Assignments Vacancies Transfers. 1. Vacancy shall be defined as a new or existing bargaining unit position which will be open for one (1) school year or longer and that the Superintendent intends to fill. The Superintendent may choose to involuntarily transfer or reassign a certificated individual instead of filling the vacancy. A position shall not be considered a vacancy, however, until it has been offered to all properly-certificated individuals on the restoration list as provided for in the “Staff Reduction Policy” in this contract.
2. Vacancies will be posted in the following manner:
a. When a vacancy occurs all certificated staff will be notified by email at their District-Supplied email account as to the vacancy. It is the employee’s responsibility to ensure that he/she checks his/her email regularly.
b. If a position is posted, an employee may be granted an interview for the position, at the Superintendent’s discretion, if a request for an interview is made in writing within ten (10) days of receiving the email regarding the vacancy.
c. All extra duty vacancies will be posted by sending an email. Any employee interested in the extra duty position should contact the Superintendent’s office in writing or via e-mail within ten (10) days of the date of the email regarding the vacancy.
3. Vacancies will be considered to be filled on the basis of area of certification/licensure, experience, overall teaching performance, seniority as defined in Article III, Section M. 9. and/or legal requirements. Whenever an employee’s request for a posted vacancy is not granted, the teacher will be notified by the Superintendent, and/or his designated representative, and the reasons for the decision as soon as the decision is made.
4. An annual tentative assignment statement for the subsequent school year will be given to each employee on or before the last day of school. If a change in teaching assignment (building and/or subject or grade level) is anticipated for the succeeding school year, the affected change in assignment will be made only after consultation between the employee(s) and the Superintendent. In making changes in teaching assignments, Certification/licensure, experience, seniority, overall teaching performance and/or legal requirements will be considered. 4. If a change of assignment is made on or after August 15 of each contract year and such changed assignment involves two (2) or more preparations, if not taught within the past three (3) years, at the secondary level or more than one (1) grade level, if not taught within the past three (3) years, at the Elementary School, each affected employee shall receive a stipend of $450.00 to offset the inconvenience and the extra work required to make such changes.
5. The District will provide written notice to employees each spring regarding their status for contract renewal or extension by April 15th. Each fall, the district will provide written notice regarding salary placement for the current school year (i.e., column, step, and salary). Grade, subject and activity assignments shall be made by the District, taking into consideration, so far as practical, the employee's professional training, experience, specific achievements and service to the District. Employees shall be given advance notice, in writing, of any change in such assignments except in cases of emergency.

1. When a Member vacates a position as a result of retirement, resignation, transfer, reassignment, non-renewal, leaves of absence (except paid sick leave or unpaid leave if granted by reason of the illness or disability to the Member), death, or termination, unless the Superintendent determines the position is not to be replaced. 2. When a new position is created.
3. When the length of the vacancy is known or reasonably expected to exceed one semester. This vacancy may be filled with a long-term substitute.
4. When a second consecutive year of leave is approved by the Board, the Board will fill that position with a teacher with a regular contract.

Assignments - Every employee shall be given the opportunity to express his/her assignment preference for the following school year by filling out an “Assignment Preference Form” and if desired, requesting a conference with the Program Administrator. This procedure shall be completed prior to the end of the current school year. Assignments are determined by the Program Administrator by genuinely considering seniority. Notification of tentative assignments shall be provided by August 1st.

1. All teachers shall receive their tentative assignments for the subsequent school year no later than July 15.
2. If an elementary teacher's assignment (including classroom assignment) is changed involuntarily, he/she will be granted two (2) release days or two (2) paid (per diem rate) days for preparations.
3. If a high school teacher's assignment (including classroom assignment) is changed involuntarily, he/she will receive release time as follows:
a. If the change affects his/her full assignment, he/she will be granted two (2) release days or two (2) paid (per diem rate) days for preparation.
b. If the change affects only part of his/her assignments, his/her release time will be pro- rated. (i.e. If only two [2] periods are changed, four [4] periods of release time or pay shall be granted.)
4. When required, teachers will be given assistance with the moving of equipment and material.
5. The District may offer and the teacher may accept an early start or late end to their workday schedule. This would be considered a flex schedule where the teacher would be required to work the same number of hours (time) in a workday, but would be allowed to flex their instructional schedule to either, start their day at an earlier time, or end their day at a later time.
Section B - Posting of Vacancies
1. Notice of vacancies for bargaining unit positions, or extra duty positions, including paid non- contract time courses will be posted in each work site in a designated location for a minimum of seven (7) calendar days before the position is filled. A copy of the posting will also be given to the Association president.
2. An employee desiring a transfer to another assignment may submit a request to the District Office on or before April 15 for the following year. If a vacancy occurs in an existing or new position for which a teacher is certified, the District will notify the employee of the vacancy and the time lines for filling the position.

1. Current employees shall be given first opportunity in the filling of bargaining unit vacancies in existing or new positions.
a. First opportunity means that when an employee applies for a vacancy, he/she will be interviewed for that vacant position if, as a teacher, he/she is certified and qualified for the position. The interview will occur prior to opening the position to the public.
