Site Safety and Security. Design/Builder shall take all reasonable steps and legally required measures at the site to comply with applicable safety regulations and standards and to adequately protect the Work, stored materials, and temporary structures located on the premises, and to prevent unauthorized persons from entering upon the site. Design/Builder shall at all times safeguard Owner’s property and employees from injury or loss in connection with the performance of the Agreement. Design/Builder shall at all times safeguard and protect its own partially or completely finished Work and that of the adjacent property and all adjacent work from damage. Design/Builder shall protect Owner’s equipment, apparatus, machinery, and other property and all adjacent work with boarding and other safeguards so as to keep the premises free from dampness, dirt, dust, or other damage and shall remove all such temporary protection upon completion of the Work. Design/Builder shall, upon execution of this Agreement, submit to Owner its Project Safety Manual, and shall operate in accordance with said Manual.

Site Safety and Security. Provider shall be solely responsible for compliance with all applicable occupational safety and health standards, rules, regulations and orders established by local agencies, the State of California, and Cal OSHA, including obtaining permits required by California Code of Regulations, Title 8, Section 341 and 341(a). In addition, Provider and all subcontractors shall comply with applicable provisions of Federal, State, and municipal safety, health, and sanitation statutes and codes. In the event there is a conflict between the provisions of the Safety and Health Regulations for Construction promulgated by the U.S. Department of Labor in Title 29 CFR Part 1926, OSHA, or Cal. OSHA, the more stringent provision shall prevail. District is designated a Cal STAR site due to their high level commitment to safety. Provider shall participate in all requirements to ensure that District remains eligible to be designated a Cal STAR site. Provider will develop a site-specific OSHA approved safety plan for the Site and submit it to District for review and approval prior to the start of construction. The Site Safety and Security Plan shall include an evaluation and appropriate documentation of the safety record for all subcontractors that will be performing work on the Project, a traffic control plan, and an Injury and Illness Prevention Program plan. The Site Safety and Security Plan shall also include the location of emergency utility shutoffs and an evacuation plan. A safety conference shall be scheduled prior to the start of construction to review the experience modification rating, the respective safety requirements, and to discuss implementation of all health and safety provisions related to the Project. Representatives from Provider, every subcontractor and District shall be present at the safety conference. No work shall be performed on the Project prior to written confirmation that District has accepted the Site Safety and Security Plan. Following the commencement of work on the Project, safety meetings will be held once a week with all Provider and subcontractors employees attending. Printed names will be taken of those attending the meeting. No individual will start work at the Site without having attended a safety briefing on the dangers and protocols of the Site. Site Safety and Security. 9.2.1 The Concessionaire will at all times throughout the Contract Period have full regard for the safety of all persons (including Users of the Concession Highway) on the Full Concession Area (whether lawfully or not) and will keep the Full Concession Area in a manner and in an orderly state that ensures the safety of such persons and that is appropriate to the avoidance of danger to such persons, notwithstanding that the Existing O&M Contractor will be responsible for the performance of certain operation and maintenance functions in connection with the Concession Highway during the period from the Commencement Date to the commencement of the O&M Period pursuant to the Existing O&M Contract and notwithstanding that the MOT Section Contractor will be carrying out the MOT Section Works pursuant to the MOT Section Contract. 9.2.2 Without limiting Section 10 [Security of the Site] or Section 30.3 [Conduct of Claims Against Third Parties], the Concessionaire will, in respect of the Full Concession Area at all times throughout the Contract Period, take such measures as are reasonably required, including fencing where appropriate, to prevent the trespass and access onto the Full Concession Area of any persons not entitled to be there or of any creatures including wildlife and livestock.

Site Safety and Security. The District may furnish shirts and a jacket for site safety and security personnel and require that they be worn during duty hours as it deems necessary for student and staff safety. Up to three (3) shirts shall be furnished per year on an as needed basis per the request of the employee with the approval of the site principal. The District shall provide new hires with five (5) shirts and one (1) jacket upon hire. A jacket shall be provided on an as needed basis but not more than one (1) every year. Site safety and security personnel shall wear the appropriate shirt during work hours, the type which will be determined by the District after consultation with the exclusive bargaining representative on any changes made.

