CHECK-OFF/UNION SECURITY. A. The Employer and the Union recognize the right of any employee to become and remain a member of the Union or to refrain from becoming and/or remaining a member of the Union, and neither party will interfere with any employee in the exercise of that right.
B. Each employee shall, as a condition of employment, beginning on the thirtieth (30) calendar day following either the commencement of employment or the effective date of this agreement, whichever is later, either be a dues-paying member of the Union or pay a service fee to the Union. A bargaining unit employee who fails to maintain membership in good standing or pay service fees as required by this Article shall, within ten (10) business days, following receipt of a written notice from the Union requesting their discharge, be subject to discharge if, during such period, the dues or service fees have not been tendered. If a bargaining unit employee’s primary job location is in a jurisdiction where union security clauses are not permitted by law, the provisions of this Section will not apply to that employee. In the event the application of such provisions become permissible in such jurisdiction during the term of this Agreement, the union security provisions in this Section will become applicable to the bargaining unit employee as of that date.
C. The Employer agrees to deduct Union Dues, Initiation Fees and/or Agency Service Fees from the wages of each bargaining unit employee and forward such dues to the Union account by wire transfer on a monthly basis, subject to the provisions of this Article.
D. The Union shall designate the same, specific dollar amount for each bargaining unit employee and/or fixed percentage of base wage rate for Union Dues, Initiation Fees and/or Agency Service Fees in writing to the Employer on an annual basis. The designations cannot be changed during the calendar year for which they apply.
E. Upon receipt of a written authorization signed and dated by a bargaining unit employee on a form approved by the Employer, the Employer shall deduct, from the bargaining unit employee’s pay, the appropriate Union Dues, Agency Service Fees and/or Initiation Fees payable by the bargaining unit employee to the Union during the period provided for in the authorization. CHECK-OFF/UNION SECURITY. Section 1 The Company agrees, during the term of this Agreement, to deduct, weekly, the initiation fee and monthly Union dues from the net earnings due any employee who has executed the Union check-off authorization form. Said authorization must be properly executed by the employee, presented to, and accepted by the Company.
Section 2 The Company agrees to deduct amounts designated by employees for the Active Ballot Club when the Company has been furnished an individual written authorization for making such deductions on a form mutually agreed upon between the Company and the Union. It is agreed that the ABC authorization is to be entirely voluntary upon the part of each such individual employee and that any such employee may revoke the ABC checkoff authorization upon giving thirty (30) days written notice to the Company and the Union. The Company agrees to remit the ABC, Union dues, and initiation fees to the President of the Local Union within ten (10) days after the last pay period of each month. Seniority, New Hire, LOA and Termination reports will be given to the Union via electronic media in a format mutually agreed upon by both parties for the same period of time.
Section 3 The Company may hire new employees from whatever source it desires, but all employees covered by this Agreement shall, in accordance with the ratified State of Colorado All Union Agreement, as a condition of employment, become members of the Union on the thirty-first (31st) day after beginning of employment, to the extent of paying the initiation fee and the membership dues uniformly required as a condition of acquiring or retaining membership in the Union, and shall remain members of the Union to the extent of paying membership dues in the Union, for the duration of this Agreement.
Section 4 The Company and the Union shall not discriminate against any employee in regard to the acquisition or retention of membership, and membership in the Union shall be available to every employee on the same terms and conditions generally applicable to all other members.
Section 5 Upon written notice, from the Union to the Company, that an employee is thirty (30) days in arrears in the payment of Union dues or initiation fee, the Company will discharge such employee unless within fifteen (15) days from the date of said written notice, such employee shall obtain or reinstate their membership in the Union.

CHECK-OFF/UNION SECURITY. Employees in the PST will continue to have Union dues deducted from payroll and advanced to the Union, until such time as they receive their anticipated promotion to the supervisor position which is outside the bargaining unit; at that time, the employee is advised to apply for a Union withdrawal card.
