Special Grievances. (a) A nurse may be suspended, disciplined or discharged only for just cause. Any grievance on these matters will be filed at Step #2 within ten (10) days of such occurrence.
(b) When a meeting is to take place for the above purposes, a nurse will be informed prior to the meeting that this is the purpose of the meeting, and she may be accompanied by her nurse representative.
(c) In the case of suspension and discharge, the Employer will inform the Local Union within twenty-four (24) hours of the suspension or discharge.
(d) Special grievances may be settled by confirming the Employer's action, or by reinstating the nurse with full compensation for time lost or by any other arrangement which is just and equitable in the opinion of the conferring parties, or of the Board of Arbitration if the matter is submitted to arbitration.
Special Grievances. Grievances will be filed at, or advanced to the appropriate stage of the grievance procedure to ensure timely and meaningful decisions. In the event there is a dispute among the parties as to the appropriate stage for filing a grievance, the Labour Relations department and the Union Grievance Committee shall resolve the matter. The parties agree there are three (3) types of special grievances which shall be filed at advanced stages of the grievance procedure:
(i) A question of unjust discharge or unjust lay-off"
(ii) A question of Job Evaluation"
(iii) A question of general application" There may also be other situations where, by mutual agreement, grievances may be filed at an advanced stage of the grievance procedure.
(a) Discharge or Lay-off - A claim by an employee that they have been unjustly discharged, or have been unjustly laid off, shall be treated as a grievance if a written statement of such grievance is lodged with the Human Resources Manager within seven (7) working days after the employee ceases to work for the Company. All preliminary stages of the grievance procedure prior to Stage 2 shall be omitted in such cases. If the employee requests, they shall have the right to interview their Shop Xxxxxxx for thirty minutes at a place designated by the employee's Supervisor before they leave the premises. Such grievances may be settled by confirming the Management's decision in discharging or laying off the employee, or by reinstating the employee with full or partial compensation for time lost as seems just and equitable in the opinion of the conferring parties or arbitrator or the Board of Arbitration, as the case may be.
(b) Job Evaluation - Subject to the provisos set out hereunder, the Union may invoke the provisions of this Article (Grievance Procedure) if:
(i) The Union representatives on the Joint Job Evaluation Committee do not agree with the description and/or evaluation of a new job added to Appendix I by the Company in the manner prescribed in Paragraph 5, Appendix V, or
(ii) The Company representatives on the Joint Job Evaluation Committee do not agree with a requested revision to the description and/or evaluation and/or date of retro-activity of a job contained in Appendix I upon the request being made by the Union in the manner prescribed in Xxxxxxxxx 0, Xxxxxxxx X, that there has been a sufficient change in job content to change the evaluation of the job, or
(iii) The Union representatives on the Joint Job Evaluation Committee do no...
Special Grievances. A grievance involving the actions of an administrator with District-wide responsibilities (such as Curriculum Coordinator or Director of Activities) is to be filed as provided in Section 7.2, and the administrator involved will be considered to be the immediate supervisor for the purpose of processing the grievance. Class grievances involving more than one immediate supervisor may be initially filed with the superintendent as provided in Section 7.3.
Special Grievances. 9.01 Where a seniority employee has been suspended or discharged, the grievance will go directly to Step Three within ten (10) ten days. Such grievance may be settled by confirming the Corporation‟s action or by reinstating the employee with full compensation for the time lost or by any other arrangement which is just and equitable in the opinion of the conferring parties or Board of Arbitration or single Arbitrator if the Arbitration procedure is invoked.
Special Grievances a) Grievances concerning discharge or suspen- sion may be initiated at Step 3 of the Grievance Procedure.
b) Issues which would become moot due to the length of time necessary to exhaust the grievance steps, may be filed at the appropriate advance Step where the action giving rise to the situation was initiated.
c) When an issue arises from an action or decision by a Department other than the Department of Transportation (such as a decision of the Human Resources Department regarding the application of FMLA leave) a grievance may be initiated at Step 2 and filed with the Director of the Depart- ment where the action or decision giving rise to the grievance occurred.
Special Grievances. (a) Nurses shall be discharged, disciplined or suspended only for just cause. A claim by a nurse that he/she has been discharged, disciplined or suspended without just cause shall be lodged as a written grievance with the Medical Officer of Health within ten (10) calendar days of the discharge, discipline or suspension.
Step 1 of the Grievance Procedure shall be omitted in such cases.
(b) Such special grievances may be settled by confirming the Employer’s action in dismissing, disciplining or suspending the nurse, or by reinstating the nurse with full compensation for the time lost, or by any other arrangement which is just and equitable in the opinion of the conferring parties or of the Arbitrator if the matter is submitted to arbitration.
Special Grievances. 5.1.1 The Association may file a grievance as the “grievant” or alleged violations of the Section pertaining to Association Rights.
5.1.2 The Association shall file a “consolidated grievance” if two or more grievants wish to file the same grievance. In such cases all grievants’ names will be listed on the written grievance form. The consolidated grievance will commence at Level 2 after the individual grievants have completed the Level 1 meeting.
Special Grievances. 8.05.01 Grievances may also be initiated by the Union at the Step 2 or Step 3 level, as appropriate, when such grievance is too large in scope to be processed reasonably as an individual employee grievance.
Special Grievances. A claim by an employee, who has completed her probationary period, that she has been unjustly suspended or discharged, may be submitted as a grievance, in writing, within five (5) days after written notice of such suspension or discharge has been given to the employee. Such grievance will be initiated at Step II of the Grievance Procedure.
Special Grievances. Employees shall be discharged only for just cause. A claim by an employee that he has been discharged without just cause shall be treated as a grievance if a written statement of such grievance is lodged with the Executive Director or his designate, within three (3)working days of discharge. Such special grievances may be settled by confirming the Hospital's action in dismissing the employee, or by reinstating the employee with full for time lost, or by any other arrangement which is just and equitable in the opinion of the conferring parties or the Board of Arbitration if the matter is submitted to a Board.
