ROLES AND RESPONSIBILITIES OF PARTNER ORGANIZATIONS a. Police Department Responsibilities The APD will designate a direct point of contact between APD and the ACPS. The point of contact will address any operational and administrative issues and will serve as a consultant for school safety and security issues including assessments and critical incident response planning. The designee will maintain a working knowledge of school rules, regulations, and laws regarding student safety and conduct. The designee will establish and maintain effective relationships with school personnel at the division and school levels. Selection, assignment, scheduling, training, supervision, and evaluation of school resource officers (SROs) will be the responsibility of the APD. However, each of these actions will take into account the input of school personnel, and identified needs and conditions of schools. The SRO shall remain at all times under the control, through the chain of command, of the law enforcement agency. As of July 1, 2020, DCJS SRO certification training is required. ACPS requires that this training be completed by SROs, before any work in a school is allowed. In developing and implementing law enforcement policies and practices that may affect schools, the APD will consult with and take into consideration the views of the ACPS and the school community. The APD will ensure the SRO receives relevant training prior to any assignment in a school and ongoing joint training with school administrators. The training should be aligned with the MOU and DCJS curriculum and in consultation with the ACPS. APD will provide payment for SROs that attend certain school staff meetings and for after-hours police investigations.

In particular, SROs should be invited to attend Seclusion and Restraint training under School Board Policy so SROs are aware of the school staff’s capabilities, but they are not expected to participate in an actual restraint or seclusion under the policy unless they, in the exercise of their law enforcement authority, determine that they must intervene for law enforcement purposes. If intervention is necessary, the SRO exclusively will determine if a student should be handcuffed in accordance with law enforcement training and policies. The SRO Supervisor will ensure that day-to-day coverage is maintained in both the High School and Middle Schools, if feasible. If an SRO assigned to a high school will be absent from the assigned school for more than one consecutive day, the SRO Supervisor shall assign a middle school SRO to cover the high school on a full-time basis for that period. The SRO shall also be responsible for training school administration in issues related to law enforcement and other relevant topics concerning the school. When it is in the best interest of law enforcement agencies and the school, SROs may make presentations to, or participate in, community organized meetings. These meetings may include, but are not limited to, PTA meetings, panel discussions, and focus groups. This point of contact will be available to address any operational and administrative issues regarding the partnership. The point of contact or designee may provide guidance upon request to staff on school safety and security issues, including assessments and emergency planning, as needed. The point of contact and any designee will be provided materials on and be familiar with school policies, regulations, and laws regarding student and school safety protocols. The point of contact or designee should work with APS to establish effective communication mechanisms and relationships with APS’s point of contact. ACPD will continue to facilitate the effective delivery of law enforcement services and collaborate with APS on planning and preparing for matters related to the safety of schools and students, staff, and administrators. ACPD may be requested to schedule supplemental external support for APS during the school day. These needs may vary by school. ACPD can provide staffing for extracurricular events as requested by APS using the special event and activity guidelines, as staffing permits. ACPD will serve on the APS Safety Audit Committee supporting the development of APS emergency operations plans and exercises and will offer assistance to individual schools when resources are available and coordinated with the Department of Safety, Risk and Emergency Management. In an emergency response situation, ACPD shall be granted access to APS facilities for the purpose of keeping students, staff, and administrators safe from an ongoing threat. When practical, ACPD will make every attempt to keep APS administration appraised of any developing scenarios that may impact schools if not directly originating from a school. Each school with an assigned SRO will provide work area(s) for the SRO that allow access to technologies, private interviewing of several persons, and locking storage space for securing physical evidence. FCPS will handle discipline within the school disciplinary process without involving SROs. FCPS policies, administrative guidance, training, and ongoing oversight will clearly communicate that school administrators and teachers are responsible for school discipline and that law enforcement is not to be involved with disciplinary action. We will not be responsible for losses of any kind that may result from your directions to us or your actions or failures to act, and you agree to reimburse us for any loss we may incur as a result of such directions, actions, or failures to act. We will not be responsible for any penalties, taxes, judgments, or expenses you incur in connection with your IRA. We have no duty to determine whether your contributions or distributions comply with the Code, regulations, rulings, or this agreement. We may permit you to appoint, through written notice acceptable to us, an authorized agent to act on your behalf with respect to this agreement (e.g., attorney-in-fact, executor, administrator, investment manager), but we have no duty to determine the validity of such appointment or any instrument appointing such authorized agent. We will not be responsible for losses of any kind that may result from directions, actions, or failures to act by your authorized agent, and you agree to reimburse us for any loss we may incur as a result of such directions, actions, or failures to act by your authorized agent. You will have 60 days after you receive any documents, statements, or other information from us to notify us in writing of any errors or inaccuracies reflected in these documents, statements, or other information. If you do not notify us within 60 days, the documents, statements, or other information will be deemed correct and accurate, and we will have no further liability or obligation for such documents, statements, other information, or the transactions described therein. By performing services under this agreement we are acting as your agent. You acknowledge and agree that nothing in this agreement will be construed as conferring fiduciary status upon us. We will not be required to perform any additional services unless specifically agreed to under the terms and conditions of this agreement, or as required under the Code and the regulations promulgated thereunder with respect to IRAs.
