DISTRICT RIGHTS AND RESPONSIBILITIES. 3.1 The District, on its own behalf and on the behalf of the district, hereby retains and reserves unto itself, without limitations, all powers, rights, authority, duties, and responsibilities conferred upon and vested in it by the laws and the Constitution of the State of Michigan, and of the United States, including, but without limiting the generality of the foregoing, the right: A. To the executive management and administration control of the school system and its properties and facilities, and the activities of its employees. B. To hire all employees, and subject to the Provisions of the law, to determine their qualifications and the conditions for their continued employment or their dismissal or demotion, and to promote and to transfer all such employees. C. To establish grades and courses of instruction, including special programs, and to provide for athletic, recreational and social events for students, all as deemed necessary or advisable by the School District. D. To decide upon the means and methods of instruction, the selection of textbooks and other teaching materials, and the use of teaching aids of every kind and nature, subject to the provisions of Article 8.1. E. To determine class schedules, the hours of instruction, and the duties, responsibilities, and assignments of teachers and other employees with respect thereto, and with respect to administrative and nonteaching activities, and terms and conditions of employment. 3.2 The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the School District, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and then only to the extent such specific and express terms are in conformance with the Constitution and laws of the State of Michigan, and Constitution and laws of the United States. 3.3 This Agreement shall be published and paid for by the School District and made available to each member of the Bargaining Unit. The Union accepts full responsibility for the distribution of the Agreement and the orientation of its membership as to the provisions. 3.4 This Agreement will be published and distributed within a reasonable time of ratification by both parties.
DISTRICT RIGHTS AND RESPONSIBILITIES. 16.1 It is understood and agreed that the DISTRICT retains all of its powers and authority to direct, manage, and control to the full extent of the law. Included in those duties and powers are the exclusive right to: determine its organization; direct the work of its employees; determine the kinds and levels of services to be provided, and the means of providing them; establish its educational policies, goals, and objectives; ensure the rights and educational opportunities of students; determine staffing patterns; determine the number and kinds of personnel required; maintain the efficiency of DISTRICT operations; determine the curriculum; build, move, or modify facilities; establish budget procedures and determine budgetary allocations; determine the methods of raising revenue; contract out work; and take action on any mater in the event of an emergency. In addition, the Board retains the right to hire, classify, assign, evaluate, promote, terminate, and discipline employees. 16.2 The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the DISTRICT, the adoption of policies, rules, and regulations and practices in furtherance thereof, and the use of judgment and discretion in connections therewith, shall be limited by the specific and express terms of the Agreement and by applicable law.
DISTRICT RIGHTS AND RESPONSIBILITIESThe Union recognizes and agrees that the Board, on its own behalf and on behalf of the electors of the District, retains and reserves unto itself, all powers, rights, authority, duties, and responsibilities conferred upon and vested in it, express or implied, by the laws and the Constitution of the State of California and of the United States.

