District Initiated Transfer. Employees may be transferred for non- disciplinary reasons under this Article when it is in the best interest of the District. Transfer is a movement from one (1) location or operating unit to another within South Orange County Community College District and within the employee’s same classification. The District agrees that it shall consider voluntary transfers prior to requiring an involuntary transfer. The District shall not be arbitrary, capricious, or discriminatory in the application of District initiated transfers. Except unusual circumstances as determined by the Chief of Police the District shall give fifteen (15) working days notice to affected employees before initiating a District transfer. By mutual agreement between the District and the employee, notice time can be less than fifteen (15) working days. The employee shall be granted, upon written request, the opportunity for a personal conference with the employee’s current immediate supervisor and/or a representative from the Office of Human Resources.

District Initiated Transfer. 6-12) 7.9.1: Subject to the approval of the Board of Trustees, the Superintendent or his/her designee may transfer unit members. Reasons for transfer would include those related to pupil or unit member welfare, enrollment changes, budgetary adjustments and changes in the instructional program. 7.9.2: The teacher to be transferred shall have the right to indicate preferences from a current list of vacancies and shall be given first consideration. 7.9.3: No vacancies shall be filled by means of an involuntary transfer without giving consideration to a qualified volunteer. 7.9.4: An involuntary transfer shall be based upon consideration of the following criteria: ● program needs (including school and student needs) ● appropriate credentials ● academic preparation (including major and minor) ● seniority in the District ● pupil and teacher welfare. 7.9.5: Notice of involuntary transfer for the following school year shall be given to unit members as soon as possible and not later than five (5) working days prior to the end of the school calendar, except when mutual agreement to waive the deadline exists. 7.9.6: When an involuntary transfer occurs due to elimination of a position, and when subsequently a vacancy occurs at the school from which the unit member was transferred, the unit member shall be given first consideration when filling this vacancy. 7.9.7: Involuntary transfers shall not be made for punitive or disciplinary reasons. 7.9.8: The administrator initiating the transfer shall arrange a conference with the teacher and discuss the reasons for considering the transfer. 7.9.9: Any teacher involuntarily transferred shall not be similarly transferred for a minimum of three (3) years unless there are circumstances such as declining enrollment. 7.9.10: It is recognized that it may be necessary to transfer unit members to service on more than one (1) campus. Such transfers shall occur only after principals and/or immediate supervisors, Assistant Superintendent, Human Resources, unit member and representative of the exclusive bargaining agent (if desired by unit member) have met and reviewed the reasons for such assignment to meet the educational needs of the District, unless requirement of such meeting is waived by the unit member.
District Initiated Transfer a. A Board official intending to recommend a transfer shall: i. Give consideration to the teacher's professional and personal goals and wherever possible obtain the teacher's agreement to the transfer. ii. Meet with the teacher at least fourteen (14) days prior to the recommendation being placed before the Board. The nature of the transfer and the reasons for it shall be communicated to the teacher. iii. Permit the teacher to be accompanied by a member of the CTA. The teacher shall have the opportunity to consider the matter and reply before the recommendation is placed before the Board. b. Within seven (7) days of being notified that the decision to recommend a transfer is confirmed, the teacher shall have the right to meet with the Board with a CTA representative present. c. When the decision to transfer a teacher has been made, the transferred teacher and the President of the CTA shall be notified, in writing, of the decision and the reasons for it. d. When the Board transfers a teacher to a significantly different grade level or subject area, the Superintendent and the teacher shall jointly determine, and the Board shall provide, the necessary resources for retraining. e. Transfers initiated by the Board shall be completed no later than May 15 in a school year for the next school year, save when they are necessitated by circumstances not reasonably known to the Board by April 30 in such year.
District Initiated Transfer. 11.3.1 The District may initiate the transfer of any employee in order to balance workloads, reduce excess staff, or to address the needs of the District, its employees and/or its students. Personal preferences of the employee involved shall be considered along with the criteria listed below.

District Initiated Transfer. 37.1 In the event that the District considers a transfer from one school to another for an employee for the ensuing school term due to a change in program, student enrollment, or school staff needs, the employee shall be notified in writing at least thirty (30) days prior to the proposed transfer, provided that this thirty (30) day notice may be waived following consultation with the Association and the employee. 37.2 The employee shall have the right to meet with his/her immediate supervisor regarding the proposed transfer. 37.3 No transfer as defined above shall be made without the consent of the employee except to prevent undue disruptions of the instructional program, in cases of emergency, change in staff requirement due to student distribution, or program changes. 37.4 Any employee accepting the position of an employee on leave shall be reassigned, provided the returning employee returns to his/her original position. 37.5 No employee shall be involuntarily transferred to an area within which the employee is not qualified by training, education, experience or certification requirements. 37.6 No employee shall be subject to an involuntary transfer more than two (2) times within any five (5) year period of time, except in extenuating circumstances such as situations where a specific program is moving to a new location, FTE is being deleted or reduced in an area where an employee’s certification is limited such as vocational education, the employee has a partial FTE or works a partial FTE in more than one building, one of which is gaining or losing FTE, etc. 37.7 Beginning teachers in their first two years of teaching shall not be subject to transfer. 37.8 When the need for an involuntary transfer exists, the following procedure will be followed: A. The appropriate administrator will first inform the total certificated staff or staff affected by the transfer within the school of the need for transfer and the reason for the need. The administrator will then call for volunteers for transfer. B. If there is more than one volunteer, the volunteering employees will be evaluated according to teaching experience, certification, endorsements and No Child Left Behind (NCLB) highly qualified requirements. It is understood a transfer will be denied if an employee has received or will receive an unsatisfactory on the evaluation in the year the transfer would be considered or if the employee were disciplined for a serious matter. District Initiated Transfer. 7.3.1 District initiated unit member transfers may become necessary to meet the operational and administrative requirements of the District. 7.3.2 No District initiated transfer shall be arbitrary, capricious, or discriminatory. 7.3.3 The unit member to be transferred shall be given ten (10) working days advance notice and a reason(s) for impending transfer. At the unit member's request, the reason shall be put in writing. 7.3.4 A District initiated transfer shall not result in the loss of compensation, seniority or any health and welfare benefits for the unit member.
