Long Term Unpaid Leave of Absence. A. Upon written request, the Board may grant an unpaid leave of absence for a period of not more than two (2) years (one year at a time) for educational or professional or other purposes and shall grant such leaves where illness or other disability is the reason for the request. B. Upon the return of the employee from such a leave, the Board may discontinue the temporary employment of the person hired for the purpose of replacing the returning employee. C. If, after the return of the employee from leave, the person employed for the purpose of replacing that employee on leave is continued in employment as a regular employee or if he/she is hired by the Board as a regular employee within a year after his/her employment as a replacement, he/she shall receive credit for his/her length of service with the Board during such replacement period.
Long Term Unpaid Leave of Absence. A long term leave of absence of greater than two (2) weeks and up to one (1) year in length, may be granted by the Associate Director, Organizational Support Services or designate, upon written request of an Employee, subject to the following provisions: (a) The request shall be received two (2) months prior to the date on which the leave is to begin; (b) Subject to Article L18 (Layoffs and Recall), the leave shall not change the Employee’s ongoing entitlement to hours of work per week or affect the Employee’s placement on the Seniority list; (c) An Employee may request an extension of up to one (1) year provided the request is received two (2) months prior to the effective date of the extension; (d) The maximum duration of each long term leave and extension shall be two (2) years.
Long Term Unpaid Leave of AbsenceAn Occasional Teacher who has been employed by the Board for one year or more and who has successfully completed the probationary period may request a leave of absence without pay for a maximum period of up to one (1) school year. The Superintendent of EducationPeople and Culture or designate shall not approve any requests for extension that result in the leave extending beyond one (1) year Requests for leaves must be made in writing to the Superintendent of Education – People and Culture or designate. Requests for leaves should be submitted two weeks prior to the anticipated start date of the leave, unless an Occasional Teacher has made every reasonable effort and was unable to do so. An Occasional Teacher shall not be granted a long term leave of absence in two consecutive school years, unless otherwise authorized by the Superintendent of Education – People and Culture or designate. An Occasional Teacher shall be returned to active status on the Occasional Teacher Roster on completion of the leave, provided he/she remains in good standing with the Ontario College of Teachers and meets the Board’s requirements to provide an Offence Declaration or satisfactory Criminal Background Check.

Long Term Unpaid Leave of AbsenceAn employee who has completed three (3) years’ Permanent employment with the Board may be granted an unpaid leave of one full year. Application of the Unpaid Leave shall be done through the Executive Officer of Human Resources or designate. Extension beyond two years may not be granted. Requests for, including the reason for requesting the leave, should be submitted, in writing, to the Manager of Human Resources prior to April 15th in the year prior to the school year in which the leave will begin. Requests received after this date due to extenuating circumstances will be considered on an individual basis. Upon being granted the leave, the employee will sign a statement indicating acceptance of terms and conditions of the leave. An employee granted an unpaid leave shall be given the opportunity to continue participation in the benefit plans held prior to the leave, provided the employee pays the monthly costs of the premium for the leave period, as arranged between the employee and the Board. Upon return from the leave the employee shall be placed in the position/work location held prior to the commencement of the leave if it is still available, or if it is not, shall follow the Layoff and Recall procedures as outlined in the agreement. Seniority shall not be interrupted. In the year of a leave of absence the member shall notify the Board by April 1st, in writing, confirming the Member’s intention to return the following year. The one (1) year vacancy will be replaced by a Long Term Occasional Educational Assistant.
Long Term Unpaid Leave of Absence. 1. The Board or superintendent may grant any employee, with a minimum of one year of service, an unpaid leave of absence of up to one year for parental leave, family need, study, or travel. Such requests for study or travel must be submitted in writing no later than 60 days prior to the start of leave; requests for other leaves must be submitted at least 30 days in advance, except in emergencies. 2. Employees will notify the District in writing of intent to return no later than 60 days prior to the scheduled date of return (90 days for study or travel leaves). Employees who wish to terminate their leaves before the scheduled date of return may inform the District in writing and the District will attempt to place them in the first available position. 3. Upon return from leave, the employee shall be placed in the same or a comparable position in the same pay classification. If no such vacancy exists, then the employee will be placed in another vacant position at the same rate of pay.
Long Term Unpaid Leave of Absence. The District, at its sole discretion, may grant non-medical long-term leave of absence of up to one (1) year. The employee may apply at least sixty (60) days prior to the start of such leave, except in the case of emergencies, and will return on the mutually-agreed-upon return date unless the leave is extended in writing by the District. A replacement employee will be employed on a temporary contract and will have no rights to recall. Persons on unpaid leaves will accumulate seniority for the period of leave.
Long Term Unpaid Leave of Absence. Upon the recommendation of the Superintendent, the Board may grant a teacher a leave of absence without pay for illness, maternity, adoption, child care, disability, educational or professional purposes, or such other leaves as may be deemed appropriate by the Superintendent.   • Unpaid Leave of Absence If an employee is on an unpaid leave of absence, then vacation leave, compensatory time, or sick leave cannot be used for the purpose of maintaining eligibility for an Employer Contribution by keeping the employee on a State payroll for one (1) working day per pay period.

