Recruitment and Appointment. 11:01 When a new or vacant position in the bargaining unit becomes available, the position shall be filled through a competitive process following a job posting. Positions may be advertised internally and externally at the same time.
11:02 Notwithstanding Article 11:01, first consideration for filling vacancies or new positions shall be given to persons on the re-employment list.
11:03 Where a vacant or new position is to be filled through internal competition, a bulletin shall be posted for a minimum of five (5) days.
11:04 The bulletin shall state the closing date for applications, the location of the position, the classification, the duties and responsibilities of the position, the qualifications required and the salary range. The Union will be provided with a copy of all bulletins as they are issued.
11:05 The selection of employees for vacant or new positions shall be on the basis of qualifications, ability, prior work performance and seniority. Where qualifications, ability and prior work performance are relatively equal, seniority shall be the determining factor.
11:06 An employee who is notified that he or she is an unsuccessful applicant for a vacant position shall be supplied with the reasons for non-acceptance within ten (10) days of making a written request. Such a request shall be made within ten (10) days of receipt of the notification that the employee was an unsuccessful applicant. An employee who has been given the reasons for
11:07 A permanent employee may apply for and be appointed to a term position as a permanent employee provided that the Employer has developed an employment plan which will return the employee to the employee’s permanent position or an acceptable alternate position.

Recruitment and Appointment. Recruitment of the Executive Secretary and support staff shall be in accordance with the procedures set out in Annex A of these Regulations. The Meeting of the Parties shall establish the remuneration and such other entitlements as it deems appropriate for the Secretariat’s staff. The Executive Secretary’s term of office shall be for four years unless otherwise decided by the Meeting of the Parties, subject to a satisfactory performance evaluation to be conducted by the Chair of the Advisory Committee at the end of the first year of employment. The Executive Secretary shall be eligible for reappointment for one additional term. The total length of employment may not exceed eight years.

11:01 All postings for positions covered under this Agreement shall state:
(a) Competition number and classification/job title;
(b) Qualifications required;
(c) Full-time equivalency (FTE);
(d) Hours of work;
(e) Location of the position;
(f) Range of pay; and
(g) Date of closing of the competition.
11:02 All postings shall be copied via electronic mail to the Union.
11:03 Subject to Article 11:04, the selection of employees for vacant or new positions shall be on the basis of skill, ability, experience and qualifications.
11:04 If two (2) or more applicants for a job vacancy or job posting possess relatively equal skill, ability, experience and qualifications for the vacancy or posting then the following process shall apply to award the position to one (1) of those applicants:
(a) The Parties recognize the value to clients and the Agency in having Métis and Inuit employees provide care and services to Métis and Inuit children and families. Therefore, if two (2) or more applicants for a vacancy or job posting possess relatively equal skill, ability, experience and qualifications, then, consistent with Section 11 and other applicable provisions of The Manitoba Human Rights Code, the Agency may, from among those applicants, select a candidate who is Métis or Inuit.
(b) The Parties also recognize the value of long-term service of employment to clients, the Agency and employees. Therefore, if two (2) or more applicants for a vacancy or job posting possess relatively equal skill, ability, experience and qualifications, and are Métis or Inuit, and the Agency intends to select one (1) of those applicants for the vacancy or posting, then the Métis or Inuit applicant with the greatest amount of seniority shall be selected for the position.
(c) If two (2) or more applicants for a vacancy or job posting possess relatively equal skill, ability, experience and qualifications and are not Métis or Inuit then the applicant with the greatest amount of seniority shall be selected for the position.
11:05 An employee who is notified that he or she is an unsuccessful applicant for a vacant position may request a meeting with Human Resources or designate within ten (10) days of notice to discuss the reasons for non acceptance, which meeting shall occur at the earliest reasonable opportunity.

11:01 For the purpose of this Article, “Qualifications” refers to education, knowledge, training, skills, experience and aptitude. “Ability” relates to overall qualities of an applicant with respect to the work to be done.

Subject to Section :03 herein, the selection of individuals by Legal Aid Manitoba for vacant or new positions shall be on the basis of ability, prior work experience and performance, employment equity and seniority. Where ability and work experience, employment equity and performance are equal, seniority with Legal Aid Manitoba shall be the determining factor. Where all other factors and seniority are equal, preference shall be given to candidates employed in a regional office.

31:06 Where a physician is moved from one (1) department to another, or within a department, the Civil Service Commission shall inform the departments or the department concerned of the move. The department from which the physician is moved, or within which the physician is moved, shall release the physician from the position within thirty (30) days of being so informed, or within one (1) week of obtaining a replacement for the physician, whichever is the earlier.
31:07 A physician who is notified that he or she is an unsuccessful applicant for a vacant position shall be supplied with the reasons for non-acceptance within ten (10) days of making a written request to the Civil Service Commission. Such a request shall be made within ten (10) days of receipt of the notification that the physician was an unsuccessful applicant.
31:08 A regular physician may apply for and be appointed to a term position as a regular physician provided that the department has developed an employment plan which shall return the physician to the physician’s regular position or an acceptable alternate position.

11:01 All vacant positions will be posted internally and externally for a period of seven (7) calendar days exclusive of any holidays listed in Articles 24:01 and 24:02.. Each internal posting will state the position, classification, salary range, qualifications and education required, hours of work and the final date and time for applications to be submitted.

11:03 The selection of employees for vacant or new positions shall be on the basis of ability, prior work performance and seniority. Where ability and work performance are equal, seniority shall be the determining factor.

(a) Appointment of a person on a re-employment list;
(b) Promotion and transfer;
(c) Competition or transfer.
11:05 An employee who is notified that they are an unsuccessful applicant for a vacant position shall be supplied with the reasons for non-acceptance within ten (10) days of making a written request to the Employer. Such a request shall be made within ten (10) days of receipt of the notification that the employee was an unsuccessful applicant.
Recruitment and Appointment. 9:01 If the Museum decides to fill a position within the bargaining unit which becomes vacant as a result of promotion, termination of employment, leaves of absence, or a new position being created, such vacancies shall be filled with a present qualified employee who makes application as hereinafter provided. The Museum shall notify the Union if it decides not to fill a vacancy together with the reasons for such decision. The Employer shall notify the Union of their intention within thirty (30) calendar days of the position becoming vacant. Where the position is not going to be filled within ninety (90) days, the Employer shall provide the Union with an update on their intentions with the position every following ninety (90) days unless otherwise mutually agreed upon.
9:02 To be considered qualified, an applicant must meet the minimum required qualifications set forth in the job description for the position.
9:03 When the Museum decides to fill a vacant position or a new position occurs in the bargaining unit, the Museum will post a notice in print or electronic format or email notice thereof to all bargaining unit staff at least five (5) working days prior to the closing date for a vacant position in Pay Groups 1, 2, or 3 or at least ten (10) working days prior to the closing date for a vacant position in Pay Groups 4 through 10. The notice shall be dated and shall include the job description, salary range, and position of immediate supervisor.
9:04 An employee desirous of applying for a vacant position classified in Pay Groups 1, 2 or 3 must do so, in writing, within five (5) working days of the posting of the notice. An employee desirous of applying for a vacant position classified in Pay Groups 4 through 10 must do so, in writing, within ten (10) working days of the posting of the notice.
9:05 Selection of a present employee for the position, from internal qualified applicants, shall be on the basis of ability which may be determined by an interview, past work performance, and seniority, with seniority prevailing in the event of equality of ability and past work performance.
9:06 An employee on leave of absence or income protection shall be notified of all vacant positions or new positions within the bargaining unit. The employee shall provide the Human Resources Department with their preferred method of contact during a leave.
