Site Safety and Security. Design/Builder shall take all reasonable steps and legally required measures at the site to comply with applicable safety regulations and standards and to adequately protect the Work, stored materials, and temporary structures located on the premises, and to prevent unauthorized persons from entering upon the site. Design/Builder shall at all times safeguard Owner’s property and employees from injury or loss in connection with the performance of the Agreement. Design/Builder shall at all times safeguard and protect its own partially or completely finished Work and that of the adjacent property and all adjacent work from damage. Design/Builder shall protect Owner’s equipment, apparatus, machinery, and other property and all adjacent work with boarding and other safeguards so as to keep the premises free from dampness, dirt, dust, or other damage and shall remove all such temporary protection upon completion of the Work. Design/Builder shall, upon execution of this Agreement, submit to Owner its Project Safety Manual, and shall operate in accordance with said Manual.

Site Safety and Security. Provider shall be solely responsible for compliance with all applicable occupational safety and health standards, rules, regulations and orders established by local agencies, the State of California, and Cal OSHA, including obtaining permits required by California Code of Regulations, Title 8, Section 341 and 341(a). In addition, Provider and all subcontractors shall comply with applicable provisions of Federal, State, and municipal safety, health, and sanitation statutes and codes. In the event there is a conflict between the provisions of the Safety and Health Regulations for Construction promulgated by the U.S. Department of Labor in Title 29 CFR Part 1926, OSHA, or Cal. OSHA, the more stringent provision shall prevail. District is designated a Cal STAR site due to their high level commitment to safety. Provider shall participate in all requirements to ensure that District remains eligible to be designated a Cal STAR site. Provider will develop a site-specific OSHA approved safety plan for the Site and submit it to District for review and approval prior to the start of construction. The Site Safety and Security Plan shall include an evaluation and appropriate documentation of the safety record for all subcontractors that will be performing work on the Project, a traffic control plan, and an Injury and Illness Prevention Program plan. The Site Safety and Security Plan shall also include the location of emergency utility shutoffs and an evacuation plan. A safety conference shall be scheduled prior to the start of construction to review the experience modification rating, the respective safety requirements, and to discuss implementation of all health and safety provisions related to the Project. Representatives from Provider, every subcontractor and District shall be present at the safety conference. No work shall be performed on the Project prior to written confirmation that District has accepted the Site Safety and Security Plan. Following the commencement of work on the Project, safety meetings will be held once a week with all Provider and subcontractors employees attending. Printed names will be taken of those attending the meeting. No individual will start work at the Site without having attended a safety briefing on the dangers and protocols of the Site. Site Safety and Security. 9.2.1 The Concessionaire will from the Site Occupation Date until the Expiry Date have full regard for the safety of all persons (including Users and Marine Users) on the Site and the Adjacent Areas (whether lawfully or not) and will keep the Site and the Adjacent Areas in a manner and in an orderly state that ensures the safety of such persons and that is appropriate to the avoidance of danger to such persons.
Site Safety and Security. 9.2.1 The Concessionaire will at all times throughout the Contract Period have full regard for the safety of all persons (including Users of the Concession Highway) on the Full Concession Area (whether lawfully or not) and will keep the Full Concession Area in a manner and in an orderly state that ensures the safety of such persons and that is appropriate to the avoidance of danger to such persons, notwithstanding that the Existing O&M Contractor will be responsible for the performance of certain operation and maintenance functions in connection with the Concession Highway during the period from the Commencement Date to the commencement of the O&M Period pursuant to the Existing O&M Contract and notwithstanding that the MOT Section Contractor will be carrying out the MOT Section Works pursuant to the MOT Section Contract.

Should Buyer or any Subcontractor enter a Removal Site without being authorized by a Seller designated site contract administrator or designee, a contractor exception report indicating the violation will be generated by Seller and Seller shall be entitled at its sole discretion to terminate this Contract for cause, and Buyer and/or its Subcontractors, as applicable, will risk losing further business from Seller. BY SIGNING THIS CONTRACT, BUYER REPRESENTS THAT IT HAS READ THE TERMS AND CONDITIONS OF EXHIBIT 3, INTEGRATED SUPPLY CHAIN PERSONAL PROTECTIVE EQUIPMENT, AND ITS SIGNATURE INDICATES ITS UNDERSTANDING OF AND CONCURRENCE, AND THAT OF ITS SUBCONTRACTORS, WITH THE TERMS AND CONDITIONS CONTAINED THEREIN. BUYER SHALL ENSURE THAT ITS EMPLOYEES AND SUBCONTRACTORS SHALL ABIDE BY SUCH RULES WHILE ON SELLER’S PREMISES.

Site Safety and Security. (a) Without limiting Section 8.8 [Responsibility for Participants and Trespassers], the Concessionaire shall, in respect of the Project Site at all times throughout the Term, take such measures as are reasonably required, including fencing where appropriate, to prevent the trespass and access onto the Project Site of any persons not entitled to be on the Project Site or of any creatures including wildlife and livestock.