  • Parental Leave of Absence A. Female unit members may use any or all accumulated leave during pre and post-natal care for that period of time she is temporarily disabled, as determined by the unit member and her physician. B. Unit members desiring to use any or all accumulated leave during a period of pregnancy or post-natal care should state this in writing to the Office of Human Resources and Employee Relations using the FMLA paperwork. C. Unit members who use any or all accumulated leave as a temporary disability during pre- and post- natal care must return to active service as soon as her physical health permits according to her physician; unless she requests a leave of absence without pay or she resigns. D. Any non-probationary female unit member who does not wish to use any or all accumulated [sick] leave during pre- and/or post-natal care shall be granted a leave of absence without pay provided that a reasonable notice in writing to the Office of Human Resources and Employee Relations is made in advance. E. Unit members using a leave of absence without pay for pre-natal care, adoption, post-natal care and/or child rearing (not to exceed a period of one (1) year in duration and taken within the first year after birth or adoption) shall have the opportunity to continue benefit programs provided to unit members. Unit members with at least one (1) year of experience with the Xxxxxxx County Board of Education will be required after the first twelve (12) weeks to assume the Board’s share of the premium in addition to any premiums he/she theretofore paid for dependent coverage. Provided that a written, advanced request is made to the Office of Human Resources and Employee Relations the employee on such leave will be offered employment upon expiration of the leave in the first available position in their classification for which they are qualified. The request should be made at least thirty (30) days prior to the return and should include the anticipated date of return. If the return is within ninety (90) duty days and such return is stipulated at the beginning of the leave, the same position shall be offered. F. Adoptive parents may use up to twelve (12) weeks in compliance with Family Medical Leave Act (FMLA) of any or all accumulated leave for the purpose of adoption and/or bonding. G. If using combined sick leave and leave without pay teachers who have at least one (1) year experience with the Xxxxxxx County Board of Education will have premiums paid for a total of twelve (12) weeks per year in accordance with the terms of the FMLA, and have their position held prior to such leave.

