A Temporary Furlough clause allows an employer to temporarily suspend an employee’s work and pay without terminating their employment. Typically, this clause outlines the conditions under which furloughs may occur, such as during economic downturns or business interruptions, and may specify the duration, benefits continuation, and recall procedures. Its core practical function is to provide flexibility for employers to manage workforce costs during periods of reduced business activity while preserving the employment relationship for future reinstatement.
Temporary Furlough. Temporary furloughs shall be by bargaining unit seniority within affected job classifications and shift. There shall be voluntary and mandatory temporary furloughs.
1. Temporary furloughs shall first be offered to affected employees on a volunteer basis by seniority commencing with the most senior employee.
2. The following provisions shall apply to temporary voluntary furloughs.
a. Temporary voluntary furlough hours shall not be counted as temporary mandatory furlough hours (see below). The Employer will make reasonable efforts not to use temporary voluntary furlough more than once per person in a pay period.
b. Employees volunteering or forced to take temporary voluntary furlough may decide to take paid leave, i.e., compensatory time, personal time or vacation.
c. If additional temporary furloughs are needed, the furloughs shall be mandatory in the reverse order of seniority on a rotating basis (see below).
1. The following provisions shall apply to temporary mandatory furloughs.
a. Temporary mandatory furlough after volunteers are exhausted shall be on a rotating basis within a classification starting with the least senior and by unit/department as applicable. An employee may opt to take their turn of unpaid mandatory furlough in lieu of another employee. Any dispute will revert back to the seniority list. The Employer will make reasonable efforts not to use temporary mandatory furlough more than once per person in a pay period.
b. Employees required to take temporary mandatory furlough may decide to take paid leave, i.e., compensatory time, personal time or vacation. However, at management’s discretion, and during times determined needed for budgetary purposes, temporary mandatory furlough will be unpaid. This is capped at 32 hours per calendar year per employee.
c. The University of Toledo shall not apply either temporary voluntary furlough nor temporary mandatory furlough procedures until Agency, temporary and contingent/intermittent employees in the same classification, in the affected unit, are first put on leave in the order set forth above.
d. There shall be no temporary transfers or other assignments into the position affected by a temporary voluntary or mandatory furlough while the employee in the position is on temporary furlough, except in case of an emergency.
e. Employees not given advance notice of temporary mandatory furlough, prior to reporting to work, who report to work, will be paid 3 hours show-up pay.

Temporary Furlough. An exception to the reduction provision of this Article shall be allowed in the event of a temporary closure of an entire building or facility due to an emergency. In such instance, the District shall have the right to reduce employees within those facilities without regard to seniority or other contractual considerations. Temporary Furlough. 7.7.1 Where a layoff is expected to be of short duration (less than ninety (90) days) or where a layoff could not have been planned for in advance, an employee(s) may be placed on temporary furlough for a period of up to ninety (90) days.
7.7.2 The District may elect to place an employee(s) on temporary furlough as an alternative to a layoff or until a layoff process can be worked out.
7.7.3 A temporary furlough shall not exceed ninety (90) days in duration.
7.7.4 An employee(s) who is subject to a temporary furlough shall continue to receive the paid insurance benefits provided for under Article 11 that were received prior to the temporary furlough for the duration of such temporary furlough.
7.7.5 Any employee contribution to those benefits must be paid to the District by the 25th of the month in order to receive benefits for the following month.
7.7.6 In the event of a temporary furlough, seniority shall not apply, but, rather, the specific employee(s) in the positions affected shall be furloughed.

(3) The Company agrees that it will not contract out work at the specific work location, unless:

If contractors are utilized and exceed ten (10) calendar days, and affected employees are not offered the opportunity to return, such employees will be paid at the rate of pay for their regular classification for all days in excess of the ten (10) days that the contractors work at their specific work location. This payment will be made in the first pay period upon return to work.
B. The process for employee selection for temporary furlough status will be as follows:
(1) The Company will inform Local 1600 of the number of employees by job classification within their respective progression lines to be temporarily furloughed and the qualifications within the classifications that must be retained.
(a) This notification will be completed at least five (5) calendar days prior to the notification to the affected employee(s).
(b) The Company will ask for volunteers in those classifications identified.
i. The company reserves the right to reasonably deny volunteer requests based on qualifications needed to complete remaining work.
ii. Whenever qualifications are equal, Local 1600 seniority will be utilized.
(c) If the Company cannot meet the requirements of the needed reductions with volunteers, then the employee with the lowest Local 1600 seniority in the identified classifications will be temporarily furloughed.
(d) Employees identified for temporary furlough will be allowed to “bump” into lower classifications within their progression line and work location, provided they have the qualifications based on training requirements to perform the work.
