OVERTIME AND SHIFT PREMIUM. (a) Where a shift premium is payable for a shift, the same premium shall apply to all overtime hours worked adjoining that shift. (b) Where an employee is called out between 9:00 p.m. and 4:29 a.m. inclusive, a shift premium of $1.25 per hour for all hours worked between 9:00 p.m. and 4:29 a.m. inclusive will apply.

OVERTIME AND SHIFT PREMIUM. 21:01 Overtime worked from 37-1/2 hours to 40 hours in any one week will be paid on the basis of straight time, and overtime hours beyond 40 hours will be paid at time and one-half. It is understood that any compensated overtime must be approved in advance by the employee's manager. All work performed on recognized holidays (under Article 22:06) will be paid at time and one-half, in addition to holiday pay as provided in 22:09. 21:02 A premium of 10% shall be paid for any shift of at least one week's duration if the majority of the hours fall outside the period from 0800 hours to 1700 hours inclusive. This shift premium shall not be paid if the hours of work are varied to suit the convenience of the employee. It is understood that for payment of shift premium, the variation in hours must be duly authorized in the manner prescribed by the Company. 21:03 The Company recognizes that there will be situations where an employee is asked to be on stand-by for consultation or return to work outside of normal working hours. Stand-by shall be defined as a requirement that employees are readily available for telephone or radio consultation for a definite period of time outside of their normal working hours. This will include organizing others to correct abnormal situations. Persons scheduled for stand-by duty, whether or not they carry portable radios or pagers, will receive two hours pay at straight time for any 24 hour period. Four hours at straight time will be paid when the stand-by occurs on a statutory holiday, Saturday or Sunday. It is understood that any compensated stand-by must be approved in advance by the employee's manager. 21:04 Employees who are called to return to work outside of the normal workday for an unplanned work assignment, shall be able to claim a minimum of four (4) hours of work. An employee receiving compensation under this Article shall have the manager's prior approval to work in such a manner. 21:05 The Company and SEAC recognize the need for some overtime. An employee shall have the right to refuse requests for unreasonable overtime.
OVERTIME AND SHIFT PREMIUM. 13.01 Overtime pay is defined as one and one-half (1½) times the straight time hourly rate and shall be paid for all work performed under anyone of the following conditions (voluntary shift exchanges excepted) that have been authorized by a Supervisor: a. in excess of eight (8) hours worked in a day; b. in excess of eighty (80) hours worked in a payroll period; c. in excess of seven (7) consecutive days; d. within the sixteen (16) hours of the last previous shift worked. For shifts of six (6) hours or less there shall only need to be eight (8) hours between shifts for the purpose of call-ins); e. for hours worked while on the employee’s scheduled vacation. 13.02 A shift premium of twenty-five cents (25¢) per hour will be paid to all employees working eight (8) hour shifts on which the majority of the hours fall between 3:00 p.m. of one day and 7:00 a.m. of the following day. The shift premium will also be paid to employees on part-time afternoon shifts on which the majority of hours fall after 3:00 p.m. A shift premium will not be paid for any period in which overtime or other premium is paid, nor will the shift premium form part of the employee’s regular straight-time hourly rate. Notwithstanding the above it is understood and agreed that no shift premium will be payable to Dietary Aides working less than an eight (8) hour shift. A weekend premium of fifteen cents (15¢) per hour will be paid to all employees for all hours worked during the forty-eight (48) hour period defined by Article 12.03 (the weekend). 13.03 Overtime premium shall not be duplicated or pyramided, nor shall other premiums be duplicated or pyramided. 13.04 In situations where the Food Services Supervisor is absent from their regular duties for a period greater than one (1) day, the Employer will assign an employee to be in-charge. Such employee will receive one dollar ($1.00) per hour in addition to their regular rate of pay for the duration of the assignment. 13.05 The Employer shall, when no supervisor is on duty, designate an RN when employees are on duty to be in-charge on those evening, night, or weekend shifts. Such RN shall receive one dollar ($1.00) per hour in addition to the regular rate of pay.
OVERTIME AND SHIFT PREMIUM. 18.01 The Company and the Union agree that all overtime will be voluntary but shall be allocated and performed in the following fashion. The overtime required on that day shall be offered on rotation in the following order: i) in order of seniority to those employees on the team; ii) in order of seniority to those employees on shift; and iii) in order of seniority to those employees who signed the overtime book. Should all senior employees refuse the overtime; the junior employees on shift will be required to work until a replacement is found. An employee who is forced to work mandatory overtime shall be paid for the amount of time worked in the first hour. If the employee is required to work into the second hour, he shall be paid for the full hour no matter how long into that hour he works. An employee will not be required to work overtime in excess of three (3) hours provided a qualified replacement worker is available and willing to work. 18.02 All employees shall be compensated for all authorized overtime hours worked at one and one half (1 ½) time their regular rate for hours worked in excess of regularly scheduled hours of work per day. In addition, if an employee is called in to work overtime on his normal day off, he shall receive one and one half (1 ½) time his rate of pay for all hours worked for a minimum of three (3) hours at time and one half (1 ½). 18.03 a) The Company will distribute voluntary overtime on a classification seniority basis and post a weekly summary of overtime hours worked on the bulletin board. The distribution of overtime will be on a rotational basis.

OVERTIME AND SHIFT PREMIUM. Hours of work in excess of eight (8) hours in any one day or shift or in excess of forty hours (40) in any one week, shall be deemed overtime hours and shall be paid at time and one-half the hourly rate for the job on which the overtime hours are worked. If an employee does not work on a paid holiday, but does work on his scheduled ‘Day-Off’ in the week in which the paid holiday occurs, the paid holiday (8 hours) will be considered in computing weekly overtime. Overtime is on a voluntary basis and overtime work will be distributed equitably among those employees who normally perform the work involved, provided the employees asked can take care of their own transporta- tion. The procedure to follow in distributing overtime hours is outlined in Appendix No overtime premium shall be paid where the overtime results from change in hours or days of work for the convenience of the employee or employees. Such change shall not be made without the written approval of the xxxxxxx or foremen involved, and no employee shall be allowed to exchange more than two (2) shifts in any one month period. An employee called out for emergency work shall be entitled to be paid for four (4) hours at his applicable hourly rate, regardless of the time worked, or to the pay to which he is otherwise entitled under the overtime provisions of this Article in respect of the time worked on such call out, whichever is the greater. Except that this guarantee shall not apply in the case of scheduled overtime. The Company agrees to provide an adequate lunch to employees who work overtime after their regular shift, without notice prior to the start of their shift.

The College reserves the right to schedule employees in a manner which minimizes the amount of overtime performed by an individual employee, department or the bargaining unit as a whole. Section 13.2. Overtime opportunity for events such as the registration of students shall be offered to the senior qualified employee. Absent unusual circumstances, the College shall distribute a notice through the intra-College mail system advising employees of such overtime opportunity at least one (1) week in advance. Employees interested in being considered shall sign the notice and return it to the Director of Human Resources within three (3) work days. If an employee, who has been assigned such overtime opportunity, should subsequently advise the Director of Human Resources that such employee is unable to work, the College will make a reasonable attempt to offer the overtime opportunity to the next senior qualified employee. All other overtime shall be offered to the senior employee who normally performs the work on a straight-time basis.

In addition, if an employee is called in to work overtime on his normal day off he shall receive one and one half (1 1/2) times his rate of pay for all hours worked.