  • Unpaid Leaves of Absence 24.01 An employee who has completed one (1) year of continuous service with the Employer may be granted a leave of absence without pay or benefits because of injury, illness, education purposes, employment by the Union, or other personal reasons, including maternity leave. The decision to grant the leave or the length of the leave period will be at the discretion of the Employer with due consideration given to the reasons and evidence presented by the employee to the Employer. Such requests shall not be unreasonably denied. 24.02 All leaves of absence (and any extensions thereof) must be applied for and granted in writing on forms provided by the Employer (with a copy to the employee). Except in cases of emergency, the leave request shall be filed with the employee's Department Head not later than two (2) weeks prior to the date on which the leave is to start. Along with the request for the leave, he shall supply any and all available documentation in support of said leave. This documentation shall consist of medical proof of disability in cases where the leave is for medical purposes and the specific reason for the leave when the leave is for other purposes. An employee will be notified in writing within five (5) working days from the date the application was made of the approval or disapproval of the leave of absence request for ten (10) working days or less. For a leave request in excess of ten (10) working days, the employee will be notified within two (2) weeks from the date the application was made of the approval or disapproval of the leave. An employee who is granted such a leave shall not accrue any benefits during his absence, including seniority. 24.03 Leaves of absence will not be granted for the employee to seek employment with another employer, nor shall any employee work for another employer during the time period he is on leave. Any employee who works for another employer while on leave shall have his leave canceled immediately and be subject to disciplinary action. 24.04 When an employee returns to work after a leave of absence, he will be assigned to the position which he formerly occupied or to a similar position if his former position no longer exists at the applicable rate of pay, provided the employee is able to perform the work. 24.05 An employee may, upon request, return to work prior to the expiration of any leave of absence, provided that such early return is agreed to by the Employer. 24.06 Employees absent from work without authorization or approval shall be considered on an unauthorized leave. An unauthorized leave for a period of more than four (4) eight (8) hour consecutive working days may, at the Employers discretion, subject the employee to disciplinary action, including discharge.

  • LEAVE OF ABSENCE 12.01 Employees requesting leave of absence shall make written application to their Location Manager giving at least seven (7) working days· notice. The Company may, at its discretion, grant such leave of absence for a period of up to three (3) months provided the services of the employees are not immediately required and there is an employee available who has the qualifications to perform the work. Such leave of absence shall be granted in writing, with a copy to the Local Chairperson. Leaves of absence will not be granted during the month of September. In the case of an employee being granted an extended approved unpaid leave 6f absence, the employee may not be permitted to sign for a regular school run and/or the run vacated by the employee may be posted. 12.04 Absolute proof of illness preventing return upon expiration of leave of absence shall excuse an employee's failure to return at that time. 12.05 Leave of absence shall not be granted to enable an employee to work outside the Company's service. Leave of absences or illness longer than five (5) working days will be posted as a temporary position. 12.06 An employee elected as a full-time representative of the Union shall be granted leave of absence without pay while so engaged. 12.07 Upon written request of the National Representative, Local President and/or Local Chairperson, employees delegated and attending general business of the Union shall be granted leave of absence without pay for that purpose. As much advance notice as possible will be given by the National Representative and/or Local Chairperson prior to the effective date of the requested leave of absence. The Company will pay lost time for regular scheduled work for all union leaves under this article to employees at their regular rate of pay and such rate of pay will be reimbursed by Unifor Local 195. 12.08 The name of an employee who is on authorized leave of absence shall be retained on the seniority list and shall continue to accumulate seniority. School bus drivers on an approved leave shall be returned to their scheduled work on the scheduled return date. 12.09 An employee wishing to return from leave of absence prior to the expiration of his approved period of leave must advise his Supervisor at least seven (7) days in advance of the date upon which he wishes to return to work. The Supervisor will, if such leave is due to illness, make every effort to change the work schedule to accommodate the returning employee, but if this is not possible, the employee shall return at the earliest possible date following the receipt of such notification by the Supervisor. If the leave were for other reasons, the employee will resume his duties at a time specified by the Company.

  • Extended Leave of Absence Professional employees who have attained renewable contract status may request extended leaves of absence for one (1) year without pay under any one of the circumstances listed in this section. All requests for such extended leave of absence will be applied for and granted or rejected in writing. Such application will be reviewed by the principal and superintendent. If the latter approves, he/she will recommend that the leave be granted by the Board. An employee returning from an extended leave will be assigned to the same position as that which he/she held before assuming the leave, providing that position still exists. By mutual agreement between the employer and the employees, he/she may be given a different assignment. Extended leaves of absence may be requested under, but not limited to, the following: 1. To serve in a county, state, or national public office. 2. To care for a sick member of the immediate family. 3. To serve as an exchange teacher or an overseas teacher. 4. To accept a sabbatical leave.