(c) Project Co shall take action in accordance with Laws to remove forthwith from the Project Site any person who engages in misconduct or is incompetent or negligent in the performance of any duties, or whose presence on the Project Site is otherwise undesirable.
Site Safety and Security. The City has an existing security program, including cameras, key cards, and other features, provided and maintained by ADT. The existing security system, or an equivalent system shall be maintained, in service, by the Concessionaire. The Concessionaire shall be responsible for assessing and maintaining the adequacy of the security program in accordance with regulatory requirements and ANSI/AWWA Standard G430-09 – Security Practices for Operation and Management, whichever is more stringent. The Concessionaire shall notify the City as soon as practicable and necessary given the nature of the breach, but no later than 12 hours after becoming aware of any security breach. The Concessionaire shall also be responsible for notifying PADEP, as required, relative to any security breach. The Concessionaire shall submit a report to the City related to the results of investigation of any security breach. The Concessionaire shall take all precautions necessary to safeguard persons entering the facilities and to protect water quality and Water System properties. The Concessionaire shall develop and implement a Security Plan that will include, but not be limited to, the following goals: a. Prevent unauthorized entry; b. Prevent interference with treatment processes; c. Prevent injury to employees, visitors, or neighbors; and d. Prevent loss or damage to City property. Security policies incorporated into the Security Plan shall include, but not be limited to, the following features. a. External facility doors will be locked at all times. b. Entrance gates will be securely locked during non-business hours. c. Fencing and gates will be periodically inspected and maintenance performed as needed. d. Building entry and fire alarm systems will be routinely monitored, inspected, tested, and maintenance performed as needed. e. Appropriate identification and documentation of authorization of all persons accessing the facilities will be required. Trespassing will not be tolerated and shall be referred to local law enforcement agencies. The City will cooperate in the prosecution of any offenders. f. A record will be made in a logbook of all persons accessing the facilities. g. Employees will report all suspicious observations to site management. h. Daily and monthly facility security checks will be conducted as part of normal operational rounds and will be documented in logbooks. i. Site Safety and Security. The Architect shall be responsible for the safety and security of its own personnel and property and the personnel and property of the Design Consultants. The Architect and its Design Consultants shall exercise due care not to harm the personnel or property of others on or about the site of the Project. The Architect shall not, however, be responsible for the safety and security of the entire Project or all of the personnel and property on or about the Project. The Architect shall have the right to bring safety and security concerns to the attention of the CM and the Owner, and shall have the right to stop the Work to avoid an imminent threat to the health and safety of persons on the Project. Site Safety and Security. (a) CONTRACTOR shall take all necessary precautions and be solely responsible for project safety, property damage, injury, or loss with respect to scope of work covered by this agreement: all persons at the Project Site and all other persons who may be affected thereby; the Work and all materials and equipment incorporated therein and other property at the Project Site or adjacent thereto. CONTRACTOR shall be required to provide adequate training for all employees and subcontractor employees (or lower tier subcontractors employees) entering upon the site with respect to OSHA, NIOSH and/or other federal safety requirements, as well as COMPANY’s safety program requirements. Such safety training must take place prior to any employee or subcontractor employee (or lower tier subcontractor’s employees) entering upon the Project site. COMPANY, in its sole discretion, may require CONTRACTOR to remove any of its employees or subcontractors’ employees (or lower tier subcontractor’s employees) from the Project Site in the event COMPANY believes such employees or subcontractor employees (or lower tier subcontractors’ employees) have caused or are causing an unsafe work environment. (b) Upon notice of non-compliance with any of the site safety requirements, CONTRACTOR shall immediately cease the Work in the affected area and shall bear all costs until the unsafe conditions are corrected except to the extent caused by the negligence of the COMPANY.