CHECK-OFF/UNION SECURITY. 6.01 As a condition of employment, all bargaining unit employees shall become and remain members in good standing of the Union, upon their first day of hire with the Agency. The Agency shall provide to the Union the name, address and phone number of any new employee within three (3) weeks of that employee’s hiring. An updated list of the membership shall be provided every six (6) months.
6.02 The Agency will deduct from the wages of the bargaining unit members any initiation fees, dues or assessments levied in accordance with the CUPE Union Constitution and By-laws.
6.03 At the end of each calendar month and prior to the last day of the following month, the Agency shall remit to the National Secretary-Treasurer of the Union, the total of the deductions made. The cheque shall be accompanied by a list of the names, addresses, classifications and hours worked of all bargaining unit members.
6.04 At the same time the Income Tax (T-4) slips are made available, the Agency shall indicate the amount of union dues paid by each Union member in the previous year.
6.05 The Union agrees to indemnify and hold harmless the Agency with respect to dues or their equivalent which are deducted from each bargaining unit employee.
CHECK-OFF/UNION SECURITY. A . The Hospital and the VFNHP recognize the right of any nurse to become and remain a member of the VFNHP or to refrain from becoming and/or remaining a member of the VFNHP, and neither party will interfere with any nurse in the exercise of that right .
CHECK-OFF/UNION SECURITY. Section 1: The Employer, shall, for the term of this Agreement, deduct union dues, initiation fees or service fees, initial service fees and uniform assessments from the pay of the em- ployees who are members of the Union, or who elect non-member status, who individ- ually and voluntarily certify in writing, the authorization for such deductions. Deduc- tions shall be made bi-weekly from the employee's check and remitted to the Union office on or before the fifteenth (15th) day of the following month.
Section 2: Every effort will be made to report new hires within a week to the Local Union. For this purpose, the Union will provide applications for union membership to be com- pleted and forwarded to the Union.
Section 3: No provision of this article shall apply in any state to the extent that it might be prohib- ited by state law if under applicable state law, additional requirements must be met before any said provision may become effective, and such additional requirements shall be first met.
Section 4: The Union agrees to indemnify and hold harmless the Employer from any and all claims, demands, suits or other forms of liability arising out of its administration of this Article.
CHECK-OFF/UNION SECURITY. Section 1. The employer agrees to deduct each month from the wages of each employee who signs a check-off authorization and assignment, the amount of his current monthly Union dues set forth by the By-Laws of the Union and twice a month, as close as possible to the 15th (fifteenth) and 30th (thirtieth) of each month remit the total of such deductions, together with a list of deductions to the Financial Secretary of the Union. It is understood that such check-off authorizations are revocable in the manner stipulated therein. A copy of such check-off authorization is attached hereto marked Exhibit "A", and is part of this Agreement (see Addendum #1). Union dues will be deducted bi-weekly. The City agrees to also deduct, at the employee's written request, initiation fees, Committee on Political Education (COPE) and group auto insurance premiums. All deductions are to be taken as a single Union deduction and separated at the Union office when submitted. Changes in the amount to be deducted shall be by written notification from the employee to the Finance Department at least 60 days before the effective date of any change.
Section 2. The Union accepts full responsibility for obtaining check-off authorizations from its members and delivering such authorizations to the Employer. Check-off authorizations must be delivered fifteen (15) days before the dues payday of the month. It is understood that payroll deductions made under this arrangement will be one (1) month in advance.
Section 3. All employees must become members of Local Union ATU 998 after thirty (30) days of employment and shall remain members in continuous good standing in the Union as a condition of continued employment. 105 with the City provided, however, that such condition of employment shall not apply with respect to 106 employees to whom membership is not available upon the same terms and conditions as are generally 107 applicable to any other member or with respect to employees to whom membership was or is denied or 108 terminated for any reason other than the failure of the employee to tender the periodic dues, initiation 109 fees and assessments uniformly required as a condition of acquiring or retaining membership. 110 111 112 ARTICLE IV -- UNION ACTIVITY 113 Section 1. 114 The City agrees to provide space for a Union bulletin board.
