The Parties agree that compressed work schedules (CWS’s) will be used ser- vicewide according to the following guidelines and approved schedules, for the purpose of improved productivity and greater service to the public, according to Title 5, United States Code, Sections 6120-6133 (5 U.S.C. 6120-6133).

Compressed Work Schedules. A compressed work schedule is defined as an eighty (80) hour basic work requirement in a pay period which is scheduled for less than ten (10) workdays. The following are examples of widely recognized (a.k.a. traditional) compressed work schedules: (1) 5/4-9: a schedule comprising of eight (8) workdays of nine (9) hours each and one (1) workday of eight (8) hours in each pay period.

Interested full time Administrative and Non-Field Professional employees, except Attorneys, may work compressed pay periods of no less than 8 days per pay period without charge to accruals. b. Compressed work schedules shall be established for a definitive term and may not be terminated by either party during that term absent thirty (30) days notice by any party. c. The time off generated by the compressed work schedule shall be scheduled for a specific day(s) by agreement. d. Start and end times for staff working a compressed work schedule, including a lunch break, shall be established by agreement. e. Employees working a compressed work schedule will continue to work the same number of hours per pay period/carry the same work load as they would if they were not working a compressed work schedule, in accordance with all the other provisions of this article. f. When a holiday falls on a day that an employee with a compressed work schedule is not scheduled to work, the employee shall receive 7 hours of floating holiday leave. The use of floating holiday leave shall be consistent with the provisions of Article 13(E). g. Employees working a compressed schedule shall continue to enjoy all the contractual rights and benefits normally accruing to full time employees not working a compressed work schedule. Notwithstanding the preceding, administrative staff working a compressed schedule shall not be eligible for overtime pay as set forth in Article 8 (A) for those hours worked in excess of 35 hours in a payroll week (not to exceed 40 hours in a payroll week or 70 hours in any payroll period) due to their regular compressed schedule pursuant to a compressed work agreement.
Compressed Work Schedules. 4/9 Work Schedule: This is a fixed schedule where employees complete the basic 80- hours requirement in 8 days of 9 hours of work each day and one day of 8 hours of work with one scheduled non-workday each pay period, totaling 80 hours of work per pay period. To be established, employees request, and supervisors must preapprove, fixed arrival and departure times and a fixed non-workday. Fixed arrival and departure times must be the same for each workday.
Compressed Work Schedules. Full-time employees shall be permitted to work compressed work schedules, as defined in Section 17.02, subject to the following limitations: (a) Employees who elect to work a compressed work schedule shall notify their first-line supervisor in writing of their intention at least two (2) weeks prior to the start of the pay period in which the compressed work schedule (or change) is to begin. The written notification shall include: 1. The proposed effective date of the compressed work schedule (or change). 2. The day during each pay period (e.g., first Tuesday, second Thursday) on which the employee plans to work the eight-hour work shift required under the compressed work schedule. 3. The employee's proposed day off during each pay period. (b) Prior to an employee beginning to work a compressed work schedule, his/her supervisor shall provide the employee with a written determination regarding their scheduled day off and their planned eight-hour day. Management shall determine the scheduled day off for all employees working compressed work schedules, using the following guidelines: 1. Days off shall be scheduled so as to minimize the number of employees in a work unit who are off on the same day (e.g., if a work unit has four (4) employees working a compressed work schedule, none of these employees should have the same day off). 2. In scheduling days off, supervisors shall give due consideration to work requirements and the preferences of individual employees. 3. In the event of a conflict among employees in a work unit regarding the scheduling of days off, supervisors may, if appropriate, give the affected employees an opportunity to resolve such conflicts among themselves. (c) Employees on a compressed work schedule work a fixed tour-of-duty and are not required to sign-in and sign- out. (d) Employees may make changes in their compressed work schedules (e.g., their scheduled day off or eight-hour workday) or may change from a compressed work schedule to a five-day-per-week flexitime work schedule (or vice versa), subject to the following limitations: 1. No change shall be made in the middle of a pay period. 2. An employee shall make no more than one (1) such change during any calendar quarter (e.g., January- March). 3. An employee must notify his/her supervisor in writing of the planned change at least two (2) weeks prior to the start of the pay period in which the change is to take place. Compressed Work Schedules. A. An employee who works a compressed work schedule is not eligible to earn credit hours. With the supervisor’s prior approval, based on limiting factors such as workload or appropriate Management control, an employee may work hours in excess of their compressed work schedule. Hours worked in excess of the compressed work schedule will be paid as overtime. B. An employee who elects to work a compressed work schedule must select a start time and an end time. Employees on a compressed work schedule may, on an occasional basis, request a change to their fixed start and end time with 24 hour notice. Permanent changes may be requested on a quarterly basis. All changes are subject to prior supervisory approval. C. The start and end times selected by an employee will be within the organization's flexible time bands. An employee on a compressed work schedule will not be permitted to set a schedule with an end time after 6:00 p.m.
Compressed Work Schedules. A. Subject to applicable statutes and supervisory approval, employees may elect to work under “5/4-9” or “4/10” models of CWS. Under the 5/4-9 program, employees are scheduled to work 9 hours per day for 8 days and 8 hours for 1 day (excluding the lunch period), with 1 day off every pay period. Under the 4/10 program, eligible employees are scheduled to work for ten (10) hours per day for four (4) days each week, with one (1)day off every week. The EMPLOYER may, for business reasons, exclude certain positions from participating in the 4/10 program. B. Within the EMPLOYER’s mission, staffing and workload requirements, the employee shall be allowed to select the day off and/or 8-hour day (for a 5/4-9 schedule) he or she wishes to have. C. The EMPLOYER may occasionally require an employee to deviate from a fixed work schedule because of a particular work assignment or a particular assignment at a financial institution. D. Employees may work no later than 6:00 p.m. under a 5/4-9 schedule or 7:00 p.m. under a 4/10 schedule. E. The EMPLOYER may reschedule an off-day because of mission, staffing or workload requirements, or based on an employee’s request when consistent with mission, staffing and workload requirements. Except in the case of unforeseen contingencies, an employee will not be expected to forego a scheduled day off. If the employee must forego such day off, he or she will be compensated under the provisions of Article 28, (Other Leave Provisions), or Article 29, (Overtime and Compensatory Time), of this Agreement as appropriate. F. Employees on a 5/4-9 or 4/10 CWS are entitled to basic pay for the number of hours of the CWS that fall on a holiday. 1. When a legal holiday falls on a scheduled workday, the employee will be excused with pay and without charge to leave for the number of hours scheduled to be worked that day. 2. When a legal holiday falls on a scheduled day off, a full-time employee is entitled to an in-lieu of holiday. An in-lieu of holiday is the same as a legal public holiday for pay and leave purposes. The number of hours of paid holiday leave granted on an in-lieu of holiday is the number of hours the employee would otherwise have worked that day. 3. The in-lieu of holiday for a full-time employee is determined as follows: a. When the holiday is on a Sunday, the next workday is the in-lieu of holiday.