The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the District, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and the law. c. AB 119 requires public agency employers to give union representative access to all new employees during orientation sessions. The word employee in this article refers to the VVTA Member of the Bargaining Unit.
DISTRICT RIGHTS AND RESPONSIBILITIES. CLARENCEVILLE SCHOOL DISTRICT - Board Rights and Responsibilities It is expressly agreed that all rights which ordinarily vest in and have been exercised by the Board, except those which are clearly and expressly relinquished herein by the Board, shall continue to vest exclusively in and be exercised exclusively by the Board without prior negotiations either as to the taking of action under such rights or with respect to the consequence of such action during the term of this Agreement. Such rights shall include, by way of illustration and not by way of limitation, the right to: A. Manage and control its business, its equipment, and its operations and to direct the working forces and affairs of the Clarenceville School District. B. Continue its rights, policies and practices of assignment and direction of its personnel, determine the number of personnel and scheduling of all the foregoing, but not in conflict with the specific provisions of this Agreement, and the right to establish, modify or change any work or business or school hours or days. C. The right to direct the working forces, including the right to hire, promote, suspend and discharge employees, transfer employees, assign work or duties to employees, determine the size of the work force and to lay-off employees, but not conflict with the provisions of this Agreement. Administrators and supervisors shall treat all employees fairly and equitably in all work-related matters. D. Determine the services, supplies and equipment necessary to continue its operations and to determine all methods and means of distributing, disseminating and/or selling its services, methods, schedules and standards of operation, the means, methods and processes of carrying on the work including automation or contracting thereof, or changes therein, the institution of new and/or improved methods or changes therein. E. Adopt reasonable rules and regulations. F. Determine the qualifications of employees, including physical health. G. Determine the number and location or relocation of its facilities, including the establishment or relocations of new schools, buildings, departments, divisions thereof, and the relocation or closing of offices, departments, divisions or subdivisions, buildings or other facilities. H. Determine the placement of operations, production, service, maintenance or distribution of work and the source of materials and supplies. I. DISTRICT RIGHTS AND RESPONSIBILITIES. 1. It is understood and agreed that the District retains all of its powers and authority to direct, manage, and control its operations to the full extent of the law, except as specified in this Agreement. 2. The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the District; the adoption of policies, rules, regulations, and practices in furtherance thereof; and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and by applicable law. 3. The District retains the right to amend, modify or rescind policies and practices referred to in this Agreement during cases of emergency within the context of Federal and State law. An emergency is defined as a natural or man-made catastrophe or action which interrupts or terminates the normal and ordinary conduct of school. Upon resolution of the emergency conditions, all policies and practices of this Agreement shall be reinstated.
DISTRICT RIGHTS AND RESPONSIBILITIES. 1. The District has the responsibility for formulation and implementation of policies and rules governing the educational program and services to the District. No delegation of such responsibility is intended, or to be implied, by any provision of this Agreement. 2. The District retains all the customary, usual and exclusive rights, decision-making, prerogatives, functions and authority connected with, or in any way incident to, its responsibility to manage the affairs of the District or any part of it, consistent with ORS Chapter 243. 3. Rights and privileges of employees in the bargaining unit and the Association are limited to those set forth in this Agreement or provided in Oregon Statutes, and the District retains all prerogatives, functions, and rights except as limited by the terms of this Agreement or by Oregon Statutes. 4. Operational and Managerial Rights and Responsibilities: Without limiting the generality of this Article, it is expressly recognized that the Board’s operational and managerial responsibility include: a) The District’s rights to contract or subcontract work. b) The District’s right to continue in existence any of its present programs in its present form and/or location, or on any other basis. 5. The forgoing enumerations of the functions of the Board shall not be considered to exclude other functions of the Board not specifically set forth; the Board retaining all functions and rights to act not specifically nullified by the Agreement.

The exercise of the foregoing powers, rights, authority, duties and responsibilities by the District, the adoption of policies, rules, regulations and practices shall be limited only by the specific terms of this Agreement and then only to the extent that such specific terms are in conformance with the Constitution and laws of the State of Oregon.

DISTRICT RIGHTS AND RESPONSIBILITIES. District retains all of its lawful rights, powers and authority, except as expressly limited by specific provision of this Agreement. Without limiting the generality of the foregoing, the rights, powers and authority of the District, include, but are not limited to the following: to manage and direct its business and personnel; to manage, control, and determine the mission of its departments, building facilities, and operations; to create, change, combine or eliminate budgeted positions, policies, departments and facilities in whole or in part; to subcontract or discontinue work for economic or operational reasons; to direct the work force; to increase or decrease the work force, and determine the number of employees needed; to hire, transfer, promote and maintain the discipline and efficiency of its employees; to determine the content of job classifications; to set standards of service, determine the procedures and standards of selection for employment and promotion; direct its employees to establish work standards, schedules of operation and reasonable work load; to specify or assign work requirements and require overtime; to schedule working hours and shifts; to adopt rules of conduct and penalties for violation thereof; to require employees to undergo testing for drugs and alcohol; to determine the type and scope of work to be performed by District employees and the services to be provided; to classify positions; to establish initial salaries of new classifications after notification of the Union; to determine the methods, processes, means and places of providing services and to take whatever action necessary to prepare for and operate in an emergency.
