Statutory Purpose and Strategic Objectives. DRAFT 2.1 The College is a non-departmental public body (NDPB) established in 2007 under the Further Education (Northern Ireland) Order 1997 (the ‘1997 Order'). Under the 1997 Order, the constitution of the College is specified in its Instrument of Government and the functions/responsibilities of its Governing Body (GB) are set out in its Articles of Government. Any company established by the College will be regarded as an integral part of the College and will be subject to the controls set out in this Partnership Agreement. The College must register any company formed as a company under the Companies Act 2006. References to the College include, where they exist, all its subsidiaries and joint ventures that are classified to the public sector for national accounts purposes. If such a subsidiary or joint venture is created, there shall be a document setting out the arrangements between it and the College. The College does not carry out functions on behalf of the Crown. For national accounts purposes the College is classified to the central government sector. 2.2 The following legislation/guidance sets out the College’s functions, duties and powers: • The 1997 Order; • Articles of Government; • Instrument of Government; • Governing Body Standing Orders; • Guide for Governors; and • The Code of Governance. (See Annex 1 for further details) 2.3 The College is an institution of further education, established under the 1997 Order. Its GB is a body corporate. 2.4 The Minister for the Department is answerable to the Assembly for the overall performance and delivery of both the Department and the College. Statutory Purpose and Strategic Objectives. 2.1 The HIARB is defined as a Body Corporate under Schedule 1(1) of the Historical Institutional Abuse (NI) Act 2019 (the Act). The Act received Royal Ascent on 5 November 2019. The HIARB became fully operational under Schedule 1(2) on the 31 March 2020 with the placing of an advertisement by XXX in the Belfast Gazette. For National accounts purposes the HIARB is classified to the central government sector. 2.2 The HIARB’s statutory functions, duties and powers can broadly be described as receiving, processing and determining applications for compensation to those victims and survivors of historical institutional abuse in residential settings as set out in section 2(3), (4) & (5) of the Act. The Act provides the HIARB with a number of supporting powers as follows: • Powers on how an application for compensation is to be determined and the amounts of compensation that can be awarded. • Powers for the Redress Board to compel the giving of evidence where it is considered necessary in the interests of justice to do so. • Xxxxxx for the President of the Redress Board to issue a restriction order to prevent the disclosure of information or a person’s identity where it is in the public interest to do so. 2.3 The HIARB is a ‘Body Corporate’ and operates independently from the Department of Justice (DoJ) and TEO. Under Schedule 1 (5) of the Act the President appointed by the Lord/Lady Chief Justice (LCJ) of Northern Ireland has responsibility for ensuring the efficient and effective discharge of the HIARB’s functions. XXX is responsible for sponsorship of the HIARB as an arm’s-length body of XXX and for the sponsorship arrangements and financial accountability as set out in the Partnership Agreement. All business cases relating to expenditure incurred by the HIARB under the Partnership Agreement are approved by the HIARB Management Board and TEO. XXX is responsible for the approval of staff requirements under Paragraph 6(1) of Schedule 1 to the Act. 2.4 Ministers for XXX are answerable to the Assembly for the overall performance and delivery of both XXX wider responsibilities for implementation of the Report of the Historical Institutional Abuse Inquiry (ISBN 978-1-908820-91-4) and for specific responsibilities for the HIARB as set out in the Act. 2.5 The Executives outcome-based approach to delivery recognises the importance of Arm’s Length Bodies and Departments working collaboratively and together in a joined up approach to improve overall outcomes and results. ...

It is overseen by a Board which is appointed by the Minister, employs its own staff and is allocated its own budget. For national accounts purposes TNI is classified to the central government sector. 2.2 TNI’s functions, duties and powers are set out in the Tourism (NI) Order 1992 The Tourism (Northern Ireland) Order 1992 (xxxxxxxxxxx.xxx.xx) and are as follows: (a) to encourage tourism; (b) to encourage the provision and improvement of tourist accommodation and tourist amenities; (c) to advise the Department generally on the formulation and implementation of its policy in relation to the development of tourism; (d) such other functions as are conferred on the Board by or under the Order or any other statutory provision. Statutory Purpose and Strategic Objectives. ‌ 2.1 HSENI is the lead body responsible for promoting and enforcing health and safety at work standards in Northern Ireland and was established under Article 12 of the Health and Safety at Work (Northern Ireland) Order 1978 [the Order] as amended by the Health and Safety at Work (Amendment) (Northern Ireland) Order 1998. HSENI is a non-departmental body with Crown status. For national accounts purposes HSENI is classified to the central government sector. 2.2 The Order gives the Health and Safety Executive for Northern Ireland the following: The functions of HSENI are defined in the Order and its subordinate instruments. Under these provisions its functions include: • generally promoting health and safety at work and issuing guidance; • arranging for the provision of health and safety information and advice; • enforcing the provisions of the health and safety legislation; • submit to DfE proposals to maintain an up-to-date health and safety regulatory framework which includes EU Directives; and • in accordance with proposals approved by the Department make such arrangements as it considers appropriate for the carrying out of and publication of research and encourage research and provision of training and information in that connection by others.