  • Union Leave of Absence An employee on an unpaid Union leave of absence shall have her wages, benefits and seniority continued by the Employer, and the Union agrees to reimburse the Employer for the costs of such wages and benefits. Employees requesting leave under this article will provide the Employer with as much advance notice as possible of the dates of the leave. Where there are less than fifteen (15) regular employees at a workstation at the time the leave request is submitted, and subject to operational requirements, unpaid Union leave of absence will be granted to one employee for the purpose of conducting Union business. This would be an additional person on Union leave at worksites where the position of the Union President or Council member has been backfilled for the duration of their term of office. A leave of absence without pay shall be granted to an employee who is a member of the Union and who is: A) a Union Council/Board member. Such leave shall be granted for the purpose of attending regular or special meetings of the Council/Board and shall include reasonable travel time. B) either elected or appointed to represent the Union and/or a region at annual or special conventions of the Union. C) a member of the Union’s bargaining committee. Such leave (including travelling time) shall be granted to attend preparatory negotiating meetings, to conduct negotiations, and to participate in mediation, industrial inquiry commissioner hearings and arbitrations. D) selected by the Union or its members as a delegate to attend the Provincial Bargaining Conference. E) selected by the Union or its members as a delegate to attend regional Bargaining Conference.

  • Return from Leave of Absence (a) Before a Nurse may return to work from a leave granted under Article 9.00, she or he must provide a minimum of four (4) weeks written notice of the specific date of his or her return to work, or such shorter time as mutually agreed. (b) Upon return from an approved Unpaid Leave of Absence, a Nurse shall be reinstated to her or his former position unless the position has been discontinued, in which case the Nurse shall be appointed to an equivalent position. (c) This clause requiring four (4) weeks written notice, does not apply to other leaves granted by an express provision of this Collective Agreement with different requirements for written notice.

  • Sick Leave During Leave of Absence (F/T) When an Employee is given leave of absence without pay for any reason, or is laid off on account of lack of work, he/she shall not continue to accumulate sick leave and shall not be entitled to receive pay for sickness for the period of such absence, but shall retain his/her cumulative credit, if any, existing at the time of such leave or lay-off.

  • ARTICLE LEAVE OF ABSENCE The Employer, may, in its discretion, grant a leave of absence with or without pay to any employee for education personal reasons. Request for leave of absence shall be in writing and submitted to his supervisor who will forward the same to the designated Human Resources representative for approval. An employeeshall not be required to use his accumulated vacation before requesting a leave of absence for non-vacation purposes. The Employer shall grant leaves of absence without pay to up to four (4) employees to attend Union conventions or seminars, provided that: such leave does not unduly interfere with the operation requirements of the Employer; the total leave of absence granted hereunder shall not exceed twenty-five working days per year of the agreement; not more than one (1) employee from any program unit may receive leave hereunder at any one time and; the Union gives fourteen (14) clear notice of such leave to the Employer. Leave of absence due to pregnancy and/or parental leave shall be granted in accordance with the requirements of the Standards Act of Ontario If an employee who has completed his probationary period is required to serve as a juror, he shall not lose his regular pay because of such attendance provided he notifies his supervisor immediately upon notification that he will be required to serve as a juror, presents proof of service and promptly pays to the Employer any amounts paid to him for such service. Employees absent from work for any continuous period of fifteen (15) calendar days or more other than a period of vacation leave or paid sick leave shall not earn vacation or sick leave credits during the period of any such absence and anniversary dates shall be adjusted accordingly except as specified in Article In addition, the Employer shall not be required to contribute to the payment of health and welfare benefits during any such absence. Employees who desire to maintain health and welfare benefits through the Employer must arrange payments of premiums for all such benefits and pay all such premiums through the Employer before commencing any absence. Notwithstanding the preceding paragraph, it is agreed that the Employer shall maintain health and welfare benefits for employees who are off work on Long Term Disability or Workplace Safety and Insurance Board Benefits for a period of up to one (1) year from the date such employee ceased working for the Employer provided the employee pays his portion of the health and welfare benefits premium. An employee shall be entitled to paternity leave which shall consist of one (1)day with pay and two (2) days without pay.
