Association Representation. The unit member grievant shall be entitled, upon request, to representation by the Association at all grievance meetings. In situations where the Association has not been invited to represent the unit member, the District shall not agree to a final resolution of the grievance until the Association has received a copy of the grievance and the proposed settlement and has been given the opportunity to file a response to the matter.
Association Representation. The employee may represent himself/herself and/or may request the presence of an Association representative at any meeting scheduled by an administrator where disciplinary action is the subject of investigative questioning.
Association Representation. The Board has no objection to an Association Representative on full-time leave of absence under Clause 18:01 from entering Service premises in connection with his duties as an Association Representative provided the Association Representative obtains permission from the appropriate Unit Commander or Designate before entering Service premises and will similarly report when leaving. Such permission shall not be withheld unreasonably. It is understood the visits may either be pre-planned or spur of the moment. In the former case permission should be arranged in advance. Such Representative may meet with the member during lunch hours or break periods at a location designated by the Unit Commander or his Designee. The Association and the Board shall cooperate with each other in ensuring that these visits do not adversely affect the Department's operations.
Association Representation. 6.01 The Employer agrees to recognize the following representatives of the local Association
(a) A Negotiating Committee of not more than four (4) employee nurses.
(b) A Grievance Committee of not more than three (3) nurses. Every attempt will be made to have a representative from each Lodge where a grievance occurs attend the grievance meeting. The employer recognizes the Bargaining Unit President, or their designate as a member of the grievance committee.
6.02 The Negotiating Committee and the Grievance Committee shall have the right of the assistance of their Labour Relations Officer of the Ontario Nurses' Association at these meetings with the Employer.
6.03 The Association acknowledges that Committee members have regular duties which must be performed on behalf of the Employer and that all absences from regular duties to attend Grievance or Committee meetings must be authorized by the Employer. Such permission will not be withheld unreasonably. In accordance with this understanding and provided the time is kept at a minimum, the Employer will pay Committee members for such time when it is spent during the nurses' scheduled working hours and on the premises of the Employer. Provided, however, that the foregoing shall not be operative at the arbitration stage of the grievance procedure or to such other arbitration, conciliation and mediation as may be provided by legislation or by mutual agreement.
6.04 The Employer agrees with the Local Association to the establishment of a Labour Management Committee. This Committee, which shall be composed of equal representation from each party, of not more than four (4) members from each party, shall endeavour to meet not less than every second month, at the request of either party, for the purpose of discussing items relevant to the services to residents of the Lodge, matters of safety, health and welfare and other matters of mutual concern, other than grievances, relative to the operation of the Lodge. It is understood, however, that there may be times when equal representation cannot be achieved and the parties may agree to proceed or make adjustments on either side to balance the representation. An agenda of items to be put forward for discussion shall be forwarded to the other party by the party requesting the meeting at least two (2) weeks in advance of the proposed meeting. Association Representation. Employees shall be entitled to Association representation at any hearing, meeting or conference involving the Employee regarding disciplinary actions or the investigation thereof at which the Employee is present. Such notice will be given on a form attached herein as Appendix C. When a request for such representation is made, no action shall be taken with respect to the Employee until such representative of the Association is present, provided that no unreasonable delay is incurred.
Association Representation. A. In each step of the grievance procedure, certain specific Association representatives are given approval to attend meetings. Any time away from job duties under this section shall be indicated on the Agency’s form or log if required under Section 4.08 of this Agreement. However, in the interest of resolving grievances at the earliest possible step, it may be beneficial that other individuals, not specifically designated, be in attendance provided that their presence will not interfere with or interrupt normal school or work facility operations. In regard to the adjustment of grievances and the formalization of settlements at the Agency Step, the Association shall designate those employees who have the authority to act on behalf of the Association. The Association President shall serve written notice to the OCB Deputy Director identifying employees. Where feasible, the employee designated to attend such meetings shall be an employee of the Employing Agency in which the grievance was filed. An Association representative who is an employee shall be granted administrative leave with pay, per Section 4.07(B), to attend a meeting held to facilitate the adjustment of a grievance, so long as attendance does not adversely impact the adequacy of the workforce at the Employing Agency.
B. A Grievant and the Association Site Representative shall be allowed time off, with pay at base rate, from regular duties for attendance at scheduled meetings under the grievance procedure. Grievance meetings will usually be held during normal business hours.
C. The Association shall be the exclusive representative of the employee in all matters pertaining to the enforcement of any rights of the employee under the provisions of this Article and in accordance with Chapter 4117.03(A)(5) of the Ohio Revised Code.
D. The Association shall have the final authority in respect to any aggrieved employee, to decline to process a grievance to arbitration if, in the judgment of the Association, the grievance lacks merit or justification under the terms of this Agreement or has been adjusted or rectified under the terms of this Agreement to the satisfaction of the Association. At any Step in the grievance procedure, the Association may decline to file an Association grievance or to withdraw an Association grievance for good reason.

Association Representation. A participating teacher has the right to be represented throughout these procedures by the Association representative of his or her choice.
Association Representation. A teacher has the right to have an Association representative present during any discussions, meetings or hearings under this Grievance Procedure.
Association Representation. 8.01 For the purpose of administration of this Collective Agreement, the Employer agrees to recognize a designated representative from the Bargaining Units and the following committee members of the Association.
(a) Negotiating Committee composed of two (2) nurses selected by the Bargaining Unit provided that the Committee shall be composed of one (1) part-time and one full-time nurse.
(b) Grievance Committee for each Home will be composed of up to three (3) nurses selected by the nurses at Grey Gables provided that the Committee shall be composed of bargaining unit employees from each classification of nurses for the Home.
(c) Occupational Health and Safety Committee pursuant to the provisions of the
8.02 The Association agrees that Local representatives and committee members have their regular duties to perform on behalf of the Employer and that they will not leave their regular duties without first receiving permission from their immediate supervisor. Such permission shall not be unreasonably withheld.
8.03 The Employer shall pay designated representatives and committee members of the Negotiating Committee, Grievance Committee and Nurse-Management Committee their respective salaries, inclusive of applicable benefits, for all regular on-duty time used in processing grievances, negotiating renewal of this Agreement and while attending all meetings of the Nurse-Management Committee with the Employer. In the renewal of an Agreement the payment will be up to, but not including conciliation and arbitration. The Union agrees to reimburse the employer for the salaries and applicable benefits as maintained by the employer.
8.04 The Local Association will provide the Employer with a list, revised when changes occur, of its officers, representatives and committee members.
Association Representation. The Appointing Authority shall not meet with an employee for the purpose of questioning the employee during an investigation that may lead to discipline of that employee without first advising the employee of the nature of the investigation and offering the employee an opportunity for Association representation. Any employee waiving the right to such representation must do so in writing prior to the questioning. However, if any employee is being questioned during an investigation of resident/patient abuse, the employee, upon request, shall have the right to Association representation.