Statutory Purpose and Strategic Objectives. ‌ 2.1 CITB NI is a non-departmental public body (NDPB) established under the Industrial Training Act (NI) 1964 and the subsequent Industrial Training (Construction Board) Order (NI) 1964 as amended. The 1964 Act was replaced by the Industrial Training (NI) Order 1984 as amended. For national accounts purposes CITB NI is classified to the central government sector as a Minor Body. 2.2 CITB NIs [statutory] functions, duties and powers are contained in Article 14 to 29 and Schedule 2 of the Industrial Training (NI) Order 1984 as amended. The Board provides the following services for the construction industry and to government: • A direct training service where it is not adequately met elsewhere and encourages adequate training of persons employed or intending to be employed in the construction industry; • Encourages the construction industry to participate in appropriate training; • Provides careers advisory support to assist in the promotion of career opportunities within the construction industry. 2.3 CITB NI is not a company limited by guarantee, but has charitable status for tax purposes and is classified as an Executive Non Departmental Public Body. Sport NI was established on December 31st 1973 under the provisions of The Recreation and Youth Service (Northern Ireland) Order 1973, as the Sports Council for Northern Ireland (as amended) with its main objective being the furtherance of sport and physical recreation. This was replaced by The Recreation and Youth Service (Northern Ireland) Order 1986. For national accounts purposes Sport NI is classified to the central government sector. 2.2 Sport NI is designated in the National Lottery Act 1993, as amended by the National Lottery Act 1998, as the body responsible for the distribution of lottery proceeds for sport in Northern Ireland. 2.3 Sport NI’s statutory functions, defined by the Recreation and Youth Service (Northern Ireland) Order 1986 are as follows: - On matters relating to sport and physical recreation, to advise the Department and other Government departments, Education Authority (EA), District Councils and other bodies interested in sport and physical recreation; - To encourage the provision of facilities for and participation in sport and physical recreation; and ⮚ To assist in the provision of administrative services, equipment, coaching and instruction by bodies providing facilities for sport or recreational activities or organising such activities; ⮚ To assist in the organising or supporting of, or participating in, international or other events, by bodies providing facilities for sport or physical recreation or organising such activities; and ⮚ To assist bodies providing supportive services in connection with sport and physical recreation. 2.4 Sport NI’s principal duties, defined by the Recreation and Youth Service (Northern Ireland) Order 1986 are as follows: - The Department may give such directions as to the performance of the functions of the Sports Council as appear to the Department to be expedient. The Department may direct Sport NI to carry out those functions and the direction may specify how the functions are to be carried out. Statutory Purpose and Strategic Objectives. 2.1 The VPB is defined as a body corporate, with administrative functions exercised on its behalf by a Northern Ireland Department, which will also be responsible for providing the Board with staff and accommodation under The Victims’ Payments Regulations 2020. The Regulations were laid on 31 January 2020 and came into effect on 29 May 2020. The Department of Justice was designated by XXX to exercise the administrative function of the Board on the Board’s behalf on 24 August 2020, as per paragraph 2(1) of Schedule 1 to the Regulations. 2.2 The Troubles Permanent Disablement Payment Scheme (the ‘Scheme’) became fully operational as per the Regulations on 31 August 2021 at 12 noon with the placing of an advertisement by the DoJ in the Belfast Gazette. Statutory Purpose and Strategic Objectives. 2.1 The Agency was originally established in 1995 and was known as the Northern Ireland Guardian ad Litem Agency (NIGALA) until 2023 when it was re-established as the Children’s Court Guardian Agency for Northern Ireland. Its partner department is the Department for the Economy in the central government sector. 2.2 The functions, duties and powers of Invest NI are set out in the Industrial Development Act (Northern Ireland) 2002, Industrial Development (Northern Ireland) Order 1982 (as amended) and Article 3 of the Energy Efficiency (NI) Order 1999. 2.3 Invest NI’s core functions include: • Selective Financial Assistance: providing financial assistance to create, maintain or safeguard employment in NI; • General Powers of Industrial Development: establishing, promoting or assisting any industrial undertaking to develop the economy or promote industrial efficiency; • Assistance for Research and Development and Marketing: providing financial assistance for industry to undertake Research and Development, to market their products and to promote the application, in industry, of the results of scientific research; • Provision of Premises and Sites: the acquisition, development, or disposal of land for use by industry; and • Supplementary Powers: incurring expenditure to exercise, promote or facilitate industrial development that is likely to provide employment in NI. Invest NI may also provide financial assistance towards any inquiries, investigations or research that will advance the core functions outlined above. 2.4 The Minister for the Economy is answerable to the NI Assembly for the overall performance and delivery of both the Department for the Economy and Invest NI. The objectives, targets and performance measures for Invest NI shall be set out in its longer-term Business Strategy and Annual Business Plan, both of which shall be initially reviewed by the Department and ultimately approved by the Minister. 2.5 It is important that partner organisations and departments work collaboratively and together in a joined-up approach to improve overall outcomes and results. 2.6 To that end there is strategic alignment between the aims, objectives and expected outcomes and results of Invest NI and the Department for the Economy.
