Teachers hired on a probationary or tenure basis shall either possess or be qualified for a minimum of a State Provisional Certificate and also meet other requirements of the laws of the State of Michigan. The Board will hire certified teachers with a minimum of a bachelor’s degree and possessing a provisional, permanent or continuing certificate. The responsibility for being properly certificated to teach in the school district rests solely with the individual teacher. The Board agrees that teachers employed by the Board, who hold annual authorizations, shall as a condition of employment make every attempt to obtain permanent status through recognized work and/or study programs as per MCL 380.1233. 7.2 The employment of teachers based on special certificates is to be permitted only in cases of absolute necessity. The Association shall be so notified in each instance and the Board shall indicate the extent to which they endeavored to fill the position with a fully certificated person. 7.3 The Superintendent may request that a teacher enroll in specific credit courses so that the teacher might fill certain academic or professional voids and so that he/she may achieve preparation standards, which are mandated by curriculum revisions, or applicable accreditation standards. Should the teacher be unwilling or unable to accommodate such a request to the extent of completing the equivalent of up to six (6) semester hours per year and the want of the indicated improvement prohibits the initiation or continuance of a desired curriculum or accreditation, then the teacher may be reassigned (accommodating his/her desires as nearly as possible) in order that the objective will be gained. Teachers complying with such requests shall be reimbursed for Teacher Certification Tests, tuition, books and necessary travel incurred by enrollment in such classes. When a school vehicle is not available, mileage will be paid pursuant to the published IRS rate per mile for actual mileage driven or as agreed to with the teacher.

Since pupils are entitled to be taught by teachers who are working within their areas of competence, teachers will not be assigned, except temporarily and for good cause, outside the scope of their teaching certificates or their major or minor fields of study. 11.04. Elementary teachers will receive a tentative assignment for the forthcoming school year prior to the first day of June. Secondary teachers will receive their tentative assignment and schedule for the forthcoming year prior to the first day of June. If an elementary or secondary teacher does not have his/her tentative assignment by June 1, he/she should ask his/her immediate supervisor for the tentative assignment. Whenever a change in a tentative assignment is necessary, the teacher will be notified and the assignments discussed as soon as possible. 11.05. PROFESSIONAL QUALIFICATION AND ASSIGNMENTS. A. Any educator whose assignment is changed shall also be notified in writing as to the specific reasons for the change. Such reasons shall not be grievable. B. An educator shall be given written notice of his/her assignments for the forthcoming year no later than sixty (60) calendar days preceding the first day of the new school term. In the event changes in such assignments are required, the educator affected shall be notified and consulted promptly whenever possible. In no event shall changes in the educators’ assignments be made later than forty five (45) calendar days preceding the commencement of the next school term unless an unexpected vacancy or need occurs. C. In filling positions for summer school programs, first consideration will be given to educators who have been employed in the district for a minimum of three years and who currently teach the subject area to be staffed. No educator whose most recent summative evaluation rating was “Needs Improvement” or “Unsatisfactory”, or who has been the subject of any discipline action within the previous school year will be considered for a summer school position. Summer school assignments will be rotated from year to year among staff meeting these qualifications. In the event that no applicant meets these qualifications, the position(s) will be opened to all staff members who are licensed to teach the subject but may not currently be teaching the particular subject. This paragraph should not be construed to require the Board to conduct a summer school program, and no other provision of the Agreement shall be applicable to any summer program which may be held. D. Assignments involving after school programs or curriculum work which occur outside the normal school day and are over and above the preparation required for regular teaching assignments shall not be obligatory but shall be with the consent of the teacher. Preference in making such assignments shall be given to educators under this agreement over any district staff not covered in this agreement. No educator whose most recent summative evaluation rating was “Needs Improvement” or “Unsatisfactory”, or who has been the subject of any discipline action within the previous school year will be considered for these assignments. CONTRACTOR shall ensure that all staff are appropriately credentialed to provide instruction and services to students with the disabling conditions placed in their program/school through documentation provided to the CDE (5 CCR 3064 (a)).

  • Due Qualification and Good Standing The Borrower is in good standing in the State of Delaware.   • Arbitrator Qualifications and Powers Any arbitration proceeding in which the amount in controversy is $5,000,000.00 or less will be decided by a single arbitrator selected according to the Rules, and who shall not render an award of greater than $5,000,000.00. Any dispute in which the amount in controversy exceeds $5,000,000.00 shall be decided by majority vote of a panel of three arbitrators; provided however, that all three arbitrators must actively participate in all hearings and deliberations. The arbitrator will be a neutral attorney licensed in the State of California or a neutral retired judge of the state or federal judiciary of California, in either case with a minimum of ten years experience in the substantive law applicable to the subject matter of the dispute to be arbitrated. The arbitrator will determine whether or not an issue is arbitratable and will give effect to the statutes of limitation in determining any claim. In any arbitration proceeding the arbitrator will decide (by documents only or with a hearing at the arbitrator’s discretion) any pre-hearing motions which are similar to motions to dismiss for failure to state a claim or motions for summary adjudication. The arbitrator shall resolve all disputes in accordance with the substantive law of California and may grant any remedy or relief that a court of such state could order or grant within the scope hereof and such ancillary relief as is necessary to make effective any award. The arbitrator shall also have the power to award recovery of all costs and fees, to impose sanctions and to take such other action as the arbitrator deems necessary to the same extent a judge could pursuant to the Federal Rules of Civil Procedure, the California Rules of Civil Procedure or other applicable law. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. The institution and maintenance of an action for judicial relief or pursuit of a provisional or ancillary remedy shall not constitute a waiver of the right of any party, including the plaintiff, to submit the controversy or claim to arbitration if any other party contests such action for judicial relief.

  • Incorporation, Good Standing, and Due Qualification Each of the Borrower and its Subsidiaries is duly incorporated, validly existing and in good standing under the laws of the jurisdiction of its incorporation, has the corporate power and authority to own its assets and to transact the business in which it is now engaged or proposed to be engaged, and is duly qualified as a foreign corporation and in good standing under the laws of each other jurisdiction in which such qualification is required.
