Staff explain to recipients how a sanction will reduce their XX xxxxx and they stress the requirements for participation in a work activity. Staff provide job readiness training and employment support counseling to recipients with a history of noncompliance.

It is explained to the individual that the experience and skills that they receive participating in work activities, including experience at Work Experience Pogram sites, can be used on their resume. In making a work activity assignment the agency considers the appropriateness of the activity. The agency makes regular telephone contact with the worksites to resolve any issues that might arise. The Welfare Employment Representative closely monitors attendance and tracks clients closely due to the work verification requirements and in doing so, is better able to address attendance issues as they arise and discuss issues including good cause.

The Case Manager for the TANF population also reinforces the need for applicants/recipients to comply with activities they are assigned to. Case managers as well as Employment Specialists provide information to clients on an ongoing basis which include the need to be engaged in work activities.

During the orientation there is a discussion as to why it is important to comply with work requirements as it relates not only to their on-going eligibility but also their ability to achieve self-sufficiency. It is stressed that with any activity they need to have reliable transportation and day care plus back up for both. We discuss supportive services the district can provide in those areas and for day care we provide a referral to those who need assistance finding a provider. The orientation also covers work supports available (EITC, etc) and budget comparisons to show the value of working. These discussions are reinforced at every contact with employment unit personnel. Non-exempt individuals are encouraged to participate in workshops when offered by our community partners that deal with finding, keeping and succeeding in a job.

During counseling by CWD staff underlying issues may be revealed such as mental health barriers, substance abuse, and daycare or transportation issues. Referral to other services will take place and monitoring for improvement by CWD and local district staff will begin. Those individuals who fail to comply with staff recommendations may be referred for conciliation and an employment sanction including a possible reduction or loss of Public Assistance and/or SNAP benefits.

Attendance Describe district policies and/or procedures in place to reduce the amount of time participants fail to participate in work activities, including absences that are with good cause: In February, 2013, the Department began to contract with the W.I.B. for five employment services; Job Readiness Program, Work Experience Program, Subsidized Employment, Services to Work Limited recipients, and Targeted Training. Provision of employment services will be more seamless with all services being provided by one contractor. The W.I.B. will educate the worksite supervisors on the proper reporting of absences and on the need for worksite supervisors to counsel recipients when there is initial non-compliance. The need for appropriate child care and a backup plan is discussed with the recipient at assessment, reassessment, WEP interview, JRT, and work limited orientation. Conciliation notices are sent out, in most instances, within 2 business days after notification to the Department of non-compliance. In the case of an applicant for or recipient of Family Assistance or Safety Net Assistance, the individual must respond to and request a conciliation within the 10 day time frame. For FA cases, it is expected that the case managers contact the individual by phone to conciliate as soon as possible. When there is non-compliance and it has been determined to be both willful and without good cause, the case is referred for sanction. Employment Assessments and development of the Individual Employment Plan, whenever possible, will be conducted prior to case openings. Reassessments and updating of the Individual Employment Plan are scheduled in the recipient's home, worksite, or at HHS.

Clients are advised during the assessment and employment plan process of having a reliable back up plan for childcare and to do their upmost on scheduling appointments when they are not at the workplace. The agency acquires school schedules from many of the county's school systems and daycare systems so the workers can remind clients to pre-plan for those dates.

This payment gives the vendor an incentive to ensure that individuals are fully attending. To help achieve this goal, many vendors contact their participants by phone and mail when they do not participate. • WeCARE vendors provide outreach services to maximize compliance for their clients who are required to attend and cooperate with scheduled appointments and activities. Outreach is one of several services provided by the WeCARE vendor to address barriers, minimize obstacles and encourage participation. In the short term, HRA intends to make this outreach more robust and focused on reasons clients are not attending, and working with those clients to attempt to mitigate their reasons and ensure reasonable accommodations are provided to assist clients in accessing services. • For clients with work limitations and workplace accommodation needs, HRA intends to reform work participation requirements. In the short term, this will entail the increased use of appropriate education/training consistent with HRA approval and allowing full-time non-post-secondary education/training engagement, including full-time HSE and ESL/LEP engagement when appropriate, as permitted by federal law. Also in the short term, hourly work participation requirements will be determined to be 35, 30 or 25 hours per week, based on clients’ needs, while the use of WEP will be phased out and replaced. In the long term, internships, community service and subsidized jobs will be utilized for those who need job readiness strengthening. See Section 3.6. • XXX also proposes that, when a work exemption or reasonable accommodation is given, the worker will check the NYCWAY Activity History to determine whether the recipient has a pending adverse action or whether an adverse action was taken close in time to the granted exemption/accommodation.
